Guidelines for providing Assistance under MIDH, NMSA, RKVY and State Plan Schemes

Subject- Guidelines for providing assistance under various Schemes of State Plan,
MIDH, NMSA & RKVY (2014).
1. Norms and guidelines would be as per the GOI and State guidelines and norms fixed
for the year 2014-15 and shall be applicable in subsequent years unless modified.
The guidelines are described in subsequent pages of this booklet.
2. The Directorate of Horticulture and Mission Director shall every year empanel
reputed firms/suppliers for supply/sale of planting material and inputs under above
schemes strictly as per the guidelines issued by Govt. of India from time to time. This
exercise should preferably be completed in the 1st quarter of financial year.
3. Component is to be implemented as per the rates circulated, firms empanelled and
instructions issued by Director Horticulture and Mission Director, HSHDA from time
to time.
4. The District-level target allotted by the Directorate will further be divided Block-
wise by the DHO in consultation with APO and HDO and in view of the potential
and response of local farmers.
5. A list of registered firms along with quoted rates for supply of drip and sprinkler
irrigation system shall be kept by District Horticulture Officers in the offices of all
the Additional Deputy Commissioners, District Horticulture Officers, Horticulture
Development Officers and members of DHMIU as applicable.
6. Scheme shall be popularized mainly through existing extension network of the
department and other resources available to them. Proper advertisement shall be
given for awareness of the programmes
1. Only those Farmer &/or entrepreneur having land ownership in Haryana State
shall be eligible for availing assistance under the schemes. In case of non-
ownership of land the eligibility be guided as below:
i. For non-project based activities and seasonal/annual crops: registered
lease agreement between the parties for one year for one year crops and
twenty years for orchards.
ii. For project based activities: registered lease agreement between the
parties for twelve years for micro irrigation and polyhouses.

2. Assistance shall be available only for horticultural crops as per the GOI norms
and guidelines
3. For general queries like crop, cluster and credit linked back ended subsidies one
can refer to Frequently Asked Questions.
4. Farmers shall be free to procure material from any registered firm of his choice.
5. Subsidy will be admissible both in loan and non-loanee cases.
6. Subsidy in loan cases would be released in loanee‟s bank account.
7. Subsidy on plantation/cultivation would be admissible only to the beneficiary
having as assured source of irrigation (tube-well/water tank supported with
engine).
1. The farmer-applicant will submit the application to the HDO in the prescribed
format.
i. Form-1 in case of non-project based activities
1. Beneficiary can deposit the application to HDO office or through HDO to
DHO cum MS DHMIU office.
ii. Form-2 in case of project based activities
1. Cases are to be sent to Mission Director for further approval from the
competent authorities i.e. MD HSHDA, EC HSHDA, EC MIDH-GOI as the
case may be.
iii. Form-3 in case of training
1. Every farmer is to be registered at HTI, Uchani, Karnal before training.
1. In case where the material and inputs are not purchased, but the component is
installed viz.: vermi-compost unit, mushroom unit, area expansion area, post-harvest
units and other physical structure, the proper verification shall be done by the HDO,
APO and DHO concerned in the prescribed format. In case of polyhouses, the policy
circulated separately shall be applicable. The physical verification shall be done as

