COMPLAINT-AFFIDAVIT

I, ORVILLE ANG Y DAVIS, of legal age, single and resident of Brgy. Rizal,
Buenavista, Guimaras, after being sworn, depose and say:

1.That at around 1:30AM in the morning of 22 October 2012, I was at the

benefit dance which was being held at the Brgy. Sto. Rosario, Buenavista, Guimaras,
Public Market which was in connection with the celebration of the barangay fiesta of
said barangay on 21 October 2012;

2. That I was together with my girlfriend Maribel S. Valdez, her younger sister
Cherremae S. Valdez and their second cousin Nieva Jane Monton;

3.That also in the venue were Michael Gallo Y Sagre and Hernan Selebio, married
and single respectively, both residents of Sto. Rosario, Buenavista, Guimaras, who, at
the time when we arrived there, were already heavily inebriated but since we know
each other and we were friends, me and my group decided to join them in their table;

4. That when I had to relieve myself at the restroom, I was joined by Michael
Gallo Y Sagre who, told me he was “solved and drunk”;

5.That although I know that Michael Gallo Y Sagre was a known trouble maker at
benefit dances and food courts, I never suspected anything because we were friends
however, when I was standing near the table after relieving myself, suddenly, said
Michael Gallo Y Sagre delivered punches on my face hitting me on my nose and
forehead and then he pulled out a sort of screwdriver and thrust it on my head hitting
me behind my ear. At about the same time, Hernan Selebio was also delivering fist
blows at the back of my head and my back;

6.That then Barangay Tanod Mark Ferraro intervened and together with other
persons pulled us apart and then Barangay Chairman Mateo Ferraro Jr arrived and
placed under arrest the person of Michael Gallo Y Sagre and when the policemen
arrived, Michael Gallo Y Sagre was loaded there and I also boarded the same which

proceeded to the Buenavista Police Station where booking was done and said Michael
Gallo was detained therein;

7.That the person of Hernan Selebio fled to unknown direction immediately after
he delivered those fist blows at my back;

8. That as a result of the fist blows and mauling employed by Michael Gallo Y
Sagre and Hernan Selebio who obviously acted in concert and were complicit in each
other’s acts, I suffered a “loosened front tooth” that requires extraction, and inflamed
cheek, upper lip and abrasions. With the extraction of my front tooth, it results to a
permanent “deformity”;

9.That I hereby append the police blotter report (Annex A), Medico-Legal
Certificate (Annex B) and Dental Certificate (Annex C);

10.That I therefore execute this Complaint-Affidavit for the purpose of filing a

case for Serious Physical Injuries as defined and penalized under par 3, Art. 263 of the
Revised Penal Code as amended against MICHAEL GALLO Y SAGRE and HERNAN
SELEBIO, whose addresses are at Brgy. Sto., Rosario, Buenavista, Guimaras.

IN WITNESS WHEREOF, I hereunto sign this affidavit this _____ day of October
