AFFIDAVIT OF ADVERSE CLAIM

I, CORAZON DE VERA TORRES, of legal age, Filipino and a


resident of Ramos, Tarlac, after having been duly sworn to in accordance
with law, hereby depose and state - THAT:

1. I am filing a Notice of Adverse Claim on the Property covered by


Transfer Certificate of Title No. 93237 of the Registry of Deeds of the
Province of Tarlac covering a real property (parcel of land) located at
Toledo, Ramos, Tarlac, containing an area of 254 square meters and
which parcel of land is particularly described as follows:

TCT No. 93237

A parcel of land (Lot 503-B of the subdivision plan (LRC)


Psd-66326, being a portion of Lot 503 of the Cadastral
Survey of Ramos, LRC (CLRO) Cad. Rec. NO. 398),
situated in the Barrio of Toledo, Municipality of Ramos,
Province of Tarlac. xxx containing an area of TWO
HUNDRED FIFTY FOUR (254) SQUARE METERS, more or
less.

2. The above-described parcel of land is registered in the name of


PEDRO DE VERA who died on September 02, 1989 leaving the above
mentioned property, without a will and testament;

3. I am one of the children and surviving heirs of the late PEDRO DE


VERA and before his death, he entrusted to me the owner’s copy of
TCT No. 93237 with the specific instruction to have the parcel of land
covered by the said lot title partitioned extrajudicially among his
surviving heirs upon his death;

4. As I was preparing the documents for the extrajudicial partition/


settlement of our deceased father’s estate, I came to a shocking
discovery that an Affidavit of Loss had been executed by LETICIA DE
VERA MANABAT and later annotated on the original/Register of Deed’s
copy of TCT No. 93237 on November 4, 2015;

5. Apparently, the said Affidavit of Loss was executed to support LETICIA


DE VERA MANABAT’s Petition for the Issuance of New Owner’s Copy
of TCT 93237 which was subsequently granted by the Regional Trial
Court (RTC) Branch 64, Tarlac City, in Land Case No. 8091 as also
annotated on the lot title on June 01, 2017;
6. LETICIA DE VERA MANABAT acted in bad faith and committed a
perjurious act punishable under the Revised Penal Code because when
she executed the Affidavit of Loss, the subject lot title was not actually
loss but in my possession;

7. Moreover, it is quite preposterous for her (LETICIA DE VERA


MANABAT) to declare the subject lot title as lost when in fact she was
never in possession of the same;

8. Lastly, the fact that the owner’s copy of TCT No. 93237 has been in my
possession all along shows that our deceased father never sold,
transferred or conveyed the subject parcel of land to LETICIA DE VERA
or to any person for that matter, and any instrument with his (deceased
PEDRO DE VERA) signature thereon would be a falsity;

9. Indeed, unless an adverse claim is annotated on the afore-described


TCT No. 93237, I and my co-heirs are in danger of being defrauded and
deprived of our just and valid right over the subject parcel of land and,
as such, I am executing this Affidavit in support of my request for
annotation of an adverse claim over the parcel of land described herein.
