15 being first duly sworn, moves the Court for leave to file an Information charging the

16 above-named Defendant with allegedly committing the offense(s) in Missoula County of;

17 COUNT I: CRIMINAL POSSESSION OF DANGEROUS DRUGS WITH INTENT TO

18 DISTRIBUTE - FELONY, a Felony, in violation of Montana law, namely: Mont. Code Ann.

19 45-9-103;

20 COUNT II: CRIMINAL POSSESSION OF DRUG PARAPHERNALIA, a Misdemeanor, in

21 violation of Montana law, namely: Mont. Code Ann. 45-10-103; COUNT III: CRIMINAL

22 POSSESSION OF DANGEROUS DRUGS - FELONY, a Felony, in violation of Montana

MOTION AND AFFIDAVIT FOR LEAVE TO FILE INFORMATION


1 law, namely: Mont. Code Ann. 45-9-102(1).

2 The Motion is based upon the following facts which have been obtained from

3 reports of the law enforcement officers which, if true, I believe, constitute sufficient

4 probable cause to justify the filing of the charges. The facts from those reports are as

5 follows:

6 On or about the 27th day of February, law enforcement officer located a probation

7 absconder, Jeffrey king, at the residence he was sharing with his girlfriend, Marie Dibble, in

8 Missoula County. Law enforcement located drug paraphernalia and a search was

9 conducted. Law enforcement located two scales, a ledger, 7 baggies of what NIK tested

10 positive as methamphetamine, two baggies of what NIK tested positive as heroin, and a

11 small number of psilocybin mushrooms.

12 In a subsequent phone interview, Marie Dibble admitted that both she and King

13 possessed the drugs. She claimed they were for personal use and that they had been left

14 at the house by someone else already packaged for sale.

15 Bail was set in Justice Court at $10,000 and has been posted.

18 DISTRIBUTE - FELONY, a Felony, in violation of Montana law, namely: Mont. Code Ann.

19 45-9-103, punishable by 20 years MSP and/or $50,000 fine;

20 COUNT III: CRIMINAL POSSESSION OF DANGEROUS DRUGS - FELONY, a Felony, in

21 violation of Montana law, namely: Mont. Code Ann. 45-9-102(1), punishable by 5 years

22 MSP and/or $50,000 fine.

The facts constituting the offense are:

1 COUNT I: On or about the 27th day of March, 2018, the above-named Defendant

2 knowingly possessed a dangerous drug, methamphetamine, with intent to distribute.

3 COUNT II: On or about the 27th day of March, 2018, the above-named Defendant

4 knowingly possessed a dangerous drug, heroin, with intent to distribute.

COUNT Ill: On or about the 27th day of March, 2018, the above-named Defendant

6 knowingly had in his possession a dangerous drug, as defined in 50-32-101, to wit:

7 psilocybin mushrooms.