6. Release of Assistance
1. Criteria for release: Physical inspection as described below must be done within 14 days of
work completion:
i. In case of non-project based activities: duly verification by the block HDO in all the
cases, 25% verification by APO concerned and at least 10% verification of total
cases by DHO
ii. In case of community tank: duly verified by a committee so constituted by Mission
Director &/or ADC-cum-chairman DHMIU
iii. In case of project based activities: duly verified and inspection report submitted by a
team members comprising of Officer concerned from Head Quarter, DHO of
concerned district, any Govt. expert in the field of component and representative
from concerned bank (if credit linked)
2. Release: subsidy will be released by the DHO after obtaining the physical report as:
i. Subsidy is to be released as per norms fixed and guidelines prescribed
ii. Subsidy is to be released within 7 days of physical inspection report.
iii. Subsidy is to be released per ha or per unit basis as the case may be. In cases where
assistance is being sought on lesser or more area than that of one ha or one unit than
subsidy be released on pro-rata basis subject to maximum limit prescribed in
guidelines under MIDH
1. For example: one beneficiary have applied for assistance for one unit of
vermi-compost for an estimated cost of Rs. 60,000/- with an assistance of Rs.
30,000/- (50%) and on verification if the unit size was of lesser size, in such
cases estimated cost be reduced on pro rata basis and on reduced estimated
cost, the 50% assistance be calculated.
iv. Determination of per ha or unit can be ascertained as prescribed against individual
component in the guidelines.
v. Subsidy be released directly to the beneficiary as direct assistance or as inputs as per
the instructions issued from Mission Director time to time for individual component.
1. For direct release of assistance to the beneficiary payment be released as
cross cheque/demand draft in the name of beneficiary only.
2. No payment be released as cash by taking signature or thumb impression in
register

3. All the assistance released must be entered in proper register and in cash
book.
7. Reporting:
1. District Horticulture Officer will maintain the subsidy account and sent the list to
Directorate monthly on or before 3rd of every month on prescribed performa..
2. District Horticulture Officer shall maintain the list of beneficiaries and shall be
sent to Directorate on the prescribed performa on or before 3rd of every month.
3. District Horticulture Officer shall send the physical and financial progress of his
district monthly on prescribed performa on or before 3rd of every month.
8. Monitoring
1. Roster register shall be maintained by the DHO in his office.
2. HDO will carry out 100% physical verification of the components under the
schemes.
3. APO will carry out 25% physical verification of the components under the
schemes.
4. DHO will carry out 10% of the total no. of units installed or complete cases.
5. Random physical verification in each district will be carried out by HQ officers at
least 2% out of total units installed or complete cases.
9. The DHO will be the controlling officer for successful implementation of the Scheme/s
and co-ordination of all the schemes under which various components are being
implemented as per the scheme guidelines. He will also ensure that the scheme is duly
publicized in the district immediately after the targets are allotted.

1. These norms and guidelines are to be operational from April 01, 2014
2. Cost norms means upper limit of cost for calculation of subsidy.
3. Project based activity means, the project proposals is to be approved by the competent authority.
4. The release of back ended subsidy need not be credit linked for the institutions like Public Sector Units,
Panchayats, Cooperatives, registered Societies / Trusts and public limited companies , provided they can
meet the remaining share of the project cost out of their own resources.

