Good day Mr. Randall,

I am the counsel of Mrs. Joanna Mel Suniga Lunaria (Joanna), the wife of your employee,
Mr. Aaron Otico Lunaria (Aaron). During their marriage, they begot a daughter named, Stacey
Quinn Suniga Lunaria (Stacey) on 17 March 2011. Stacey’ is now six (6) years old.

We are writing this letter to formally demand support from Mr. Aaron. We are asking your
good office to kindly deduct Php 5,000.00 from Mr. Aaron’s salary in support of their Stacey’s
basic needs. Said amount can be deposited to Ms. Joanna’s bank account to be disclosed
thereafter. Mr. Aaron neglected their child by his failure to give their agreed monthly support.

Support, as defined under Article 194 of Executive Order No. 208, otherwise known as
“The Family Code of the Philippines”, comprises everything indispensable for sustenance,
dwelling, clothing, medical attendant, education and transportation in keeping with the financial
capacity of the family.

The education of the person entitled to be supported referred to in the next preceding
paragraph shall include his schooling or training for some profession, trade of vacation, even
beyond the age of majority. The same Article also explained that transportation shall include
expenses in going to and from school, or to and from place of work.

Said amount will be used for Stacey’s education and basic needs. We would like to clarify
that the amount being demanded by my client must come from Mr. Aaron’s salary and not from
your company. I would also like to inform you that the unreasonable deprivation of Mr. Aaron’s
child’s basic need is a criminal act. It is considered as an act of child abuse as defined under Section
3(b)(3) of Republic Act No. 7610, also known as Special Protection of Children Against Child Abuse,
Exploitation and Discrimination Act. It states:

“(b)child abuse refers to the maltreatment, whether habitual or not, of the child
which includes any of the following:

(1) xxx
(2) xxx
(3) Unreasonable deprivation of his basic needs for survival, such as food and
shelter.”

Further, Section 16 of the same law provides that:

“Any person who shall violate any provision of this Article shall suffer the penalty
of a fine of not less than One thousand pesos (Php 1,000.000) but not more than
Ten thousand pesos (Php. 10,000.00) or imprisonment of not less than three (3)
months but not more than three (3) years, or both at the discretion of the court.”

we will be forced to file the appropriate civil or criminal cases against Mr. XXX
