Sir/Madam, Sub:- Draft Transfer/Placement/Deputation Policy for Group-'B' Gazetted and Group ‘B’ Non-Gazetted Officers posted to Gujarat Customs Zone, Ahmedabad-request for comments-reg. Looking to various demands placed by Group-B Officers’ Associations from different parts of Gujarat, it is felt necessary to have a relook into the present policy and effect changes in the existing guidelines for smooth functioning of the administration and keeping in mind, minimum difficulties to the officers. 2. Accordingly, a draft Transfer/Placement/Deputation Policy for Group-‘B' Gazetted and Group ‘B' Non-Gazetted Officers for posting to the formations of Gujarat Customs Zone, Ahmedabad, duly approved by the Chief Commissioner of Customs, Gujarat Zone, Ahmedabad is enclosed. 3. No. 1N/03-12/EstCC0/2017, Date: 06-04-2018 DRAFT TRANSFER/PLACEMENT/DEPUTATION POLICY FOR GROUP.’B’ GAZETTED AND GROUP 'B' NON-GAZETTED OFFICERS POSTED TO GUJARAT CUSTOMS ZONE, AHMEDABAD. Various representations have been received from different Officers’ Associations of the Zone, requesting for changes in certain provisions of the existing Transfer/Placement/ Deputation Policy for Group-'8' Gazetted and Group ‘B’ Non-Gazetted Officers posted to Gujarat Customs Zone, Ahmedabad issued from F. No. II/3-11/Estt/2011/CCO, dated 10-06-2011 and amendments thereof, issued from time to time. A meeting of representatives of all the Associations was held with the Chief Commissioner of Customs Gujarat Zone and Principal Commissioner! Commissioners of all the Commissionerates of the Zone on 12-03-2018 to discuss the changes proposed by the Associations 2, __ Looking into various demands placed by the Associations, it is felt necessary to have a relook into the present policy and effect changes in certain provisions for smooth functioning of the administration and mitigating difficulties of the officers. 3. This policy is framed in supersession to all the erstwhile transfer policies/guidelines and amendments thereof. Sourcing of Staff for Gujarat Customs Zone. 4. Ahmedabad CGST & Central Excise Zone and Vadodara CGST & Central Excise Zone will be the feeder Zones for Gujarat Customs Zone, Ahmedabad, The allocation of staff to Gujarat Customs Zone from the two feeder Zones will be as follows: a) As far as possible, same ratio of vacancies to the sanctioned strength will be maintained in all the Commissionerates of the Zone. b) Ahmedabad CGST Zone will provide the required number of officers to cover the vacancies arise in Ahmedabad Customs Commissionerate in the offices located at Ahmedabad, Jamnagar and the vacancies in Kandla/Mundra in proportionate to its sanctioned strength ¢) Vadodara CGST Zone will provide the required number of officers to cover the vacancies arise in Ahmedabad Customs Commissionerate in the offices located at South Gujarat and the vacancies in Kandla/Mundra in proportionate to its sanctioned strength, d) The officers, who are undergoing disciplinary proceedings, may be equally distributed and posted to the various Commissionerates in the Gujarat Customs Zone accordingly, as administration also finds it difficult to accommodate more number of charged officers in the same location’ Commissionerate, as the charged officers cannot be assigned any sensitive charges. 7 Q- ©) Officers of age 57 years and above shall be posted to their parent/nearest location as far as possible 1) The tenure of posting of officers to Gujarat Customs Zone will be four years, Period of tenure will be counted from Annual Ge and not from the date of joining 4g) An inspector, on promotion to Superintendent, will be continued to be posted in the same Commissionerate, till completion of his/her tenure in Customs, as long as vacancy exists. h) Internal postings in the Commissionerates will be decided by the respective Commissioners following the transfer policy guidelines issued by DGHRO and instructions issued by DGoV in this regard feria for posting officers in Ahmedabad_Commissionerate_of Gujarat Customs Zone 5. Both the CGST & Central Excise Zones shall post the officers to Customs Zone as per the following criteria: a) The officers from Ahmedabad CGST Sector will normally be posted in the offices of Ahmedabad Customs Commissionerate, located in Ahmedabad, and the officers from Vadodara CGST Zone will be posted in the offices of Ahmedabad Customs Commissionerate in South Gujarat, unless the administration is constrained to do otherwise for want of required number of vacancies. b) Both the Zones will prepare a list of officers considering the duration gap with their previous posting in Customs. Ahmedabad CSGST Zone will consider only the officers of the Commissionerates of Ahmedabad CGST Sector for preparing this list. The list will be in descending order, keeping the officer having longest gap in the combined cadre of Inspector and Superintendent, on top. For the purpose of preparing this list, the relevant date will be taken as below: i) In the case of officers having a previous experience of above one year, the date of relieving from Customs formation will