Dear Ms. Parker: 
 
Thank you for your response.   The letter attached does not have date or signature.  
 
We are confident the Corps received more than three forms of interest in forming a new RAB, and since I and others
besides myself that live on Culebra submitted, we are confident forms from residents were sent. This is also part of the
reason we would like to restore the RAB and the formal record.  
 
Regarding any of the non­resident advisors offering to participate on the community RAB, as you may be aware, Culebra
is a low­income, traditionally underserved and isolated Environmental Justice community.  Many larger communities do
not have the expertise needed to meaningfully participate where complex hazards of this magnitude exist, let alone where
they exist in the unscannable and shifting sands of a world renown tourism attraction.  Therefor we have advisors that
unlike a contracted TAPP, the community knows for years and that the community trust.  Free expertise should be
welcomed by the Corps, not discouraged especially where the local population is under 2,000, but where tourism
populations can top out at over 5k, on the beach same beach that was the epicenter of the Atlantic Fleet's Training area.  
 
While we understand the Navy controls the clean up on Vieques and the Corps on Culebra, it is interesting that there are
so many similarities regarding problems articulated by both communities, and associated with both the clean ups and
despite the different protocols underway. 
 
We did not understand that both time critical and non­time critical removal actions embrace the same safeguards with
respect to the environment.  It was our understanding that time critical removal actions do not involve special precautions
for critical habitat, listed marine reptiles and mammals.  It is my hope you can please send the protocols that reflect this.  
 
We were told at the meeting where only a few hours notice was given to the public, that the public notice was "not the
Corps fault."   The Corps said the municipality called the meeting.  These days the proverbial buck seems to stop at any
duo­accountable agency, in what to us looks like a social justice shell game where the affected poor communities always
seem to loose.  The municipality of Culebra is a low income, traditionally underserved, environmental justice community
that when notified of the closure, Im sure did their best to try and notify their people. They did the right thing by requesting
your agencies assistance.    The Corps on the other hand, with a disabled RAB, and who knows what has happened to
the federal record, failed to manage an announcement compliant to federal standards for meaningful public participation. 
We have to ask why the Corps failed to respect its obligations of meaningful public participation, deflecting its
responsibilities on the low income community?   This deflection of accountability is unacceptable and no excuse.   If the
expenditure of federal funds is involved, in this case Wilberto Cubero's time, transport and preparation for the
presentation, and especially given this involved one of the most critical announcements the community received regarding
closure of the epicenter of their tourism revenue, Playa Flamenco,  then the Corps is obliged to abide by federal agency
rules of proper public notification.  
 
There are clear gaps in agency planning and the implementation of biological oversight where we documented a
hovercraft screaming over fourth of July holiday and inside Culebra's Marine Protected Area.  There is digital video
showing the craft bouncing along the shore, spewing oil fumes and smashing shoreline corals. The biological expert
working for contractor  informed me it was his first day, and said he could not tell if the craft was working properly,

because it was the first time he saw it operating.  He was later photographed on shore of a different beach, out of sight of
the craft from where the craft was working, and clearly in violation of spotting protocol.  
 
While we don't know who from what agency was notified as you indicated, we have a record of agency representatives
who should have been notified and were not.  This is why it is so frustrating to us that all of this is taking place outside of a
venue that affords a public record.  This environmental justice community meaningful public participation and a
meaningful record of our concerns should be a must.  For example, if there were a record, you would have known who
was not informed, since they wrote the project manager.  It appears from your communication, you were not informed. 
The most frustrating aspect is that these problems repeat,  when meaningful communication with the people could solve
the problem. 
 
Finally, I dont think you understood the point I was trying to make about the limitations on Culebra of Recognize ­ Retreat
and Report, specific to the impacts to the 7 year old girl burned by the white phosphorous munition. The probability is that
munitions  found today, may have likely been left when NATO exercises increased in the late thirties, early forties.  Seven
decades of exposure.  The flares no longer appear as munitions, and who knows what else is even out there.  There is a
significant discrepancy between what the Navy records show was fired and what has been detected.
Since NATO forces used the area we have had US UXO experts tell us they don't know what some of the foreign country
munitions are or how to diffuse them.  After decades the munitions can become encrusted in calcium carbonate, or altered
by the exposure to the elements of the ocean, making them even more hazardous especially where spring detonated
devices are concerned.  If you cannot Recognize, then how can you Retreat and Report... 
 
