I, NORMA A. LACABA, of legal age, married, Filipino and a resident of Sitio

Hitaas, Barangay Benanalan, Sta. Rita, Samar, after haing been duly
sworn to in accordance with law hereby depose and say that:

1. I am executing this Affidavit for the following purposes:

a. To testify on what I personally know about the past living

status/situation of my former co-worker, Guida Pelareja;

b. To testify on what I have witnessed in 1993 in relation to

alleged signing of my former co-worker of the Deed of Sale
presented by herein Respondent in his Answer; and

c. Such other material and relevant matters;

2. That I am hereby answering the questions presented to me, fully

conscious that I am doing the same under oath and that I may
face criminal liability for false testimony or perjury;

3. I hereby warrant that the attached Annexes/Exhibits in this Judicial

Affidavit are faithful reproductions of the original and/or certified
true copies of said attached annexes and/or exhibits. I also hereby
undertake to bring the original and/or certified copies to the Court,
for comparison and verification of the authenticity of the same;

4. The questions and answers as stated in this affidavit are now in

English form, a language known to me. The questions and answers
are the same questions and answers that my attorney asked me
during the taking of this Judicial Affidavit and I have verified that
 the answers are the same answers I have given already now
translated into English language. Prior to signing this Judicial
Affidavit, I have read the same and the same is consistent with all
the questions and answers I have given during the taking of the
interview with my lawyer;

5. The following statements, in question and answer form is hereby

testified to in this Affdavit before Atty. Sherry Mae A. Arcales, a
resident of Barangay 9, Catbalogan City, Samar at her office in
Catbalogan City, Samar, to wit:

Q1: Good morning, Ms. Norma, kilala mo ba an nagkiha o nag-file hine

nga kaso ha korte?
(Good morning, Ms. Norma, do you know the PLAINTIFF or the one who
filed this case in Court?)
A1: Yes, Ma’am.

Q2: Hino hiya, an mga nag-file hine nga kaso?

(Who is the PLAINTIFF in this case?)
A2: GUIDA PELAREJA.

Q3: Kay ano mo hiya kilala?

(Why do you know her?)
A3: Kilala ko hiya kay nagka-trabaho kami han una.
(I know her because we used to be co-workers.)

Q4: Diin mo hiya naging katrabaho?

(Where did you become co-workers?)
A4: Ha Broadway Puto and Bakery ha 10th Avenue, Caloocan City.
(In Broadway Puto and Bakery at 10th Avenue, Caloocan City.)

Q5: Pira nimo ka-tuig naging katrabaho hi Ma’am Guida?

(How many years did you work with Ma’am Guida?)
A5: Napulo ka-tuig. Tikang 1989 hasta 1999.
(Ten years. From 1989 until October 1999.)

Q6: Ano an rason kay ano nga aanhi ka yana dinhe ha akon opisina?
(What is the reason why you are here now in my office?)
A6: Gusto ko mahipasabot ha korte nga waray gud umuli hi Ate Guida ha
Samar han June 21, 1993. Imposible nga umuli hiya hito nga mga
panahon.
(I would like to inform the Court that Guida did not go home to Samar on
June 21, 1993. It was impossible for her to have gone home during that
time.)

Q7: Kay ano ka nakasiring nga imposible nga nakauli hiya hadto nga
mga panahon?
(Why do you say that it was impossible for her to have gone home during
those times?)
A7: Kay magkaupod kami hadto nga mga panahon. Stay in man kami ha
balay han amon amo. Usa la an amon ginkakaturugan didto la ha gawas
han kwarto han amon agaron kay gusto niya guin-iihap kami bag-o
kumaturog. Usa ka beses la hiya nakakauli ha usa ka tuig kay strikto hin
duro an amon agaron. Diri kami gintutugutan mag uli-uli. Hi Ate Guida,
usa ka beses la nakakauli ha usa ka tuig. Kada patron la ha ira pag
January.
(Because we were together during those times. We were stay in staffs at
the house of our boss. We used to sleep in the same place just right
outside the room of our boss because she would check if all of us were
there before we rest at night. She could only go on a vacation once a
year because our boss back then was very strict. She would not allow us
to go on vacations. Guida could only go home once a year during their
town fiesta on January.

(How many days in a year was Ma’am Guida allowed to go on
vacation?)
A8: Maiha na an usa ka semana. Strikto kasi hin duro an amon agaron
amo an usa ka semana nga bakasyon, api na an pag-biyahe pauli ha
probinsya ngan an pabalik ha Manila.
(One week is already a long vacation. Our boss was very strict that is why
the travel time going to the province and the travel time going back to
Manila is already included in her vacation.)

6. I am executing this affidavit to attest to the truth of all the foregoing

and to state all that I know relating to this case.