Question: Are all the districts covered under the MIDH Scheme?
Answer: The Scheme is being implemented in 367 district covering 18 States and 3
UTs in the country. The details of crops and district cluster are available under ‘State
Profile’ of the web site.
Question: Whom should a farmer contact for availing assistance under the MIDH?
Answer: The MIDH is being implemented by the State Horticulture Mission of which the Mission
Director is responsible for coordinating the programme. The contact details of the Mission
Directors are given under ‘Contact Us’ of this web site. At the district level, the District level
Committee is responsible for implementing the programme. The District Horticulture officer is the
Member Secretary of the DLC, who may be contacted for availing the assistance.
Question: From which date assistance as per new norms will be available to the
beneficiaries?
Answer: The new norms are applicable with effect from 1st April, 2010. However,
assistance for spill over work of previous year and maintenance of area expansion
activities taken up during 2008-09 and 2009-10 will be as per the pre-revised norms.
Question: Can a beneficiary avail assistance for more than one activity under the PHM
component of the Scheme.
Answer: Yes. The assistance will be within the permissible limits of individual
components for which integrated project proposal will have to be submitted, for approval of
EC/EMC.
Question: Can a beneficiary avail assistance for area expansion activity in less than one
hectare?
Answer: Yes.
Question: Can a farmer get assistance for cultivating two or more crops?
Answer: The Mission envisages a cluster approach for the holistic development of crop in the
particular cluster. Hence the farmer is expected to get assistance for the main crop.
Question: Can a beneficiary avail assistance from the NHB as well as MIDH for Post Harvest
Management related activities?
Answer: Assistance for the same component like storage, pack houses etc. could be availed
only from one source.
Question: What is credit linked back ended subsidy and how is it administered?
Answer: Assistance for a number of components under MIDH, particularly for the private sector
involving infrastructure development such on nurseries, establishment of lab & clinics, post-
harvest management and marketing is in the form of credit linked back ended subsidy. It implies
that the beneficiary has to avail loan from the Nationalized Banks /Financial Institution (FI) such
as NABARD, IDBI, SIDBI, ICICI, State Financial Corporations, State Industrial Development
Corporations, NBFCs, NEDFI, National SCST/minorities/ Backward- Classes Financial and
Development Corporation, other designated loaning institutions of the State / UTs, Commercial/
Cooperative Banks, etc. Concerned banks/ State FIs may adhere to their own appraisal norms
while sanctioning projects under the scheme. The appraisal note submitted to SHM for sanction/
Claim of subsidy should invariably be the same which formed the basis for sanction of term loan.
The project should be implemented within a period of two years from the date of
sanction of loan. The payment of back-ended subsidy will be made after the project has been
successfully completed according to the terms and conditions of the loan/or as per the approved
feasibility cum project report, as the case may be.
Upon completion of the project, the concerned Bank/FI/would inform SHM that the project had
been completed (in accordance with) the guidelines of MIDH and shall make a request to SHM
for joint inspection of project the point inspection will be conducted in the presence of promoter.
The payment of back ended subsidy will be made after project has been successfully completed
according to the terms and conditions of the loan or as per the approved feasibility-cum-project
report, as the case may be.
Bank /FI/NCDC, as the case may be, would submit to SHM the Utilization Certificate of the
subsidy released by SHM. The subsidy assistance released by SHM to Bank/FI on behalf of the
individual units which are sanctioned, will be kept in the separate account. The adjustment of
subsidy will be on the pattern of back-ended subsidy wherein the full project cost including the
subsidy amount but excluding the margin money contribution from beneficiary would be
disbursed as loan by the banks. The repayment schedule will be drawn on the loan amount in
such a way that the subsidy amount is adjusted after the bank loan portion (excluding subsidy) is
liquidated.
The subsidy admissible to the borrower under the scheme will be kept in the Subsidy Reserve
Fund A/c. borrower .wise in the books of the financing Banks. No interest will be applied on

subsidy portion by the Bank. The balance lying to the credit of the Subsidy Reserve Fund A/c will
not form part of Demand and Time Liabilities for the purpose of SLR/CRR. Suitable instructions
issued in this regard by the RBI from time to time would be followed.
Question: Can a farmer avail assistance for activities like mushroom production and bee
keeping?
Answer: Yes, with effect from 2010-11, assistance is available for activities like (a) Integrated
mushroom unit for spawn, compost production and training (b) spawn making unit and (c)
compost making unit. Assistance is also available for beekeeping activities like production of bee
colonies by Bee Breeders, distribution of honey bee colonies, hives and bee keeping equipments.
Question: Is assistance available under MIDH for setting up food processing units?
Answer: Under MIDH Scheme, assistance is available for setting up primary / mobile processing
unit costing up to Rs. 24.00 lakh. For bigger units, assistance is being provided by the Ministry of
Food Processing Industries.

