DEL ROSARIO VS OCAMPO-FERRER

FACTS: Del Rosario filed a complaint for sum of money againt respondent before the Regional
Trial Court of Las Pinas City, Branch 275. A compromised agreement was entered by the parties
before the Las Pinas, Branch 275 but still respondent failed to comply which resulted on a levy
on sale on one of responden’t property. Respondent filed a complaint before the RTC of Las Pinas,
branch 198 seeking the annulment of the sherrif’s sale, as well as payment of damages. Branch
198 rendered judgment in favor of respondent.

ISSUE: Whether or not Branch 198 has jurisdiction over the case considering that Sheriff Ortiz
was just complying a lawful order of RTC Las Pinas, Branch 275, a co-equal court, considering
further that the levy on property was procedurally defective.

HELD: Branch 198 has no jurisdiction over the case because Branch 275 has already acquired
jurisdiction over the matter.

Under the doctrine of judicial stability, courts with equal authority, should not, cannot, and are
not permitted to interfere with their respective cases, much less with their orders or judgments.

Therefore, RTC Las Pinas, Branch 198 has no jurisdiction over the case.
