Abstract
Efficient urban governance is characterised by four main characteristics including
accessibility, accountability, transparency and efficiency. Urban governance also as
the sum of the many ways individuals and institutions, public and private, plan and
manage the common affairs of the city. It is a continuing process through which
conflicting or diverse interests may be accommodated and cooperative action can be
taken. It includes formal institutions as well as informal arrangements and the social
capital of citizen.

1.0 Introduction

The exercise of political, economic and administrative authority in the management of a


country’s affairs at all levels. Governance comprises the complex mechanisms,
processes, and institutions through which citizens and groups articulate their interests,
mediate their differences, and exercise their legal rights and obligations.

Good governance is among other things participatory, transparent and accountable. It is


also effective and equitable and it promotes the rule of law. Good governance assures
that political, social and economic priorities are based on broad consensus in society
and that the voices of the poorest and the most vulnerable are heard in decision-making
over the allocation of development resources.

Governance includes the state, but transcends it by taking in the private sector and civil
society. The state creates a conducive political and legal environment. The private sector
generates jobs and income. The civil society facilitates political and social interaction
remobilising groups to participate in economic, social and political activities. Because
each has its weaknesses and strengths, a major objective of our support for good
governance is to promote constructive interaction among all three.

The regularized ways of ordering human societies at all levels of organization from family
units to entire societies. Good governance occurs when societal norms and practices
empower and encourage people to take increasingly greater control over their own
development in a manner that does not impinge upon the accepted rights of others

The good characteristics of governance are effectiveness, equity, participation,


accountability and security. Good governance is representative of a successful public
sector reform programme that promotes equity and sustainable development. A weak
governance system compromises the delivery of services and benefits to those who
need them most; the influence of powerful interest groups biases policies, programs and
spending away from the poor and lack of property rights, police protection and legal
services disadvantages the poor and inhibits them from securing their homes and other
assets and operating businesses.

2.0 Background of Case Study

Kuantan Municipal Council was implemented on 1th August,


1913 with the establishment of the Sanitary Board Kuantan
responsible for sanitation, health and development control.
In 1937, Kuantan Sanitary Board was replaced by the
Kuantan Town Board. After almost 16 years under this
system, the Kuantan Town Board was upgraded to Kuantan
Municipal Council with the administration of 10 square miles only, Mukim Kuala Kuantan
focused. On 1 September 1979 once again, Kuantan Municipal Council upgraded to
Kuantan Municipal Council based on the Local Government Act (Act 171), which
remains to this day. An area of Kuantan Municipal Council was expanded to 324 square
miles covering four mukim namely Kuala Kuantan, Kuantan Ulu, Beserah and Sungai
Karang. The area is 10% of the total area of Kuantan. From that area, 20% were given
the taxable municipal services while remaining in the area of development.

2.1 Department of Planning and Development

The Town Planning Department is the department that was established to cater
for town planning services in determining the development of land-use is planned
comprehensively. It involved the preparations of long-term planning plans for
example, the preparations for Local Plans, Special Area Plans and Development
Action Plans, to form strategic development which are sustainable, balanced and
progressive to upgrade the livelihood of the population in a harmonize
environment. This department is also responsible in the physical development
planning control and enforcement of the Enforcement Act 172.

The Goal of The Town Planning Department is to make Kuantan a major centre
of business, service, industrial and tourism development of the East Coast with
world class facilities by year 2005. This Division consists of 5 staff – a Town and
Country Planning Officer as Division Head (the Assistant Town and Country
Planning Officer (Senior) is acting as Division Head), an Assistant Town and
Country Planning Officer and 2 Town and Country Planning Technicians.

2.2 Department of Treasury

The Treasury Department is the main department responsible for all the financial
management of the Councils. It liable to advise the Council and Administration in
matters related to finance rules and also to monitor position of Council’s financial
flow to ensure it is constantly at a stable level. It also reviews finance and

accounting transaction records maintenance activities to ensure that such


records are documented according to the prescribed accounting principles.

On the other hand, it supervises and ensures the Annual Financial Statement is
completed based on the prescribed period. Then, to prepare the Council’s Annual
Budget according to the prescribed period and specification. Lastly, to control the
Council’s expenditure and ensure collection of revenue and arrears fulfils budget
requirements. There are 2 main divisions under the Treasury Department which
are:

a. Budget and Procurement Division


b. Finance and Accounts Division
c. Car Park Division
d. Asset Management Division

2.3 Department Business Control and Licensing

Department Business Control and Licensing Department was officially


established on the 2nd April 2009. Prior to this the Department Business Control
and Licensing Department was part of the Health Department. This department
conducting activities related to commercial licensing and permits. It is also
conducting enforcement and business controlling activities. Besides that it also
provides for business controlling and enforcement services to residents within the
Kuantan Municipal Council areas in upgrading the prosperity in line with the Acts
and By-Laws which are being applied.

