SUB; Detailed Report Viz-a- viz the case titled Satinder Singh versus Mirwaiz Umar Farooq and others
subjudice before Disstt.and sessions judge chandigarh,meeting with supreme court lawyer Rebbecca
John and the vist at Tihar jail Harinagar Delhi;

Esteemed Sir;

With humble submission,I would like to draw your kind attention towards my visit to
Chandigarh,New Delhi,which commenced from 31-12-2017 to 14-01-2018

1, on 31-12-2017, I started my journey from srinagar and on the same day in evening I reached to
Jammu and stayed for the night there in then on 01-01-2018 travelled from Jammu to Chandigarh, in
evening I entered into Chandigarh city Sector 45-C .It is submitted since the case was listed on 3rdo of
january 2018,but on 02-01-2018,I went to court wherein I enquired about the listing of case and court
location and on 03-01-2018 ,I attended the case at 9;30 am which is now being listed on 07-03-2018 and
soon after attending the case, I departed from Chandigarh at about 11:00 am on the same day,viz 03-
01-18, reached to new delhi at night on the same day. On 04-01-2018, I took a rest,but on 05-01-2018
[Friday] I had two hours meeting with senior Supreme court lawyer.Ms.Rebbeca John at her Defense
Colony D-378 private chamber wherein we discussed Shahidul Islam’s case threadbare ,she accepted to
plead the transfer of the case to Srinagar plus bail of the detenue /Jail inmate Shahid Sahib but she
declined to appear in the trial.On 06-01-2018, I met with S.A.R Geelani at his residence at Zakirnagar
New Delhi and discussed the said case with him in detail and sought his assistance in the
same.Thereafter I was told by SAR Geelani Sahib that the detenues/Jail inmates have been shifted to jail
No 4 and it may take a few days that they may be brought again in jail No 8 at Tihar jail, as such,I
intimated you Sir viz a viz the same,therefore I was directed to stay /wait for these days and accordingly
on 11-01-2016, I went to Teeshazari court for drafting of documentations which is the requirement in
order to reach to the detenue/Jail inmates and accordingly I drafted the same which include application
addressed to jail Superintendent Tihar,photostat copy of my I-card,power of attorney/wakalatnama duly
stamped through Bar Welfare Teeshazari Court,New Delhi. Copies whereof the same are enclosed
herewith as ANNEXURES A,B and C respectively and on the same day i.e;on 11-01-2018,I reached to
Tihar Jail Haringar New Delhi at 2 pm wherein I was informed by Jail authority that lawyers are allowed
to submit documents after 3 pm and on 3pm ; I made them the request that I wanted to meet Shahid
Sahib in person,accordingly I was allowed after proper scrutiny of legal papers I submitted and after
wakalatnama was sealed and signed by deputy superintendent central jail no 8\9 and after the same
was signed by shahid ul islam by putting his thumb impression as well and as such I met him [Shahid
Sahib ] from 3;30 pm to 5;45 pm [evening] thereby discussed his case and other allied issues in detail,
the last day i.e, 12-01-18 I made my stay therein and on 13-01-2018 ,I left Delhi , reached Jammu in
evening on the same day , but on 14-01-2018.I started my journey from Jammu to srinagar and hence I
came back home on 14-01-2018.

DISCLOSURES MADE BY SHAHID-UL-ISLAM IN TIHAR JAIL HARINAGAR

DELHI ON 11-01-2018 [JAIL NO 8]
He has been arrested on 24-07-2017 at 11 am by NIA stationed at BSF camp HUMHAMA after asking him
to appear therein and on the same day he was airlifted from Srinagar at 6pm. On 25-07-2017 he was
brought before patiala house court at Delhi which sent him for 10 days remand in NIA’S custody.He was
again brought before the said court on 04-08-2017 which remanded him upto 01-09-2017 to Judicial
custody [Tihar Jail] wherein he had been kept with proffessional drug addicts,murderers and other hard
core criminals,the remand was extended upto 27-09-2017,then 17-10-2017,then 14-11-2017,then 15-
12-2017,then 12-01-2018 then 18-01-2018 and now 30-01-2018,by the said court to Tihar jail Harinagar
Delhi.

Shahidul Islam along with other jail inmates viz Raja Mehraj Kalwal,Ayaz Akbar,Shahid Yousuf Shah
S/O Syed Salahuddin have been kept in jail NO 8 of Tihar Jail in HIGH RISK WARD

He along with other inmates are being given just 4 Bannocks [chapatis] with Daal [pulse] and potatos as
lunch at 11 am and 5 Bannocks with pulse [DAAL] as dinner which is poison for the Diabetic patient like
Shahid, but no rice is being served. Since the ailments like Hypertension ,Diabetese, Osteo arthritis
Shahid suffers,need regular medical check-ups which is denied to him and to other inmates,even he is
not been provided with the glucometer, being the diabetic patient,hence there is every likelihood that
he may collapse therein at any time though he had demanded medical treatment and a glucometer
which he otherwise has a right under law.Therefore he and other kashmiri jail inimates above named
have been condemned unheard by jail authority,s denial to provide them the basic medical facilities
which is against the basic principles of natural justice,hence denial of medical treatment,medical diet
and requisite medical drugs amounts to violation of Article 21 of the constitution,which is
reproduced herein below ;-

‘’No one shall be deprived of his life and personal liberty except according to the procedure
established by law ‘’

But due to the said inhuman treatment of Jail Authority with the kashmiri jail inmates specially Advocate
Shahidul Islam and the aforesaid jail inmates amounts to depriving them of their life and curtailing their
liberty due to the denial/non availability of proper and sufficient diet and medical treatment which
resulted into the loss of weight of Shahidul Islam which has immensely and considerably decreased
thereby given birth to so many other serious diseases like poor vision ,joint pain etc,hence Shahidul
Islam is virtually at death bed. The shocking news which has come to limelight is that for last three
months Shahidul Islam and other kashmiri jail inmates have been forced to sleep on open and cold
cement floor that too without any bedding,Shahidul Islam is using his jeans pant as a cushion ,resultantly
he and others are in quiet embarrassing and miserable condition which they cannot disclose to anyone
excepting Allah.I was being informed by Shahidul Islam that IG NIA has threatened them that they shall
be mentally ready to count 12 long years in Tihar jail.He and others are being treated and considered
like beggars.As per his version,there is no scope of legal battle,as the judges even move as per NIA’S
directions,they don’t listen to their genuine and legitimate demands as stated herein above.He further
narrated that he is being forced that if he chooses to be loyal to Mirwaiz Umar Farooq,then he is bound
to remain in jail,besides he is being forced to make a statement before magistrate/Judge against the
Mirwaiz –e-kashmir and on TV channels that he receives money from Pakistan .He further reiterated
that initially he and other inmates of Kashmir were being allowed to talk to family twice a week for five
minutes i.e on every Monday and Thursday .Now for last one month this right even has been curtailed
they are allowed to talk to family only once i.e on Monday for 7 minutes .Our life has become hell as
we are being treated worst than animals and we may perish at any time he further stated with tears in
his eyes .Hence the report is hereby submitted.