As you can see from the attached photo ­ this was posted in 2013 on facebook at a RAB full of people and on a facebook
post that reflected more effective communications with community and agency.

each point in order of your email. 
 
Attached is the most recent letter mailed to the community regarding the establishment of a Restoration Advisory Board
for Culebra. 
 
Public input is an important component of the CERCLA process. We have hosted multiple public/community meetings
throughout the course of this project over the years, and will continue to do so. We also provide periodic project update
letters to the community to ensure they are informed of ongoing work efforts. 
 
All public meetings hosted by the Corps of Engineers are announced via direct mailing, social media, posters, web site,
etc. We take every measure to ensure the public is well informed when a meeting hosted by the Corps will occur. 
 
To address your concern about a meeting that occurred regarding the closure of Playa Flamenco and lack of
announcement, this meeting was not hosted by the Corps. The Corps was invited to simply participate and provide a
project update after discussing the status of the project with local officials. We cannot control or direct how other entities
choose to announce their meetings. 
 
Vieques is not managed by the Corps of Engineers, and is being managed by the Navy. Any concerns regarding
activities at Vieques should be directed to the appropriate persons managing that site. 
 
Protecting the environment, including threatened and endangered species, is one of our highest priorities. We have
established environmental safeguards since the beginning – it is required for all projects. Environmental safeguards do
not change in a Time Critical Removal Action (TCRA) or a non­TCRA. They remain the same. 
 
The Corps coordinates all work plans, fieldwork activities and schedules and other aspects of environmental responses
with the Puerto Rico Environmental Quality Board, the Environmental Protection Agency, National Marine Fisheries
Service, and resource agencies, including but not limited to the Puerto Rico Department of Natural and Environmental
Resources and the US Fish and Wildlife Service. The Corps also coordinates with the municipality while preparing for
fieldwork and throughout fieldwork activities. 
 
We do our very best to ensure that work will not interfere or disrupt the community. There will be times contractors will
work during holidays, but the regulator, resource agencies, stakeholders and the municipality are aware of the fieldwork
schedule prior to crews mobilizing to the field. 
 
The Corps maintains records and takes into consideration all public concerns that are expressed to us, in addition to the
comments and concerns we receive from the regulator, resource agencies, and other stakeholders.

It is our understanding that the Puerto Rico Environmental Quality Board has initiated a munitions management training
and education program which should address your concerns regarding training.  We recommend you submit your ideas
for a validation notebook to EQB as they recently offered a munitions management awareness training to local
emergency responders on Culebra. 
 
The Recognize, Retreat, Report education campaign is working as local agencies are receiving reports of finds from
residents or visitors minimizing potential incidents with munitions items on the island. We will continue to support and
promote this critical safety message across all venues of the island. We always welcome the support of the local
community in assisting us to help spread this important message.

Before we get bounced about again, it is not clear if our concerns below were copied to your attention, so please take a
moment to read our concerns below. 
 
Also going forward, the community wants to let you know that we expect a RAB restored on Culebra, with regular
meetings. 
 
We would like a consideration for a smaller board, since the environmental justice, low income, traditionally
underserved population of Culebra is small, 
and given there is precedent already established for this considerationon the past RAB board. 
 
We demand a meaningful voice in the CERCLA process now that it has apparently reached the time in the process,
when this is possible?  Actually we really have no idea. 
 
We expect future public meetings to be announced according to federal announcement protocol, 
and not a few hours prior to important meetings taking place, as happened with the meeting announcing the closure of
Playa Flamenco before the hurricane.  Perhaps given the millions of dollars of public funds now being spent,
announcements should be placed and a public record kept in the Federal Registry, 
 
We demand an end to open air and in water burns / detonations and will be making these concerns more visible in
partnership 
with activists also concerned on Vieques and the Cease Fire Campaign.    Given the lack of monitoring there is no
assurances these clean ups are safe for the public.  We felt the last detonation on Vieques, at our office on Culebra,
and winds were above 20mph, so we have to question breaches of detonation protocol on Vieques as well. Culebra is
only 7 miles away. 
 