The goal of Department Business Control and Licensing Department is to make


Kuantan a municipality with a hawker and small trader’s development system that
can contribute in terms of social and economic in line with town development in
terms of cleanliness, beauty and smoothness of other activity. There are 2 main
divisions under the Licensing and Hawkers Department namely:

a. Hawker Division
b. Licensing Division

2.4 Department of Yang Dipertua

Department of Yang Dipertua (consist with One Stop Centre) began as a unit
which was established on the 1st October 2003 under the responsibility of the
Council Secretary. This was in line with the instruction from the State
Government that a 'One Stop Centre' be set up in all the Local Authorities in
Pahang to accept and process the approval of building plans and CFs. In Jun
2007, the functions of this Unit were further expanded in line with the official
announcement by the Prime Minister for setting up One Stop Centres (OSC) in all
Local Authorities all over the country.

In 2009, the Unit was upgraded to the status of a department and named the
Department of Yang Dipertua in accordance with the increase in workload and
the demand in upgrading the relaying system in the public services, especially in
getting approvals for development applications. There are 5 main divisions under
the Department of Yang Dipertua which are:

a. One Stop Centre Division


b. Enforcement & Safety Division
c. Public & Community Relations Division
d. Sport & Tourism Division
e. Audit Division
f. Building Commissioner Division

2.5 Department of Landscape

Realizing the importance and requirements of the landscape aspect, a


department of Landscape was established in 1985. This is in line with the
development of landscape whereby the balance between development and
environment is starting to be given its due importance. The main role of the
department is to create town beautification and provide efficient maintenance on
par with other beautiful cities in the world.

This department also provides spacious areas and green recreational parks
complete with the recreational facilities to upgrade the tranquillity and comfort of
the people of Kuantan. There are 2 main divisions under the landscape
Department namely:

a. Landscape Planning and Development Division


b. Landscape Maintenance Division

3.0 Methodology

The method use to evaluate the local authority is by using questionnaires. The
questionnaires are distributed to 5 selected departments to be completed by any officers
from each of the selected departments. In other words, 5 questionnaires are needed for
this survey. The 5 departments that were selected which are:

a. Department Planning and Development


b. Department of Treasury,
c. Department Business Control and Licensing,
d. Department of Yang Dipertua (One Stop Centre, OSC)
e. Department of Landscape.

4.0 Evaluation

The part of survey of the local authority is divided into 5 characteristics of good
governance which are effectiveness, equity, participation, accountability and security.
The aim of this survey is to evaluate whether Kuantan Municipal Council is a good
governance or not by evaluating those characteristics.

4.1 Section A: Effectiveness

The characteristic of effectiveness is evaluate to know whether the processes and


institutions produce results that meet needs while making the best use of resources. This
characteristic is evaluated in term of whether it promotes efficient public delivery systems
or not.

Based on the survey, all the departments involved in the survey agreed that
Kuantan Municipal Council publish the formal publication of performance delivery
standards for key services. The Client Chart Achievement for every department in
Kuantan Municipal Council for instance will be issued for every quarter year.

Effective delivery requires good governance and performance management, so that


funds are directed quickly to the most urgent needs, and incentives enable service
providers to make good use of available resources. Local authority that are large,
urban, well-established and have a productive economic base are in the

forefront of this effort. Kuantan Municipal Council has to maintain this effort in
order to achieve the level of good governance.

b. Frequency of carrying out a survey on the satisfaction of the consumer towards


services

Table above shows that most of the departments are satisfied with the frequency of
carrying out a survey on the satisfaction of the consumer towards Kuantan Municipal
Council’s services except for Treasury and Landscape which is neutral. Through this
analysis; it shows that Kuantan Municipal Council is always placing customers as its
main priority. The survey done by Kuantan Municipal Council is to ensure that the
provided services satisfied customers.

c. Local government’s commitment in articulating a vision for the city’s progress and
future and its participatory process

Based on the table above, all the departments are satisfied with Kuantan Municipal
Council’s commitment in articulating a vision for the city’s progress and its
participatory process especially in Landscape Department. It shows that Kuantan
Municipal Council is in a right way or direction to realize the vision for Kuantan which
is "Steering Kuantan towards Becoming a Historical Royal City That Is Culturally
Forward, Sustainable and Excellent"

4.2 Section B: Equity

Based on characteristics of good governance, equity means all men and women have
opportunities to improve or maintain their well-being. This characteristics become part of
the evaluation in order to know whether Kuantan Municipal Council give opportunities to
different gender to be able to work or become part of the administration.

a. Client Charter of Department/Division that is published by local authority which


acknowledges citizens’ right of access to basic services.

