Dear Parent,
You are aware that for the past few months, the school has been engaged in several rounds of
discussions with a few disgruntled parents with a view to amicably resolve various issues which
did not materialize.

You are also aware that inspite of agitation / dharnas etc, the school management did not take any
stern action against the erring parents at that time as the school firmly believed in the process of
discussion / mediation and treated the disgruntled / erring parents as a part of big family.
However unfortunately the disgruntled parents filed a complaint with the police of alleged
collection of capitation fees etc even though they had agreed and unconditionally paid the
applicable fees of quarter 1 and 2 along with late fees of Rs.100/- where ever applicable. The
aforesaid complaint was referred by the police to the Education Department for their opinion
/ decision. Pursuant to the aforesaid complaint a joint meeting was held on 7th February 2015 by
the education department officials and all points of dispute were put forward and explained in
detail by the respective parties assisted by their lawyers. This meeting was attended by:

· The Education Department officials


· Law enforcement officials
· The Management
· Principal & Vice-Principal
· Legal advisors for the school
· Some volunteer parents
· 4 representatives from the disgruntled parents group
· Advisor for the disgruntled parent group

As informed earlier, we were awaiting the decision of the Education Department hence refrained
from commenting on any aspect of the matter with a view to avoid unnecessary
miscommunication. We have now received an official report / order from the Education
Department dated Monday 9th March 2015 which is attached herewith along with the English
translation of the said report. You will note from the said report / order of the Education
Department that the main grievance / complaint of the disgruntled parents against different fee
structure for Pioneering and Non Pioneering batch and late fee of Rs.100/- per day has been
REJECTED by the Education Department.

The school urges you once again to only believe written official signed Report of the Education
Department and refrain from believing inaccurate and exaggerated reports circulating in the social
media including Whats App especially regarding alleged oral discussions and decisions of Hon`ble
Minister Shri. Tawdeji who has been disrespectfully referred to as "Vinod Tawde".
The disgruntled parents should take note of the above report of the Education Department and act
accordingly.

REPORT

Sub: Complaint against JBCN International School, Borivali (W)
Reg: Letter dated 20.1.2015 from Sr Police Inspector, MHB Colony, Borivali West

Regarding the above subject, a meeting was held on 7th February 2015 at 3.00pm. This meeting was held in
the school premises. Matters given in the complaint were discussed in the meeting. Trustees, Principal,
parents and legal advisors were present from both the sides.

Discussion Points:
1. Regarding Late fees :
The school charges Rs.100/- per day as late fees after the due date. The parents contended that the
same is not as per the Maharashtra Capitation Fee Act.
2. National Geographic and study kit:
The parents contended that the School forces parents to purchase the National Geographic magazine
and study kit
3. Pioneer & Non-pioneer :
The parents contended that the school is discriminating by charging two different kinds of fees.

Report from the Education Department regarding the discussion points:

1. Late fees:
The Education Department does not fix the fees of Private Unaided schools. The management of the
institution has the authority to decide the fees and control it. The school should charge the late fees as
per the timelines and rules and regulations decided by the management.

2. National Geography and study kit :


Buying of uniform, study kit and National Geographic magazine from the school or any authorized
vendor appointed by the school is not compulsory. The school has clarified in the meeting that they
have not made it compulsory and these items are optional now & will continue in future as well.
However, wearing the school uniform and carrying prescribed study kit items is mandatory.

3. Pioneer & Non-pioneer :


A report regarding the pioneer and non pioneer fees has been given on 21.11.2014 by Asst Deputy
Education Inspector. The total number of students in the school from Nursery to Grade 9 is 1162 , out
of these 220 are from the pioneer batch, and 942 from the non pioneer batch. This implies that only
19% students are in the pioneer batch.
All 100% parents of the school have paid the full applicable Q1 & Q2 fees. Out of the 1162 students,
only 43 students have not paid the Q3 and Q4 fees. Rest of the students fees have been received for
Q3 & Q4.
The subject for the parents contention is whether point 1 (late fee) & point 2 (National geography and
study kit) violate the Capitation Fee Act of 1987.

If the Education Department decides or approves the fees of an institution and the said institution
charges more than the approved fees, then it is known as Capitation Fee. Since JBCN International
School’s fees have not been decided by the Education Department or the Government therefore,
JBCN International School has not violated any rule. Hence there is no question of capitation fee
collection by JBCN International School.

At the end of the meeting the Education department officials suggested to the Management & parents,
that incase of further clarification on the said topics they should approach the Education department
with a written request. The school Management has already submitted a written clarification on the
above mentioned topics to the Education Department.

The Education Department has made this report based on all the above mentioned facts.
