The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):

Charge Description: That on or about February 12, 2018, in the City of Minneapolis, Hennepin County,
Minnesota, WESLEY NORMAN MARTIN, alone or aiding and abetting others, took personal property
from the person or in the presence of Victim, knowing that he was not entitled to the property and used
and/or threatened the imminent use of force against Victim to overcome her resistance or powers of
resistance to or to compel acquiescence in the taking or carrying away of the property, and inflicted bodily
harm upon another.

STATEMENT OF PROBABLE CAUSE 2/23/2018 02:04:09 PM

Complainant has investigated the facts and circumstances of this offense and believes the following
establishes probable cause:

On February 13, 2018, police were made aware of a robbery of an elderly woman (“Victim”) that was
video-recorded and uploaded to Facebook. The video is appalling. 

Police investigation revealed that the incident actually occurred the day before on February 12, 2018, at the
Chicago-Lake Transit Center, located in the City of Minneapolis, Hennepin County, Minnesota. Metro
Transit Officers were familiar with several people involved. One of the main aggressors was known to
police and identified as WESLEY NORMAN MARTIN [(D.O.B. 3/8/1997); (“Martin”)]. A female accomplice
was also identified (“Accomplice 1”). The person who video-recorded the incident was also identified
(“Accomplice 2”). 

Officers reviewed surveillance footage from the transit shelter. Victim was sitting on a bench inside the
transit shelter. Martin initially approaches Victim. Accomplice 1 joins in soon thereafter as they hover over
Victim and appear to yell at her. Victim seems to ignore them at first. After a while, Victim tries to get up
and is repeatedly shoved back down onto the bench. Martin reaches inside Victim’s jacket, steals a liquor
bottle from her, and puts it in his back pocket. A woman tries to intervene, but Martin pushes her aside and
continues to accost Victim. Martin then proceeds to run his hands over Victim’s stomach, bottom, and
thighs as Accomplice 1 hovers over Victim. Victim tries to push past Martin and Accomplice 1, but they
grab Victim and prevent her from escaping. Accomplice 1 starts trying to remove Victim’s jacket as Martin
holds Victim in place. Victim continues to struggle and almost makes it to the door of the transit shelter, but
Martin and Accomplice 1 keeps pulling her back. 

At this point, Accomplice 2 can be seen holding up his mobile phone and records the brutalization of
Victim. Martin and Accomplice 1 pull Victim backward into the transit shelter and throw her to the floor.
Martin holds Victim down on the ground and gropes her. Accomplice 2 moves the camera in for a close-up
of Victim’s face. Accomplice 1 rips the jacket off of Victim 1, but Victim manages to hold onto it. Victim
was in a fetal position on the floor, with both arms clutching her jacket under her head. Accomplice 3
continues to record the incident as Martin and Accomplice 1 continue to accost Victim. 

Accomplice 3 can be heard on the video yelling racial epithets about Victim and commenting that “that lady
like a hundred years old!”

Victim can be heard on the video yelling, “Help me!” There are many people in the shelter who do nothing.

An older man in the shelter steps up and pushes Martin away from Victim. Martin pushes the man back.
The man then punches Martin. A fight between the two ensues. Accomplice 2 verbally encourages the fight.
Martin and the older man go to the ground. During the fight, Martin kicks the older man in the face while the
older man is on the ground. Martin later punches the older man in the face. The older man can be seen
staggering from the blow. 

Accomplice 2 records the fight between the two men while Accomplice 1 holds Victim on the ground.
Accomplice 1 begins to try to rip Victim’s shirt from her body. Accomplice 1 continues to yank on Victim’s
shirt and eventually tears it from Victim. Accomplice 1 throws the shirt toward Martin but it falls to the
ground. Victim tries to get her shirt back but Accomplice 1 rips it away from Victim’s grasp. Accomplice 1
then walks away with Victim’s shirt. Martin continues to fight with the older man who was trying to intervene.
Eventually, Martin leaves the transit center with Victim’s shirt.

Martin is on probation for a conviction of Assault in the Third Degree from February 7, 2018 (D.C. File No.
27-CR-17-28468). 

Martin is currently in custody for a probation violation and is not being held on this charge. Therefore, the
State is requesting that this complaint issue as a warrant.

BLAKELY NOTICE: The State will be seeking an upward departure at sentencing through a bifurcated trial
process pursuant to Minn. Stat. § 244.10 and the Minnesota Sentencing Guidelines. The grounds for
departure are (1) the victim was particularly vulnerable due to age and circumstances of the offense, (2) the
victim was treated with particular cruelty for which the individual offender should be held responsible, (3) the
videotaping of the offense was particularly demeaning, and (4) the current conviction is for an offense in
which the victim was injured, and the offender has a prior felony conviction for an offense in which the victim
was injured.