Landscape Department is strongly satisfied with the Client Charter of


Department/Division published by Kuantan Municipal Council which
acknowledges citizens’ right of access to basic services. Meanwhile the other 4
departments are satisfied enough.

One the list of Client Charter of Department/Division that emphasizes the basic
services to citizen is to ensure the development and maintenance of public
infrastructure and recreational park projects are in good condition so that people
can have a better living condition and a healthy lifestyle.

b. Increasing percentages of women councilors’ position every year for election


held.

According to the table above, it shows that 3 departments which are Treasury,
OSC and Landscape are dissatisfied with the position of women councillor’s

member for each year of election being held. Most of them said that usually there
is only one position for woman. Meanwhile the other two departments which are
Town Planning and Business Control and Licensing are neutral.

Based on the current official web page of Kuantan Municipal Council, out of 30
members from the Council Members list, there are only six women below that are
able to take place or elected as the Councillor’s members. This situation happens
because man is considered more qualified to become a leader.

According to the survey, all of the departments state that Kuantan Municipal Council
provides incentives to small business such as business permits, business spaces,
entrepreneurship workshop and the infrastructure to enhance the public economy. The
examples for small business incentives by Kuantan Municipal Council are Kiosk at
Kuantan Plaza, Food Arena that covered all of residential in Kuantan like Indera
Makhota, Bukit Sekilau, Taman Cenderawasih, Tok Sira etc.

The examples of workshop or talk given to small businesses are `Kursus Usahawan
Masyarakat Kuantan 2013’, ‘Jom Jual 2010’, ‘Taklimat Usahawan Makanan 2009’.
Those organized programs are aim to intensify or increase the economy of those small
businesses so that they can survive although they are competing with big businesses.
Besides that, incentives given are by giving discounts to those hawker or dealer who
want to start a business.

3.3 Section C: Participation

All men and women, inclusive of the physically challenged, should have a ‘right to be
heard’ in decision - making, either directly or through legitimate intermediate institutions
that represent their interests. Such broad participation is built on freedom of association
and speech, as well as capabilities to participate constructively. In term of this survey,
the evaluation is based on the participation of people in election of Kuantan Municipal
Council Members.

Based on the survey, three departments which are Treasury, OSC and Landscape
are absolutely neutral with the election of council’s member while Town Planning
Department is satisfied with the election. They agreed with the right way or process
of the election. Meanwhile the Business Control and Licensing is disagreeing is
disagreeing with the election. It means that those departments do not care about the
election.

Most of the departments say that YDP of Kuantan is the local people. This shows
that the YDP of Kuantan obligatory from the local people. Means that people who
living outside from Kuantan cannot be the YDP. It is totally follow with the rule of
the election that says someone who wants to become the Council Members must
come from their state.

3.4 Section D: Accountability

This section of evaluation is about accountability. Central to the principle of


accountability is information sharing and transparency which should be promoted by
governance structures. Hence, accountability is hard to achieve especially in the
absence of access to information.

a. Transparency level to access the existence of a formal publication which


provided by the local authority itself.

Based on the table above, 3 departments which are Treasury, Business Control
and Licensing and OSC are satisfied while Town Planning and Landscape is
Neutral with the transparency level to access the official information provided by
the local authority itself such as contracts and tenders, budget and account.

However, the departments who satisfied that only basic information or document
can be accessed by outsiders. Private and confidential information, data or
document such as the way to get tender is secret.

b. The level of the state government’s responsiveness to the local authority in


appointing and removing councilors from office.

Based on the survey, 2 departments which are Town Planning and Business control
and licensing strongly satisfied with the level of the state government’s
responsiveness to the local authority in appointing and removing councillors from

office. Meanwhile the other 2 departments which are Treasury and OSC are satisfied
enough with the processes. Then, Landscape Department are neutral because the
landscape management is hard to abuse power. It shows that Kuantan Municipal
Council is responsive in undertaking the responsibility as the local authority and a
step towards good governance.

