Brief Facts
The present complaint is led for grant of compensation for delay in possession. Also, the
complainant claimed that he is entitled to the interest on the principal amount due to the delay.
The complainant also asked for compensation for not allotting him the top floor flat he chose.
Held
The Authority directed the respondent to pay compensation to the complainant @ Rs. 5/sq.ft
from 24.09.2014 to 19.07.2018, and if the respondent does not give possession to the
complainant even after that, they were directed to pay the complainant the full amount in
addition to the compensation at the interest of 18%. Also, if respondent is not able to provide
the complainant with the desired top oor at, this will amount to false promise on
respondent's part and they will have to refund the entire amount paid by the complainant at
the interest of 18%.