NOTE:
1. In case of tank sizes above and below the mentioned dimensions, the capacity and subsidy can be
calculated on pro-rata basis on 0.5 scale.
2. Estimates of water tanks shall remain same as already circulated last year due to non- revision of HSR.
3. The rate per litter and subsidy in column 8 & 9 in table - A is for tanks where in catchment area/irrigated
area is to be vegetable/flower grown in open and/or in protected structures.
4. The rate per litter and subsidy in column 10 & 11 in table - A is for tanks where in catchment
area/irrigated area is to be fruit crops or vegetables as inter crop with fruit crops.
iv) The community/farmer group should have a permanent source of quality water fit for
horticultural crops for filling the water tank.
v) The area which is to be irrigated from tank as per the capacity of tank approved from
the competent authority will compulsory be developed under horticulture crops.
vi) All such area must be brought under Micro Irrigation System. The crops in any of the
case whether fruits or vegetables must be under drip (Drip system and/or mini
sprinkler system).
vii) Assistance is limited to maximum 20 lacs per community/farmer group.
viii) Assistance norms which are applicable at the time of sanction of case, shall be
followed.
4. Release of Subsidy:
i) Physical verification will be done by committee constituted at District level.
ii) HDO and DHO will ensure to use the stored water for horticultural crops only with
Micro Irrigation System.
iii) Criteria are framed with 4 stages for release the subsidy (as given below) in the
benefit of farmers.
Protected Cultivation
A. General Guidelines:
I. All the cases must be entertained through online on HORTNET in case assistance is to be availed
under MIDH scheme.
II. The cases shall be entertained on First Come First Serve Basis.
III. The applicant shall be responsible for the completion of all required documents. Incomplete
documents does not entitles applicant to avail assistance. The application shall be considered
only after completion of all the documents.
IV. Farmer will apply to concern DHO office through HDO of concerned block with complete
required documents as per check-list as attached at Annexure-I.
V. DHO will verify the documents as per check-list and will forward the case online on HORTNET
to headquarter with his recommendation as per availability of the funds with them.
VI. Headquarter will scrutinise the cases and accord approval for release of assistance under this
component.
VII. In case it was decided that DHO will sanction the cases then Step V & VI above shall be
executed by District Office.
VIII. DHO will issue sanction letter after approval from HQ (Form -5).

VI. Bank after sanctioning the loan amount of project will send a copy of sanction letter and
appraisal report to DHO for the sanction of project. The date of receiving of appraisal report in
DHO office shall be treated as first day of application and will be considered based on available
targets.
VII. DHO will forward the all case online on HORTNET to headquarter with his recommendation as
per availability of the funds with them.
VIII. Headquarter will scrutinise the cases and accord sanction for release of assistance under this
component.
IX. In case it was decided that DHO will sanction the cases then Step VII & VIII above shall be
executed by District Office.
X. DHO will issue sanction letter (Form -5)
2) Only farmer of Haryana can be a beneficiary under the schemes. The document viz. Ration
card/voter card/Aadhar card/Domicile/Passport etc. is required.
3) Farmer means a person having land ownership in one‟s name.For this he has to submit Land
Records: Original Jamabandi (Latest by three months), Intekal ,Sizra, Land verification report by
Patwari. Girdawri. All the documents submitted shall latest not more than three months old.
4) Farmer includes farmer‟s family, means husband, wife and their minor children. Ration card is
required to prove family unit.
5) The adult son/daughter or in case of his/her death, his/her widow/widower and children shall be
deemed to be living with the parents or either of them. The adult son/daughter shall only be
considered as separate unit only when separated from parents. It means they live separate from
parents and this can be verified by means of Adhaar card and/or Voter ID Card or Driving
License or separate ration card having in all the cases separate address to that of their parents.
6) Department promotes cluster and for that farmers of Haryana can take land on lease. But in all
such cases the cluster projects should be bankable. The combined amount of assistance to such
cluster projects should not increase 20% of the total financial targets of that district.
7) Only those applicants are eligible to apply who did not availed assistance on account of Protected
Cultivation in his/her name/spouse name or in name of dependent member of his/her family from
any Government agency. Further those applicants or dependent family members who have been
availed assistance under this component at anytime, anywhere in Haryana are not eligible.
3. Application Forms and formats: The sample forms and formats are annexed at Annexure – II.
4. Assistance Limit: the assistance shall be applicable as per norms given below:

