ADDENDUM TO THE CONTRACT FOR THE CONSTRUCTION OF 3- BLOCK VIP LATRINE FOR

LOIKAS PRIMARY SCHOOL

Ref No. 6/2015

This document is in reference to a contract agreement dated Nairobi, 14th December, 2015,
between the following parties that are named below in this document:

1. The non-governmental organisation under Kenyan Law CORDAID, established statutorily in Kenya
(New Rehema House, Rhapta Road 5th floor), registered at the NGO Coordination Board under
number OP. 218/051/9553/540 (May 11 2000) represented by Ms. Vlora Gojani in her function as
Acting Country Director, Cordaid Office Kenya hereafter named: "Cordaid";

2. The company under Kenyan Law, Maraai Company Limited, registered under the Companies Act
Cap. 486, under registration number CPR/2015/1942016 with its registered offices at Maralal
represented by Mr. Zakaria Hussein in his function as Director hereafter named “Contractor”

Also jointly referred to as: "Parties".

May it be known that the undersigned parties, for good consideration, do hereby agree to make the
following changes that are outlined below;

i) The Contractor to construct a 2 Units & Shower VIP Block Latrine in lieu of 3 Block
Latrines
ii) Owing to (i) above, the Contractor to incorporate the following items that were not included in
the Bill of Quantities that forms part of the Contract document

The changes shall constitute variation of provisional quantities in the bill of quantities that forms part
of the contract document in accordance with Article 24 of the Conditions of Contract, consequent to
which the contract price shall be varied accordingly.

These changes shall be made valid as if they are included in the original stated contract and in
accordance with Article 4, clause 4.1.

With such an aforementioned amendment to the contract, all the other articles of the contract document
shall be in consistence with the amended Article 4, clause 2.1 and shall remain unaltered.

Subsequent payments to the contractor shall be made unequivocally pursuant to this addendum and in
consistence with Article 2 of the contract agreement.

This addendum shall be effected forthwith upon undersigning by the aforementioned parties.

No other terms or conditions of the above mentioned contract shall be negated or changed as a result
of this here stated addendum.
