CATERING SERVICES AGREEMENT

This CONTRACT is made and entered into this December 18, 2017 by and between:

--------------------------------, a sole proprietorship duly registered

under the laws of the Philippines with a Department of Trade and
Industry (DTI) Certificate No. --------------------, with business
address at -------------------, duly represented herein by its
Owner/Manager, ---------------- and hereinafter referred to as
"CATERER"

hereinafter referred to as "PROCURING ENTITY"

WITNESSETH:

WHEREAS, PROCURING ENTITY shall hold its ------------------- at -----------------;

WHEREAS, to effectively and efficiently implement the above-cited exercise, various supplies
and materials including catering services must be procured;
WHEREAS, in accordance with the provisions of Republic Act No, 9184, the provision of
catering services for the Christmas Program was awarded to the CATERER, being the lowest
bidder in the amount of THIRTY EIGHT THOUSAND ONE HUNDRED PESOS ONLY
(Php38,100.00);
NOW, THEREFORE, for and in consideration of the foregoing premises and the terms and
conditions herein, stipulated, the parties hereby mutually agree and bind themselves to the
following:
1. SCOPE OF WORK.

a. The CATERER shall provide catering services for ----------- participants of

Christmas Program on ----------------;
b. The CATERER shall provide all materials to effectively execute this Agreement,
including but not limited to utensils, tables, chairs, and such other matters that is
necessary and incidental thereto;
c. The CATERER shall provide sufficient personnel/waiters in appropriate attire
who are skilful in food preparation, table arrangement and serving;

2. CONSIDERATION AND TERMS OF PAYMENT

a. PROCURING ENTITY is under obligation to pay the CATERER in the amount

of THIRTY EIGHT THOUSAND ONE HUNDRED PESOS ONLY
(Php38,100.00) as a consideration of this agreement;
b. Any balance due to the CATERER shall be settled after the completion of the
catering services;

 c. In no case shall PROCURING ENTITY be held liable for any excess of the
contract price;

3. DUTIES OF THE CATERER

a. The CATERER shall undertake all tasks so that high standards of food hygiene
and health and safety are met;
b. The CATERER shall ensure that its personnel are in good personal hygiene at all
times and be of well-groomed appearance at all times;
c. The CATERER shall ensure that goods and left-overs are collected and cleaned-
up after each and every meal;
d. The CATERER shall not depart from the agreed food to be served, unless with the
written consent of the PROCURING ENTITY;
e. The CATERER shall exercise all reasonable skill, care, diligence, and prudence
in the discharge of the duties agreed to be performed and shall always work in the
best interest of the PROCURING ENTITY.

4. DUTIES OF PROCURING ENTITY

a. The PROCURING ENTITY shall provide suitable facility for the

CONTACTOR to perform duties required for the number of guest expected;
b. The PROCURING ENTITY shall arrange for, or personally provide access to said
facility to accommodate the reasonable set-up and preparation prior to the event;

5. GENERAL PROVISIONS:

a. The CATERER shall be held responsible from all liabilities if food poisoning or
any problem should arise;
b. All procurements and payments under this Agreement shall be subject to existing
government accounting and auditing rules and requirements;
c. CATERER shall not contract with any entity to perform in whole or in part the
work or services required hereunder without the express written approval of the
PROCURING ENTITY. Neither this Agreement nor any interest herein may be
assigned or transferred, voluntarily or by operation of law, without the prior written
approval of the PROCURING ENTITY. Any such prohibited assignment or
transfer shall be void;
d. This Agreement may be supplemented, amended, or modified only by the mutual
agreement of the parties. No supplement, amendment, or modification of this
Agreement shall be binding unless it is in writing and signed by all parties;
e. Failure on the part of the CATERER to comply with the agreements set forth in
this Agreement shall make the party liable for damages to the affected party
