THE UNFAIRNESS OF JUSTICE

Today I have decided to tackle one of the most worrying issues in Spanish society nowadays, the
unfairness of justice.
SUBJECTIVE SYSTEM?
Justice is a system that has been created with the ability to establish an equitable order in society,
punishing those who have committed criminal actions and proving the innocence of those who have been
tried in the first place and have not committed a crime. Despite this, justice has always been a field
criticized not only for its lack of impartiality in several trials due to the thought, in this case, of the judges,
but also the influence generated in it by other fields such as the press or politics. Moreover, unsettling
research into the psychology of courtroom decisions has shown that our personal backgrounds,
unconscious biases about race, gender and appearance, and even the time of day play a more important
role in outcomes than the actual law.
POLITICS INFLUENCE
A particularly aggravated case is that of the influence of politics on the law. The most numerous cases
consist of granting personal administrative concessions among high-ranking persons without following
the concession protocol or without these people ACHIEVING the requirements established for this. it's
about personal favors between mayors with their political party or simply with people from their personal
circle. but the most serious case is that in which judicial favoritism can be appreciated, when the
constituents of a political party, judges or those persons belonging to the high political or judicial sphere
commit a crime, related in most cases with his position, whitening of capital, fraud ... his judicial process
is usually delayed in time, and the penalty is usually less or even consists of paying a sum of money and
the removal of his office, without having to serve jail.
PRESS INFLUENCE/THE MEDIA’S INFLUENCE
The media serves as the primary public source of crime information. However, in several cases the
sensationalism of the press makes journalists exaggerate the facts, transgress the limits of personal rights
to the person, such as the right to family privacy and even create irreparable damage to the families of
the victims. This happened with the case of Diana Quer, a Spanish girl who was supposedly kidnapped in
2016 and recently her body was found in a well, she was killed by a man from her city. It was a very
controversial case in the media as a result of they began to assume facts about the family that were mere
assumptions, such as that Diana Quer did not get along with her family and had run away or that she was
a rebellious girl who did what she wanted, being totally involved in his private life and going beyond the
limits of respect.
GENDER AND RACE DISCRIMINATION
From my point of view, the main issue in the Spanish and American judicial system is discrimination, both
of race and gender. Undoubtedly the latter is one of the most worrying today because of the number of
cases that occur and that continue to happen every day. In 2017 there were almost 50 battered women
murdered by their partners, which is called macho violence. The gap in the Spanish judicial system is that
it does not include women murdered by men in gender violence, if not only those who are a couple, so
the number of women murdered is much higher. In addition, the penalty for sexist violence is more
aggravated, whereas if a man kills a woman he did not know at first, it is classified as normal homicide. On
the other hand, violence against black people has aroused several criticisms against the American police
system. The incarceration rate of blacks (African Americans) is more than three times higher than their
representation in the general population. The accusation discriminated in many cases to the black people
is blamed, according to some journalists to the Insecurity among whites who fear progress by blacks will
cost them economic status and political power.