We demand a consideration defined as a part of this clean up that establishes proper environmental safeguards for
endangered marine reptiles, mammals and critical habitat consistent with requirements for non­time critical removal
efforts.  It seems an abuse to have  previously planned and scheduled time critical removals, possibly to avoid these
precautions.  If this is the case, and because of lack of communication it is not clear, this is completely unacceptable.
Given the millions already spent on studies and clean up,  it should at this point be no surprise to anyone there are
bombs in these areas and a proactive protection plan for federally listed resources in the area should be defined and

implemented with meaningful input form the affected community. 
 
We are seeing repetitive clean ups.  Repetitive SOP's.  We recognize the need for better communications with
contractors where there have been conflicts with invasive and poorly planned contractor clean ups were scheduled
during holidays.  Agency heads have not properly expressed community concerns. 
 
 At this point we are not even sure if our written concerns are being included in any record. 
 
 
Finally, and for what has to be close to the 20th time making this point in writing, this community needs a plan and
training protocol in place to safeguard tourists and islanders when bombs are found where offices of first responders
have high turn over.   We envision a validation notebook so when new officers arrive they are made familiar with
Culebra's UXO issues and are asked to sign off on a sheet that they understand Culebra's unique issues. 
 
"Recognize, Retreat and Report "did not work and cannot be relied upon to work in the future because Culebra
munitions have 
been here so long,  and are so impacted by the sea and/or encrusted by corals, they are not recognizable.  This was
tragically illustrated by the 7 year old tourist allowed to board the ferry because first responders did not realize the burns
were from white phosphorous.  Then there was some kind of a cover up on the other end, after Army Corps officials
explained to me they were sending someone to meet them on the Fajardo side. 
 
I don't know if this even goes into a record, but I just want to make this point very clear, it is not acceptable for one more
little kid to be injured in this way on Culebra,  not one more kid and when protocols prove they don't work, they demand
revisiting and with the affected public.

The letter you sent dated March 26, 2018, stated the following: 
 
"The Culebra clean­up activities may require open field burning to clear the area of vegetation so the contractors can
locate unexploded ordnance (UXO) or shrapnel and remove it or detonate it. This variance would be issue under Rule
301 of the RCAP, if required and applicable. The treatment of munitions and explosives of concern (MEC) during these
operations follow the Department of Defense Explosive Safety Board (DDESB) approved Explosives Site Plan (ESP) or
Explosives Safety Submission (ESS)."

As you know, the US Army Corps of Engineers has dissolved the RAB on Culebra, despite public interest and at the
time when the clean up has moved into that part of the CERCLA process where public participation is warranted.  While
there is still a RAB on Vieques, there was no public notification of concerned party's of the detonation felt on Culebra,
March 22nd. 
 
We are very concerned that the letter you wrote included the possibility of open field burns on Culebra and we would
appreciated your advise as to how we can file a formal intervention to insure we have a voice on such a proposal, 
should Rule 301 of the RCAP be solicited to open field burn on Culebra. 
 
It is outrageous that open field burning would be considered given impacts this would clearly have to local public,
wildlife and threats posed to coastal water quality, and critical habitat listed resources from subsequent erosion. It is
also outrageous that these recent open detonations on Culebra and Vieques are conducted without public notification, 
and that they are allowed to continue at all, given the agencies non­discretional duties of oversight to protect the
people's health as defined by law. 
 
It seems intuitive that violations of air quality standards cannot be detected, if nothing is being monitored.   EPA has
spoken about open air detonations occurring when wind speed is below 20mph, but this is not respected either. 
 
It seems clear that the only way to protect human health and environmental is for Puerto Rico to demand chambered
detonations. 
 
This cannot be the first time the agencies have had to deal with contractors that claim they cannot afford to conduct
practices in an environmentally sustainable manner. 
 
Thank you for any direction in establishing an intervention into this permitting process.