be counted. ii) _ In the case of officers, who have never worked in Customs, the date of joining in any CGST & Central Excise (erstwhile Central Excise or Service Tax) formations in Gujarat in the Inspector cadre will be counted as the relevant date. Tenure of an officer in Customs for a period of less than one year will not be counted as worked in Customs for the purpose of preparing the abovementioned list, c) The required number of officers from each Zone will be provided from the top of the list so prepared General criteria for posting officers in Jamnagar Customs(Preventive) Commissionerate of Gujarat Customs Zone. 6. Ahmedabad CGST Zone will post officers of the Commissionerates of Rajkot Sector for posting to Jamnagar Customs(Preventive) Commissionerate, as below: a) To keep the displacement of officers to the minimum possible, the officers allotted from CGST Sector, Rajkot will be posted to Jamnagar Customs, unless the need arises. b) The list of officers from CGST Rajkot Sector will be prepared in the same manner as mentioned in 5(b) & (c) above. ©) In case of any shortage of officers from Rajkot CGST Sector, officers of Anmedabad CGST Sector may be posted to fill such vacancies. Officers of Ahmedabad CGST Zone so posted to Jamnagar Customs shall be transferred back to Ahmedabad -3- Customs Commissionerate, on his/her request, after completion of two years tenure and they will be posted to non-sensitive posting in Ahmedabad Customs for the remaining two years. If he/she does not opt to return to Ahmedabad Customs Commissionerate after completion of two years, thereafter he/she will be considered in the AGT only after completion of four years in Jamnagar Customs Commissionerate. General criteria for posting officers in Kandla/Mundra Commissionerates of Gujarat Customs Zone - 7. The vacancy in Kandla/Mundra Commissionerates will be filled up as below a) Tenure of posting to Kandla and Mundra Commissionerates combined together would ordinarily be for four years. The four years tenure will be divided into two years in each of these Commissionerates. b) Both the CGST Zones will provide the required number of officers for posting to Kandla/Mundra Commissionerates in proportion to their sanctioned strength. ©) Willingness for the posting to Kandia/Mundra Customs Commissionerates will be called for from the officers of CGST & Central Excise, Anmedabad Zone and CGST & Central Excise Vadodara Zones, who are due for rotation to Gujarat Customs Zone only after completion of six years in CGST Zones. d) A list of officers who have given willingness to Kandla/Mundra Customs Commissionerates will be prepared looking to the gap from their previous posting in Customs, keeping the officer having longest gap on top. For preparing the list, the relevant date will be taken in the same manner as in the case of para-5(a) above. e) Vacancy will be filled up from the list of willing officers, taking the required number of officers from top. f)_ If willingness is not received from sufficient number of officers to fill up the vacancies, the balance required number of officers will be drawn from list of officers prepared as per 5(a) above. 4g) Henceforth, the posting to Kandla and Mundra Commissionerates will be for 2 years each. On completion of 2 years in one Commissionerate, the officers will be transferred to the other Commissionerate. 8. Posting/Deputation to SVP International Airport, Ahmedabad. 75% of the posts to SVP International Airport, Anmedabad is to be filled from the officers of the controlling Commissionerate of Ahmedabad Customs. 25% of the postings is to be filled from other Commissionerates from any in the country, on deputation basis. The tenure of posting on deputation to SVP International Airport would be for two years. 9. Transfer on compassionate/administrative ground or in public interest : a) In case of an officer seeks a posting to a particular station within the Commissionerate on medical grounds, the jurisdictional Commissioner will be empowered to take a decision on genuine request. b) In case of an officer seeks a posting in the Zone, outside the Commissionerate on medical grounds or 12" Standard of his/her child, Committee of the Commissioners would examine the request and forward the same if found genuine, to the Chief Commissioner, who would take an appropriate decision in this regard. No other grounds are normally considered except due to administrative exigencies. ) Notwithstanding anything contained in this policy, an officer may, if necessary in public interest or on administrative ground be transferred or posted to any station or post in Gujarat Customs Zone. 4) Applications for Inter Commissionerate Transfer will be entertained only in the month of January only. e) Posting to CCO, Customs, Ahmedabad and Commissioner(Appeal), Customs will be done by CCO directly. 10. Chief Commissioner of Customs, Gujarat Zone has the discretion to deviate from the above guidelines, subject to recording of the reasons for deviation in writing. This policy shall come into force with immediate effect.
