STATEMENT OF PROBABLE CAUSE 3/19/2018 11:40:00 AM

The following is based on your complainant’s review of the reports of other officers and your complainant’s
own investigation:

On March 17, 2018, at about 4:20pm, St. Paul Police responded to the street in front of 328 Kellogg Blvd.
W., St. Paul, Ramsey County on a reported altercation.

On arrival, officers observed a man sitting on the ground bleeding severely from his head and appearing to
have difficulty thinking. He was identified as SKM (11/9/1959). He told officers that he had been riding a
pedal cab and had provided a ride to a man and woman. He said that at the destination, a dispute arose
over the price, and the man became physical.

The man was nearby and was identified as the defendant, ALBERT DARNELL CLEVELAND (5/25/1996).

Officers spoke with several eyewitnesses. SMG (11/29/1970) and TLE (5/18/1970) said that they had been
walking nearby, saw SKM on the ground, and saw the defendant kick him in the head three times. They
said that they ran over and told the defendant to stop. TLE said that the defendant spit at SKM as well.

MAB (6/30/1969) said that said that he had been walking nearby and saw the defendant on top of SKM,
punching and kicking him in the head. He said that he saw the defendant spit at SKM as well. He said that
he and his friends told the defendant to stop. He said that the defendant said that if they had not intervened,
he would have “beaten him bad.”

JCG (5/14/1973) said that he had been in a nearby parking lot and saw the two men (SKM and the
defendant) “wrestling” with one another. He said that eventually the defendant got SKM and the ground and
then punched him.

Photographs were taken of the scene and of SKM’s injuries.

The defendant was taken into custody. He declined to make a statement to an investigator. His boots were
observed to have blood on them; they were recovered.

SKM was transported to the hospital. In a follow up interview, he said that he and the pair to whom he gave
a ride had agreed on the price ($30) in advance. But he said that when he transported them to their
destination, they walked away without paying. He said that he asked them to pay, and the man (the
defendant) refused. He said that as they continued to talk, the defendant became physical and then struck
him with an aluminum bottle in the head and face. He said that he fell to the ground, and the defendant
punched and kicked him repeatedly in the head. He said that after witnesses intervened and the defendant
stopped, the defendant said: 
 
     “Lucky I didn’t stick you.”

The next day, SKM gave a second follow up interview to an investigator in which he reiterated his earlier
statements. He said that when he asked the man (the defendant) to pay the fare, the defendant responded
that he didn’t feel that the ride was worth the price. He said that the defendant brought out an aluminum
bottle. He said that he (SKM) began to walk away, and the defendant struck him from behind with the bottle,
then kicked him when he was on the ground.

SKM said that he was diagnosed with four facial fractures; he said that he was transferred from St.

Joseph’s Hospital to Regions Hospital because St. Joseph’s was not equipped to deal with his injuries.

and released from custody, with or without bail or recognizance, who intentionally fails to appear when
required after having been notified that a failure to appear for a court appearance is a criminal offense, or
after having been released on an order or condition that the releasee personally appear when required with
respect to the charge or conviction, is guilty of a crime for failure to appear and may be sentenced to not
more than one-half of the maximum term of imprisonment or fine, or both, provided for the underlying crime
for which the person failed to appear, but this maximum sentence shall, in no case, be less than a term of
imprisonment of one year and one day or a fine of $1,500, or both.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
