CITY ORDINANCE NO. 2011-029

AN ORDINANCE FURTHER AMENDING SECTION 83

OF CITY ORDINANCE NO. 2008-01 OTHERWISE
KNOWN AS THE LEAD-BC CODE, REQUIRING NEW
APPLICANTS/AWARDEES AT THE CABADBARAN CITY
SUPERMARKET TO PAY THE OCCUPANCY FEE IN
FULL PRIOR TO ACTUAL OCCUPANCY OF THE SPACE

WHEREAS, City Ordinance No. 2008-01 otherwise known as the

LEAD-BC Code was amended through City Ordinance No. 2010-03 as the
City Government’s response to the clamor of the market vendors for
consideration following the conflagration of the Old Public Market which
affected their business operations;

WHEREAS, the amendment was intended to alleviate the financial

burden of the old vendors/occupants and further giving them the
chance to recover their investment by allowing them to pay in installment
the occupancy fee of the various stalls at the Cabadbaran City
Supermarket;

WHEREAS, the LEAD-BC Regulatory Board in its Board

Resolution No. 2011-03 recommends for the amendment of City
Ordinance No, 2010-03 and that the installment scheme be no longer
applicable to new applicants/awardees of stall at the City Supermarket
and shall instead pay the occupancy in full prior to actual occupancy of
the space.

NOW THEREFORE

BE IT ORDAINED, by the 2 nd Sangguniang Panlungsod, in its

47 Regular Session assembled, that:

SECTION 1. Section 83. STALL OCCUPANCY FEE SCHEDULE.

TIME AND MANNER OF PAYMENT:

OCCUPANCY FEE – apart from rentals, there shall be

an occupancy fee collected from qualified applicants for
every stall at the Supermarket to be used for the
maintenance thereat. Said fee may be paid ONE-TIME IN FULL
OR ON INSTALLMENT BASIS OVER A PERIOD OF 36 MONTHS,
STARTING FROM THE MONTH OF THE PERFECTION OF THE
CONTRACT OF LEASE BETWEEN THE CITY GOVERNMENT AND
THE APPLICANT.”

c.) Ten percent (10%) discount shall be given to
those applicants who can pay the occupancy
fee in full at the time of occupancy.

Shall be amended to read as follows:

Section 1. STALL OCCUPANCY FEE SCHEDULE.

TIME AND MANNER OF PAYMENT:

OCCUPANCY FEE – apart from rentals, there shall be an

occupancy fee collected from qualified applicants from every
stall at the Supermarket to be used for the maintenance thereat.
Said fee is applicable to new applicants/awardees
should existing, original or old occupant of a space
retires from business, voluntarily withdraws his/her
privilege, or in cases where existing contracts are
revoked for a cause. Such new applicants/awardees
shall pay the prescribed occupancy fee in full prior to
actual occupancy of the space.