Based on the survey, most of the departments are satisfied with the code of
conducts used during the election officials and government staff. Code of conduct is
a set of conventional principles and expectations that are considered binding on any
person who is a member of a particular group. Organizations may impose penalties
for breaking their codes of conduct.

d. How is the level of local authority receiving the citizen’s complaint?

Table above shows that 4 departments, which are Town Planning, OSC, Business
Control and Licensing and Landscape, are strongly satisfied with the level of local
authority receiving the citizen’s complaint. Meanwhile only one department which is
treasury is satisfied enough.

Via the Kuantan Municipal Council website (2013), there is a comment or complaint’s
column for anyone who want to drop a comment or complaint about anything, for
example the services provided by Kuantan Municipal Council. It shows that the local
authority is taking seriously any comment or opinion that is raised or stated by
people because the satisfaction of people under its administration area is the main
important things to consider.

e. The existence of anti-corruption department or unit in Local Authorities can assist


Malaysian Anti-Corruption Commission in an effort to reduce corruption.

Based on the survey, department of Business Control and Licensing is strongly


satisfied if the unit or anti-corruption department is established in Kuantan Municipal
Council. The same goes with Departments of Town Planning, and Landscape which
are satisfied enough. Meanwhile officers from OSC and Treasury are neutral mode.

All the departments that are strongly satisfied and satisfied think that the
establishment of the unit or department of anti-corruption can help to reduce or
minimize corruption. Corruption is a bad ethic that is unavoidable in any
organizations. It is expected that the effort of the establishment can overcome
corruption, nepotism or others bad ethics from becoming worse.

From the table above, it can be concluded that all of the officers from the 5 departments
stated that the elected officials are required to publicly disclose their income and assets
prior to take the position. This is to ensure that they accountable enough to take the
responsibility and to avoid any misconduct such as corruption in the future. The previous
experience shows that there are officers who involved in corruption whereas his property
and asset exceed his capabilities to earn much that. So when any elected officers are
needed to disclose income or asset, it is hope that no such thing as corruption can
happens or at least try to minimize it.

Based on the survey done, all of the departments agreed that there is a unit of audit
accounting at Kuantan Municipal Council which is namely Internal Audit Division which is
responsible to coordinate audit works on all payments, receipts, internal control systems,
assets management, inventories and stocks.

4.5 Section E: Security

Last but not least, this section is evaluated to know or measure the security level under
the administration of Kuantan Municipal Council.

i. The existence of crime prevention policy as new units in Local Authorities can
reduce crime in the administration of the Local Authority.

Table above shows that all of the departments agreed that the existence of crime
prevention policy as new units in Kuantan Municipal Council can reduce crime at the
administration area. Hitherto, there is no unit of crime prevention establish at Kuantan
Municipal Council. The establishment of this new unit is hoping to reduce, prevent or at
least minimize the rate of crime at the administration area. Less crime occur at the under
the administration area means that the safety and security of people is guaranteed.

ii. The involvement from public in conflict resolution with Local Authorities

Most of the departments which are Business Control and Licensing, OSC and
Landscape satisfied with the public participation in solving or overcoming the issues
with staff of Kuantan Municipal Council. The examples of public participation are
`Kursus Menghijaukan Bandar’, ‘Larian Jom! Kitar Semula’ `Minggu Kesihatan’,
`Kursus Mencegah Kebakaran’ and many more. All of those activities or programs
organized by Kuantan Municipal Council can be considered as a precautionary step
to make sure people feels safe and their security is guaranteed.

iii. Effectiveness of the local authorities’ policy for protecting women from violence.

Based on the table above, 3 departments which are Town Planning, Finance and Parks
and Recreation satisfied with the effectiveness of local authorities’ policy for protecting
women from violence. Meanwhile the other 2 departments which are Licensing and
Hawkers and OSC are neutral. From the analysis, we can say that the policy to protect
women from violence is effective enough.

5.0 Conclusion

In a nutshell, the Kuantan Municipal Council selected departments like Town Planning
and Development, Treasury, Business Control and Licensing, One Stop Centre and
landscape was evaluated through 5 characteristics of good governance system which
are effectiveness, equity, participation, accountability and security.

From the results, Kuantan Municipal Council is 90% archive the good governance
system whereas, citizens will have easy access to the elected and staff decision makers
who are responsible for municipal services. Beside, community will be recognized as an
important component of decision making. Furthermore, all municipal functions and
services will be addressed; services will be delivered at a level communities believe to
be appropriate and suitable quality service will be delivered efficiently and in a manner
that makes citizens feel they are receiving a reasonable return on their tax money.