8. Empanelment of new firms: the new firms shall be empanelled during 2014-15. The list of required
documents, terms and conditions and instructions are annexed at Annexure – V.
9. Training: Minimum three days training-cum-workshop regarding awareness on Protected Cultivation,
issues related to Cultivation, Construction and Maintenance of Poly houses is required. A certificate to
this effect shall be issued by HTI, Uchani, Karnal. Training certificate is mandatory before release of
assistance on account of cost of cultivation.
10. Pre-Sanction: The pre-sanction letter may be issued by DHO to facilitate farmer to apply for bank
loan. The validity of pre-sanction letter shall be 90 days from the date of dispatch. Any
correspondence beyond this period shall not be entertained e.g. if sanction letter along with appraisal
report of the bank is not received within validity period, the farmer has to re-apply for pre-sanction.
The work may be executed after issue of Sanction Letter.
11. Sanction: the sanction shall be issued from DHO office as per norms & guidelines and availability of
budget. All the structures sanctioned during current financial year should be completed during same
financial year. The validity of sanction letter shall be one year from the date of dispatch. After one
year the beneficiary has to apply again for re-sanction or extension of validity. However, it is made
clear that during re-sanction or extension the prevailing cost norms and subsidy norms shall be
followed.
12. Work Order: the farmer will issue work order to firm after receiving sanction letter from
Department/HSHDA.
13. Construction of Protected Structures: the work of construction of protected structures shall be
completed within a period of 120 days. Further, an extension of maximum 30 calendar days may be
considered in advance in writing.
14. Inspection: there shall be two inspections.
i. First Inspection: First inspection shall be conducted by Joint Inspection Team (JIT)/ Third Party
Inspection (TPI) from HQ or Third Party Inspection nominated by the Department or HSHDA just
after supply of material and completion of foundation work. This inspection will be conducted after
call from farmer/firm in written to DHO with assurance that the material supplied as per component
list and the foundation work is complete as per departmental specifications and quantity as per
design excluding cladding material. The farmer/firm will keep representative sample of all the
components. The JIT may check any of the used material at site and firm has to facilitate it. In case
of bankable cases Joint Inspection Team (JIT) shall carry out the inspection.
ii. Final Inspection: Final inspection shall be conducted by JIT/JIT or Third Party Inspection
nominated by the Department or HSHDA after intimation to DHO after completion of structure in
all respects. DHO, Firm representative & farmer will remain present at the time of physical
inspection to be carried out.
iii. Additional inspection: Due to the shortcomings in structure during first/final inspection, the
additional inspection if required, the firm shall bear the charges for the same. If additional inspection
is due to farmer, the farmer shall bear the charges for the same accordingly. The rate shall be
charged applicable at that time and is binding to all.
iv. The intimation of first and final inspection shall be conveyed to financing bank.

