Interested Firms are requested to collect tender form with term & conditions from MS Office ESICMH
Baddi on any working day from 10 a.m to 3 p.m and on Saturday from 10 a.m to 12 noon at the cost
of Rs. 500 (Five hundred) in the form of Demand Draft (Non-refundable) in favour of ESIC FUND
ACCOUNT NO.1 payable at Baddi. Tender documents can also be downloaded from Hospital website
(http://www.esic.nic.in) in that case DD for the cost is to be enclosed with Tender. Tender form is to
be submitted complete in all respects alongwith prescribed EMD in favour of ESIC FUND ACCOUNT
NO.1 payable at Baddi in form of Demand Draft. The Annexure –III contains the format in which price
has to be quoted and it contain the commercial terms for the Tender.
Tender complete in all respect must be deposited in tender box kept in Hospital medical
Central store (Basement) Room No B-32 till 1 P.M. on due date of opening. Tender received late will
not be entertained. The sealed envelope containing the quotation should be marked in capital letters
““TENDERFOR SUPPLY OF MEDICAL BOOKS AND MEDICAL JOURNALS (INDIAN & FOREIGN)..“
.Tender will be opened on the due date at 2.00 p.m in office MS of Hospital in the presence of
bidders or their authorized representative. If due date of opening is declared holiday, tender will be
opened on next working day at same time and place.

For Library of ESIC medical college , Mandi (H.P). up to scheduled Time and Date .
Sealed tenders should bear the Tender Inquiry No and be clearly super subscribed as
“TENDER FOR SUPPLY OF MEDICAL BOOKS AND MEDICAL JOURNALS (INDIAN &
FOREIGN). Tenders submitted after Scheduled time shall out rightly be rejected.
1) TENDER VALIDITY
Tender shall remain open for acceptance for a period of 120 days from the date of opening
of Tender. Tenders received forshorter validity will be rejected.
a) Copy of PAN card issued by the Income Tax Department and Copy of the Income Tax
Return for the financial years 2010-2011, 2011-2012, 2012-2013.
b) At least 3 years’ experience in supply of Medical Books/Scientific/Technical and Medical
Journals (Indian and Foreign) to Medical Colleges libraries/Government of India libraries
(Attach Certificate from 3 libraries served)
c) Declaration regarding availability of books in ready stock.
d) All Tenders must be filled as per details mentioned in Annexure- I, II& III.

3.1. The Bidder, to qualify for the award of contract, shall submit a writtenpower of attorney
authorizing the signatories of the bid to participate in the bid.
3.2..The bidder shall submit full details of his Agency / Firm or, if the bidder is
aProprietorship/Partnership or a Private Limited Company, full details ofownership and name
of the directors.
3.3. Bidder shall submit a copy of PAN card No. under the Income Tax Act.
3.4. Bidder must submit self-attested copies of all documents and each & every page Of
tender document duly signed by him.
i)- In case the tenderer withdraws its tender or impairs or derogates from the tender in any
respect during the period oftender validity as specified by the purchaser,

