PROCEEDINGS OF THE COUNTY BOARD OF JACKSON COUNTY, MINNESOTA

January 2, 2018

The County Board of Jackson County, Minnesota met in regular session, in the Jackson County
Courthouse Board Room, 405 Fourth Street, City of Jackson, Minnesota, on January 2, 2018.
The following members of the Jackson County Board of Commissioners were present: Don
Wachal, Catherine Hohenstein, James Eigenberg, Kim Hummel and Scott McClure. County
Coordinator Steven Duncan and Trish Schulz, Human Resources Technician, were also in
attendance.

CALL TO ORDER

County Coordinator Steve Duncan called the meeting to order at approximately 9:00 a.m. and led
the Pledge of Allegiance.

County Coordinator Duncan called for nominations to serve as Chair of the Jackson County
Board of Commissioners. Motion was made by Commissioner Hummel and seconded by
Commissioner Hohenstein to have Commissioner Don Wachal serve as Chair for calendar year
2018. Motion carried unanimously.

Chair Wachal assumed the position of Board Chair and called for nominations for Vice-Chair.
Motion was made by Commissioner McClure and seconded by Commissioner Hummel to
name Commissioner Hohenstein as Vice-Chair for calendar year 2018.

Motion was made by Commissioner Hohenstein to name Commissioner McClure as Vice


-Chair for calendar year 2018. Motion died for a lack of a second.

Motion carried unanimously to name Commissioner Hohenstein as Vice-Chair for calendar year
2018.

Motion was made by Commissioner Eigenberg and seconded by Commissioner McClure


to adopt the agenda. Motion carried unanimously.

CONSENT AGENDA

Motion was made by Commissioner Hummel and seconded by Commissioner Hohenstein


to approve the Consent Agenda. The motion carried unanimously.

Board Action 18-001: Approve the December 19, 2017 Board of Commissioners regular meeting
minutes.

Board Action 18-002: Approve all Commissioner disbursements in accordance with Minnesota
Statutes 130.01, subd. 4(b), recorded on warrants numbered 83759 through 83885 in the amount
of $1,165,516.27. For the following funds: Revenue, $418,564.38; Road & Bridge, $26,337.79;
Insurance Trust, $2,023.50; Ditch Fund, $492,014.70; Insurance Trust, $212,189.00; Library,

$14,330.11 and Tax & Penalty, $56.79. A detailed list of claims paid is available at the
Auditor/Treasurer’s office upon request.

Board Action 18-003: Approve the adoption of Roberts Rules of Order as the official
parliamentary authority governing rules of procedure for Jackson County Board of
Commissioners meetings for 2018.

Board Action 18-005: Approve releasing first installment (50%) of the Jackson County Fair
Association appropriation for 2018 in the amount of $20,000.00

Board Action 18-006: Approve releasing 2018 Southwest Minnesota Workforce Development
Board appropriation request in the amount of $2,515.00.

Resolution 18-001: Approve Appointing Andy Geiger as the County-designated employee


responsible for enforcement of control or eradication of noxious weeds in Jackson County.

RESOLUTION 18-001
APPOINTING COUNTY-DESIGNATED EMPLOYEE RESPONSIBLE FOR
ENFORCEMENT OF CONTROL OR ERADICATION OF NOXIOUS WEEDS IN
JACKSON COUNTY

WHEREAS, the County Board is required under Minnesota Statute 18.80 to appoint
either an agricultural inspector or a county-designated employee to carry out duties as specified
in statute.

NOW, THEREFORE, BE IT RESOLVED by the Jackson County Board of


Commissioners that Andy Geiger, Land Management Director, is appointed as the County-
Designated Employee Responsible for Enforcement of Control or Eradication of Noxious Weeds
in Jackson County effective January 2, 2018.

Resolution 18-002: Approve Grant Agreement and accept a $1,500.00 donation of grant funds,
from the Southwest Initiative Foundation, on behalf of the Jackson County Library, to be used
for purchase of Ancestry.com subscription.