15. Release of assistance: the assistance shall be released to farmer after completion of structure in all
respects. The release of assistance shall be applicable as given below:
i. Non- bankable projects in case of self-construction:
The assistance shall be released to farmer directly in single instalment after completion of structure in
all respects and submission of certificate of completion and first and final inspection reports subject to
availability of funds. Any amount that may be withheld, due to any shortcoming, shall be released on
removal of shortcomings. The penalty if any shall be deducted accordingly. Farmer shall be fully
responsible for quality and quantity of material used and also for maintenance and repair thereof.
ii. Non- bankable projects in case of construction by empanelled firm:
The assistance shall be released to empanelled firm directly in single instalment after completion of
structure in all respects. DHO will release assistance to Firm in single installment, on receipt of
invoice, farmer share receipt, insurance policy receipt along with First and Final inspection reports
subject to availability of funds and instructions. Any amount that may be withheld, due to any
shortcoming, shall be released on removal of shortcomings. The penalty if any shall be deducted
accordingly.
Government contribution will be released to Firm in case farmer has paid only farmer share.
iii. Bankable projects: A stakeholders‟ meet on protected cultivation was held on dated 05-05-2014 in
NABARD office. While releasing banking plan for 2014-15 for protected cultivation in Haryana, it was
decided that in bankable projects only farmer share shall be financed and subsidy will be front ended
and release of assistance in case of such bank financed project shall be as follows:
Release of assistance from DHO to bank
o First Installment: DHO will release 50% of total eligible subsidy to the bank just after
issue of sanction letter (not after pre-sanction letter) in form of crossed cheques in
subsidy reserve fund/account of financing bank.
o Second Installment: Second installment shall be based on second inspection report and
amount worked out on the basis of completion of structure and penalty if any. This
amount is to be released to the bank after final inspection report.
Release of assistance from bank to beneficiary
o The bank shall release assistance to the construction agency. The assistance shall be
released as one installment on the basis of final inspection report.
o The bank will submit to DHO/DHMIU the utilization certificate of subsidy released.
o The balance lying to the credit of the subsidy reserve funds A/c will not form the part of
the Demand and Time Liabilities for the purpose of SLR/CRR. Suitable instructions in
this regard by the RBI from time to time would be followed.
16. Insurance of Polyhouses: the insurance of Polyhouse is the responsibility of farmer.
17. Assistance on cost of cultivation: the assistance on cost of cultivation shall be released only after
successful completion of Polyhouse and release of assistance. The farmer has to apply to concerned
District Horticulture Officer by intimating the possession of structure and submission of training
certificate.
18. Guarantee/Warranty of material: The firm has to provide guarantee/warrantee certificate of the
material used for construction of protected structure to farmer. This guarantee/warrantee shall remain valid
for a period of three years after supply of material. The guarantee/warrantee includes all the structure

material including cladding material. If material has to be replaced in guarantee/warrantee period, the
same shall be done by the construction agency free of cost.
19. After sales service: After sales service is the responsibility of construction agency. The after sales service
has to be provided for two year from the date of completion of structure. The firm has to provide the sale
service on following items free of cost-
1. Any type of technical defect.
2. Gutter leakage and other type of leakages.
3. Opening and closing/smooth operation of shade net beneath polysheet or rotary handle operation
not proper working.
4. Leakage in MI system.
5. Side vent curtain not proper opening and closing.
6. Curtain clamps left out from curtain folder.
7. Tighten of nut bolts/fasteners.
8. Rusted fasteners/nut-bolts /steel parts.
1. The farmer shall prepare the detailed job sheet from any other empanelled firm of his choice.
In job sheet the second firm has to mention clearly the liabilities of the firm as well as
farmer countersigned by the farmer beneficiary. The liabilities of both farmer and firm shall
be mentioned in budgetary figures (i.e. amount in rupees).

2. On expiry of seven days from the date of intimation to the firm by farmer in written, the
farmer will give a final notice of three days to the firm clearly mentioning the full and final
claims (i.e. amount in rupees).
3. The full and final claims shall be as below:
i. Cost of preparing the job sheet - Rs. 2000/-
ii. Penalty amount - Rs. 20,000/-
iii. Liabilities of firm as per job sheet - Rs. X
Total - Rs. 22,000/- plus X plus taxes applicable
4. If the original construction firm does not responds within three days, the farmer will get the
structure repaired from the second firm and the amount as per claims has to be paid to
farmer by the construction firm through account payee cheque.
22. Arbitration: All disputes and difference arising out of or in any way touching upon or concerning this
construction what so-ever-shall be referred to the sole arbitration of any officer appointed by Director
General Horticulture – cum – Mission Director. The decision of such arbitrator shall be final and binding
on the concerned parties. Director General Horticulture, Haryana will be Appellant Authority in case the
dispute is not settled through Arbitrator.

