AFFIDAVIT

I, DAVE LESTER H. CEA, of legal age, Filipino, single and a resident of

Purok Sampaguita, Brgy. Saliao, Esperanza, Sultan Kudarat, after having been
duly sworn to in accordance with law, do hereby depose and say:

1. That I am the above named person and the authorized driver of

MITSUBISHI FUSO TRUCK bearing plate number YCK-921 owned by my
father;

2. That sometime on February 27, 2015, I was hired to transport fish to

Cebu City from General Santos City;

3. That on my way going back to General Santos City, the motor vehicle I
was driving suffered mechanical breakdown somewhere in San
Francisco, Agusan del Sur;

4. That while I am repairing the said truck somebody called me if I

wanted to have a back loadto be delivered in General Santos City, so I
agreed though the person contacted me did not tell me what exactly
be loaded to my truck;

5. I was surprise later, when I saw pieces of lumber, so I ask the person in
charge if the lumber have a permit and I was told that there was a
permit and the lumber will be needed for construction of the church of
Manny Pacquiao in General Santos City;

6. The person in charge of the lumber was known as Jimmy Laeno and I
keep on asking from him if where is the permit and he keep on telling
me that he will show it to me later;

7. That the truck was apprehended when we reach Crossing Cuevas,

Trento, Agusan del Sur;

8. That I was thinking all along that the said lumber has a permit;

9. That I am executing this affidavit to attest to the truthfulness of the

above statements based on my personal knowledge and for any legal
purposes it may deemed best.

I, EDUARDO P. CEA, of legal age, Filipino, married and a resident of

Purok Sampaguita, Brgy. Saliao, Esperanza, Sultan Kudarat, after having been
duly sworn to in accordance with law, do hereby depose and say:

1. That I am the above named person and the registered owner of

MITSUBISHI FUSO TRUCK bearing plate number YCK-921;

2. That the said truck was driven by my son Dave Lester H. Cea;

3. That the said truck was involved in Administrative Case in Department

of Environment and Natural Resources (DENR), Bunawan, Agusan del
Sur;

4. That as the owner of the said motorvehicle, I know the same has been
hauling cement at the port of General Santos City to the bodega
located outside the port of General Santos City;

5. Since, Novemebr 2014, my said truck was hauling cement and what I
know is that if there is no hauling of cement, my truck was just in the
port of General Santos City waiting for cement to be transported;

6. I did not know that my truck sometime on March 2014 traveled to Cebu
City to transport fish and on its return it was hired to transport logs
from Surigao to General Santos City;

7. That I have no knowledge or prior information that my said motor

vehicle be used to transport lumber;

8. I was just surprise when I was inform sometime on March 10, 2015,
that my said motor vehicle was apprehended for transporting logs;

9. That I am executing this affidavit to attest to the truthfulness of the

above statements based on my personal knowledge and for any legal
purposes it may deemed best.
