ACOMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This Agreement is executed this ____________ in

______________ by and between:

xxx, Filipino, of legal age with address at c/xxx Law

Offices, address, (hereinafter referred to as FIRST
PARTY)

-and-

xxx, Filipinos, of legal age, with address address

(hereinafter collectively referred to as the SECOND
Party).

WITNESSETH: That -

WHEREAS, the FIRST PARTY is the Private Complainant in CASE

NO. pending before the Pasay City Prosecutor’s Office for B.P 22 & Article
315 (2)(d) of the Revised Penal Code (the “Criminal Case”) and SECOND
PARTY are the Respondents in the Criminal Case.
WHEREAS, the SECOND PARTY received from the FIRST
PARTY, on different occasions, the total (aggregate) amount of ONE
MILLION THREE HUNDRED SIXTY THOUSAND PESOS (Php 1,
360,000.00).
WHEREAS, SECOND PARTY issued various checks equivalent to
ONE MILLION THREE HUNDRED SIXTY THOUSAND PESOS (Php
1,360,000.00), on different dates, in favor of the FIRST PARTY in
consideration of the total cash received by them.
WHEREAS, the ALL CHECKS issued by the SECOND PARTY
were DISHONORED by reason of “ACCOUNT CLOSED.”
WHEREAS, despite verbal and written notice, the SECOND PARTY
failed to make good the checks and consequently, the FIRST PARTY filed
the Criminal Case.
Whereas, the SECOND PARTY has offered to pay the FIRST
PARTY the total amount of TWO MILLION PESOS, Philippine currency
(Php 2,000,000.00) inclusive of interests, as settlement of the civil aspect

and as a consideration for the eventual dismissal of the criminal case, and
the FIRST PARTY, to buy peace and avoid a protracted litigation, has
accepted the offer.

NOW THEREFORE, in consideration of the foregoing and the

further covenants hereinafter set forth, the parties agree as follows:

1. Consideration. The SECOND PARTY shall pay the FIRST

PARTY the total amount of TWO MILLION PESOS (Php 2,000,000.00)
inclusive of interests in accordance with the following schedule:
1.1. Down payment of Php ________________________ to be
paid in cash, upon the signing and due execution of this
Compromise Agreement.
1.2. Balance of _____________________________ shall be paid

1.3. Respondent xxx shall issue corresponding checks for the

aforementioned payments and deliver the same to the FIRST
PARTY at the time of the signing of this Agreement.

2. Archiving of the Criminal Case. The parties agree to cause

the archiving of the criminal case pending the full payment of the amounts
stipulated above.
3. Affidavit of Desistance. After the total consideration is paid
in full, the FIRST PARTY and SECOND PARTY shall cause the revival of
the case and the FIRST PARTY shall execute the corresponding Affidavit
of Desistance.
4. Default of the Second Party. In the event the SECOND
PARTY fails to pay the monthly installments and/or if any of the above
checks is dishonored for whatever reason, the FIRST PARTY have the
option to revive and continue the prosecution of the criminal cases.
5. Effect/s on other cases. This Compromise Agreement shall
not affect nor prejudice any case or cases between the parties not
specifically referred to herein.