B. Micro Irrigation
General Guidelines
National Mission on Micro Irrigation has been subsumed into National Mission for
Sustainable Agriculture (NMSA) by Govt. of India. Norms & guidelines of NMSA shall be
applicable from 2014-15. Further, it has been decided that till formation of various committees
under NMSA, committees of NMMI shall remain in existance.
through department offices and for which user ID and passwords are required and are
being provided.
iii. After filling of application online, the farmer name shall be visible to all registered firms
in the state. Any register firm can be contacted or they can contact the farmer vice-
versa.
iv. On finalization of firm by the farmer, the firm will survey the site, prepare estimate and
design, upload the requisite documents online for sanctioning the case by District
Horticulture Officer on recommendation of Horticulture Development Officer.
v. Sanction shall be issued by District Horticulture Officer-cum-Member Secretary,
DHMIU as per the Action Plan of the district and budget provision.
vi. After sanction of case, Tri-Party Agreement shall be executed by farmer, firm and
District Horticulture Officer-cum-Member Secretary, DHMIU.
vii. Upon installation, the concerned firm shall send intimation for inspection online to
DHO and Third Party hired by the Department.
viii. Third Party shall conduct physical verification-cum-trial run of micro irrigation system.
ix. District Horticulture Officer-cum-Member Secretary, DHMIU shall take action on
release of assistance on the basis of physical verification-trial run report given by Third
Party.
x. Detail of payment shall be uploaded on MI-NET by DHO.
xi. Time for action has been prescribed under Tri-Party Agreement and flow chart.
4. Inspection procedure
i. On the installation intimation, the physical inspection-cum-trial run shall be conducted
by Third Party within time period prescribed under TPA.
ii. Third Party shall operate MI-NET for filling up of inspection data and submit hard copy
of same to DHMIU concerned with signature, designation and stamp of inspection team
members.
iii.During inspection, embossing of CML no. & specification of item shall be checked and
recorded.
iv.One officer from department shall accompany the inspection team of Third Party to
ensure proper site and beneficiary.
The Deed of agreement executed on this day of ______ 20__ (Two thousand _____ ) at ___________,
Dist._______ among District Horticulture Mission Implementation Unit (hereinafter called the “DHMIU”)
as Implementing Agency of Micro Irrigation under National Mission for Sustainable Agriculture (NMSA)
having its office at---------------------------, which expression shall be deemed to include its successors and
assigns on the one part, (District Horticulture Officer).

SELECTED SUPPLIER, i.e., Registered firm selected by farmer for installation of MI system (Drip
Irrigation System or Mini/Micro Sprinkler System), to provide and maintain system (during three years),
M/s _______ address:___ (hereinafter called the MIS supplier), which
expression shall be deemed to include its successors and assigns on the Third part, (Represented by
_________________________).
Farmer, therefore, approached DHMIU vide application dated ______ which is received by DHMIU vide
receipt No.________ and farmer requested for installation of Drip Irrigation System / Mini/Micro Sprinkler
System (tick mark on applicable) on _________ hectare/s of land situated in village ___________, Tehsil
___________, Dist. ________, Haryana State.
DHMIU has agreed to organize installation of MIS on farmer‟s field through approved and selected MIS
supplier by farmer on the following terms and conditions, obligations and responsibilities of each party as
under.
1. APPLICATION REGISTRATION
1.1 DHMIU has received above referred application from MIS supplier selected by farmer in Form-1 after
conducting site survey along with design and cost estimates as per requirement of the farmer, soil and
water testing report, original copy of land records, and attested copy of ration card and other prescribed
proof to ascertain the beneficiary family.
2. SANCTION LETTER:
2.1 DHMIU of concerned district received following estimates from MIS supplier duly accepted by farmer
and after verification DHMIU has accorded sanction with following detail:
2.2 DHMIU issued sanction letter vide memo. no. ________ dated _________ with copy to Farmer and
MIS supplier selected by farmer in Form-2.