Resolved by the Board of Commissioners, County of Jackson, and State of


Minnesota:

WHEREAS, a grant agreement and donation of funds proposal has been made by the
Southwest Initiative Foundation to Jackson County with this grant of funds to be used by the
Jackson County Library, and;

WHEREAS, Minnesota State Statutes Chapter 465, Section 465.03, “Gifts to


Municipalities” informs that a county governing body shall accept such gifts by resolution and
by at least a two-thirds majority;

IT IS HEREBY RESOLVED, that the Jackson County Board of Commissioners does


hereby approve, by resolution, accepting the grant agreement and the one thousand five hundred
dollar ($1,500.00) donation from the Southwest Initiative Foundation and to be allocated to the
Jackson County Library and used for the purchase of an Ancestry.com subscription.

JACKSON COUNTY EDITORIAL GROUP/PRINTERS PROPOSALS

Justin Lessman, Jackson County Editorial Group, presented proposals for the publication of all
Board proceedings, the annual financial statement and the list of delinquent real estate taxes for
the year 2018. Proposals are on file in the office of the County Coordinator.

Motion was made by Commissioner Eigenberg and seconded by Commissioner McClure


to adopt Resolution 18-003: Approve accepting the proposal of the Jackson County Pilot,
Lakefield Standard and the Tri-County News for publication of all Board proceedings in 6 point
font, the annual financial statement and the list of delinquent real estate taxes for the year 2018.
Motion carried unanimously.

PUBLICATION AGREEMENT
Financial statement/delinquent taxes/monthly proceedings

THIS AGREEMENT, made and entered into this 2nd day of January 2018 by and between Justin
R. Lessman, publisher of the Jackson County Pilot and Lakefield Standard, and on behalf of
Gerald Johnson, publisher of the Tri-County News, as parties of the first part, and the Jackson
County Board of Commissioners, party of the second part.

WITNESSETH, that the parties of the first part agree to print and publish in each and all of the
newspapers above mentioned, printed and published in said County, all of the proceedings of the
said County Board for the year 2018, the annual financial statement to be published during the
year 2018 and the notice and list of real estate taxes remaining delinquent on the first Monday of
January 2018, for the said County, all for the legal rate as specified by law. The composition and
billing procedures of the financial statement, delinquent tax list, and monthly proceedings are
provided on attached copy. Other necessary publications are contracted to be printed and
published in the official newspaper.

Legal charges are determined by type size and column inch. The charges of the respective type
sizes are:
• 9 pt. $9.44/column inch
• 8 pt. $11.28/column inch
• 7 pt. $13.08/column inch
• 6 pt. $14.86/column inch

Payment for publication of said proceedings, financial statement, and list of real estate taxes
remaining delinquent is to be made as follows:

Tri-County News, Heron Lake, Minnesota 23%

Said proceedings of the Jackson County Board are to be published in each of the three
newspapers within fifteen (15) days after copy has been furnished to the official newspaper by

Motion was made by Commissioner Hohenstein and seconded by Hummel to adopt


Resolution 18-004: Approving the designation of 2018 official newspaper and the county website
as the official location for publication of transportation project request for proposals. Motion
carried unanimously.

DESIGNATION OF OFFICIAL NEWSPAPER

WHEREAS, according to Minnesota Statute §331A.04, the Jackson County Board of


Commissioners is required to designate an official newspaper at the first County Board meeting
of the year; and

WHEREAS, according to Minnesota Statute §331A.12, the County Board may designate the
County’s Web site as the official manner of publication for transportation project request for
proposals (RFP’s); and

WHEREAS, Jackson County has a “Web site” as defined in Minnesota Statute §331A.12 with
an addressable location of www.co.jackson.mn.us.

NOW, THEREFORE, BE IT RESOLVED, that the Jackson County Pilot, published on


Thursday of each week, be and the same hereby is designated by the Jackson County Board of
Commissioners of Jackson County, State of Minnesota, as the official newspaper of said county
for the year 2017.