In case successful tenderer fails to furnish the performance security.
ii.) The Earnest Money of unsuccessful bidders will be returned as promptly as possible after
the expiry of the period of tendervalidity without interest.
7. TERMS OF DELIVERY:-
Free of cost delivery at Library Department, ESIC Medical College, Ner Chock, Mandi (H.P)
8. DELIVERY PERIOD:-
books afterplacing the supply order.The name may be intimated to the Medical
Superintendent. So that thesupply order can be placed to the next supplier.
a) Medical Journals should be supplied as soon as published or become available but not
later than 30 days after their availability from the publisher for all type of journals.
b) The delivery shall be through registered/Book Post/Parcel/Courier/in person on the risk
&responsibility of the firm. No postage, Insurance or any other charges whatsoever shallbe
paid extra.
c) Only original Journals will be accepted and no duplicate/defective/photocopies of these
shallbe entertained. If any such instance comes to the notice, the same shall be returned
onrisk and cost of the firm. The supplier should put his stamp verifying the originality of the
journals.
d) The firm will supply Original Electronic CD of Journals as received by them from
Publishers free ofcost; Subscription numbers of for all the Journals to facilitate the user;
Free on-line access to journals where thepublisher given it free of cost . 5% for books, 10%
for journals services against print Journals.
e) The Firm shall quote overall Discount percentage to be allowed on Publisher’s price
list/Catalog of MedicalJournals for the subscription year 2014-15 as per Annexure-III.The
catalogue and original price list to be attached from the publisher.
9. AGREEMENT
The successful tenders shall have to execute a formal agreement with The Medical
Superintendent, ESIC Model Hospital, Baddi (H.P) within a period of 15 days the date of
proper supply order in their favors is issued. “All the expanses on account of stamp
registration and other related changes there to shall be borne by the accepted tenders.
(b) Termination for default:- The purchaser may, without prejudice to any other remedy
orbreach of contract, by written notice of default sent to the supplier, terminate the Contract
inwhole or part if the supplier fails to deliver any or all publications ordered to him within
thetime period specified in the contract, or if the supplier fails to perform other obligation(s)
underthe contract. In the event of the termination of the contract by ESI Hospital in whole
or in part,the hospital may procure, upon such terms and in such manner as it deems
appropriate the undelivered books, Medical Journals & periodicals and the supplier shall be
liable to pay for anyexcess costs for such purchases. However, the supplier shall continue
performance of thecontract to the extent not terminated.
(c) Force majeure - The supplier shall not be liable for (a) and (b) above, if its delay
inperformance or other failure to perform its obligations under the contract is the result ofan
event of force majeure(means an event beyond the control of the supplier and notinvolving
the supplier’s fault or negligence and not foreseeable). Such events may include,but are not
restricted to, acts of the purchaser either in its sovereign or contractual capacity, wars or
revolutions, fires, floods, epidemics, quarantine restrictions and freightembargo. The
Supplier shall promptly notify the purchaser in writing of such conditions andthe causes
thereof.
12. INSPECTION
Medical Books and Medical Journals (Indian & Foreign) will be accepted only after the
inspection by the Dean or librarian / library committee r any officer authorized by him at
Place of Delivery.
13. No tender may be withdrawn in the interval between the deadline for submission of
tendersand the expiry of the period of tender validity. Withdrawal of a tender during the
intervalmay result in the Bidder’s forfeiture of its Earnest Money Deposit.
14. The successful Bidder shall not in any case sublet the contract in full or any part of it to
third party.
15. Tenders not meeting any/ all of the aforesaid requirement(s) shall be rejected.
16. Conditional tenders are liable to be out-rightly rejected.
17. The Medical Superintendent reserves the right to accept or reject any tender and to the
annual tendering process and rejectany or all tenders at any time prior to award of the
contract, without thereby incurring any liability to the affected Bidders orBidders or any
obligations to inform the affected Bidders or Bidders of the grounds for the purchaser’s
action.
18. RESOLUTION OF DISPUTES
In case of a dispute or difference arising between supplier and purchaser relating to
anymatter arising out of or connected with the contract, such dispute or difference shall
bereferred to the Sole Arbitrator duly appointed by the Director General, ESI Corporation,
Head quarters’ office, CIG New Delhi-110002. The award of the arbitrator shall be final and
binding tothe parties concerned.

NOW THEREFORE we hereby affirm that we are guarantors and responsible to you,

of currencies in which the contract price is payable, and we undertake to pay you, upon
your first written demand declaring the supplier to be in default under the contract and

the sum specified therein.
We hereby waive the necessity of your demanding the said debt from the supplier
beforePresenting us with the demand.
We further agree that no change or addition to or other modification of the terms of
the contract to be performed there under or of any of the contract documents which may be
made between you and the supplier shall in any way release us from any liability under this
guarantee and we hereby waive notice of any such change, addition or modifications This
guarantee shall be valid until the date of issue of the acceptance certificate issued by
purchaser’s representative.