BE IF FURTHER RESOLVED, that the County Board hereby designates the Jackson County
Web site, with an addressable location of www.co.jackson.mn.us, as the official publication site
for transportation project RFP’s.

Motion was made by Commissioner McClure and seconded by Commissioner Hohenstein


to adopt Resolution 18-005: Approve Supporting the Maintenance of Local License Bureaus.
Motion carried unanimously.

RESOLUTION 18-005
SUPPORTING
THE MAINTENANCE OF LOCAL LICENSE BUREAUS

WHEREAS, the State of Minnesota established a deputy registrar network to provide


our citizens with motor vehicle titling and registration services, including driver license
transactions; and,

WHEREAS, deputy registrars are required to operate as agents on behalf of the State of
Minnesota without compensation from the State for the services they offer; and,

WHEREAS, in 1949, the State of Minnesota established in statute a user-based filing fee
on motor vehicle and driver license transactions to be retained by the deputy registrar to defray
all their costs to provide this localized service to our citizens for the State; and,

WHEREAS, the State of Minnesota now receives over $1 billion annually in state fees
and taxes collected through the deputy registrar network; and,

WHEREAS, the State of Minnesota has now shifted substantial clerical and auditing
responsibilities onto the deputy registrar network due to the State’s conversion to their new
MNLARS (Minnesota Licensing and Registration System) program; and,

WHEREAS, the new MNLARS regimen is now documented to have multiple


shortcomings which have severely strained normal deputy registrar operations with longer
processing times that greatly limit their typical volume of daily business; and,

WHEREAS, other MNLARS shortcomings have frequently forced deputies to conduct


“no-(filing) fee” services for customers which acerbates the deputy business model; and,

WHEREAS, deputy registrar offices are now forced to invest in additional staff, office
equipment, and more space to meet customer demand due to the MNLARS conversion; and,

WHEREAS, the filing fee revenue no longer covers the operational costs to maintain
deputy registrar offices such that many local government-based deputies are seeking local
property tax subsidies and private operators are applying for lines of credit to stave off complete
closure,

NOW, THEREFORE, BE IT RESOLVED that the County of Jackson, Minnesota


Board of Commissioners calls upon the State Legislature and our Governor to enact legislation in
2018 to provide deputy registrars with proper compensation by reallocating from existing state
fee structures or other appropriate filing fee adjustments to ensure their valued service and
continued presence remains in our local community to serve our citizens and the State.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal


to adopt Board Action 18-007: Approve declaration of Unit 1092 (Stepp Tar Kettle) as Surplus
Equipment. Motion carried unanimously.

Motion was made by Commissioner Hummel and seconded by Commissioner McClure


to adopt Board Action 18-008: Approve purchase of one (1) 2018 Cancade 14’ Tandem Axle Pup
Trailer from Crysteel Truck Equipment of Lake Crystal, Minnesota for a total price of
$54,690.66 under State contract #122433. Motion carried unanimously.

Motion was made by Commissioner Eigenberg and seconded by Commissioner Wachal


to adopt Board Action 18-009: Approve 2018 Local Legislative Platform. Motion carried
unanimously.

Motion was made by Commissioner Hummel and seconded by Commissioner McClure


to adopt Board Action 18-010: Appointing Commissioner Hohenstein to the Plum Creek Library

System Governing Board for a term to expire the first Tuesday of January 2019. Motion carried
unanimously

to adopt Board Action 18-011: Approving the regular meeting schedule of the Jackson County

to adopt Board Action 18-012: Approve aauthorizing a per diem rate of $50.00 and mileage rate
at the IRS rate, which is 54.5 cents/mile, effective January 1, 2018, for lay persons serving on
the following Boards, Commissions and Committees: Planning & Zoning Commission; Board
of Adjustment; Extension Committee; Housing & Redevelopment (HRA) Authority;
Comprehensive Water Management Advisory Committee; Revolving Loan Fund Advisory