3.1 This tri-party agreement is signed by the farmer, authorized representative of MIS supplier and
District Horticulture Officer on behalf of DHMIU of concerned district. Farmer has paid amount of
difference between MIS cost and entitled Government subsidy in cash / by bank DD.
3.2 The Tri-Party Agreement shall be effective from the date of signing.
4.1 Farmer agreed to undertake trenching work at his own cost as per trenching plan of approved design
and advice of MIS supplier and hand over the farm site to the MIS supplier for installation of
approved MI System within 7 days from the date of signing of TPA. Farmer also agreed to refill the
trenches only after installation and inspection is over. The cost of this trenching work is to be borne
by the farmer.
4.2 Farmer agreed that in case farmer does not hand over farm site after trenching within 7 Days from the
date of signing tri-party agreement, the work of installation will be delayed and for the same MIS
supplier will not be responsible.
4.3 Farmer shall issue site clearance certificate having signature of authorized signatory of MIS supplier
as taken over of site for installation of structure in Form-3.
5.1 Farmer agreed to construct suitable pucca platform as per guidance given by the MIS Supplier for
creation of platforms for filter, fertigation tank, head control unit and also take up other involved
civil works. The cost of civil work as above is to be borne by the farmer.
5.2 Farmer should provide suitable pumping unit, power and voltage adequate for
running the pump at his own cost.
5.3 MIS supplier shall undertake installation activity and complete installation work in a maximum
period of 30 days of handing over of clear site after completion of trenching work referred under
clause 4.1.
5.4 MIS supplier should intimate DHMIU of concerned district in writing for completion of MI System
and for inspection. The physical-cum-trial run inspection will be conducted within 15 days by
departmental officer/officers from the date of the call from MIS supplier and issue inspection report
in Form-4.
5.5 MIS supplier should ensure that trenches are kept open at defined locations for physical verification
cum trial run.
5.6 Farmer will remain present at the time of physical cum trial run inspection to be carried out.
5.7 After inspection of trial run, farmer will take over MI System from MIS supplier and issue
satisfaction certificate in Form-5.

5.8 The farmer is free to choose any other approved supplier, in case the delay in installation by the
selected MIS supplier is more than a month. Delay may be counted from the date of handing over of
site.
5.9 Farmer agreed to provide safe storage place to MIS supplier for storing various
components/instruments required for installation of MI system subject to watch and ward of
supplier.
6.1 DHMIU will calculate Government contribution (subsidy), farmer share for MI System as per the
provisions under the scheme.
6.2 As per requirement of Government contribution entitlement, farmer is required to maintain MIS
system for 10 years from the date of handing over MIS by MIS supplier. In case MIS is not available
on the farmer‟s field during 10 years from the date of handing over MIS by MIS supplier to the
farmer due to any of reasons, farmer will not be entitled for benefit of subsidies under Govt. scheme.
6.3 This agreement will be considered as part of undertaking for the purpose of subsidy.
7.1 Farmer agreed to settle (pay or receive) the account, after the implementation of MIS on the field and
MIS supplier agreed to collect/pay difference amount.
7.2 The farmer agreed not to change / modify / remove / dispose / resell the system during the 10 years
period. The farmer shall note that DHMIU and/or MIS supplier will not be responsible for any
consequences like Government contribution entitlement variation due to amendments issued by
Government, reduction in yield, crop damages etc. arising out of such change / modification /
removal / disposal / sale / damage of the system by the farmer.
7.3 DHMIU and/or MIS supplier will not be responsible for damages of equipments / instruments due to
any act on the part of the farmer.
7.4 The farmer cannot create any lien / charge or transfer the MI system fully or any portion thereof.
8. PAYMENTS
8.1 DHMIU will release Govt. share to MIS supplier, on receipt of invoice along with inspection report,
satisfaction certificate from farmer confirming receipt of MI System etc within 15 days subject to
availability of funds.
8.2 The Government contribution (subsidy) of the MIS will be made directly by DHMIU to MI supplier
(Registered firm).
8.3 In case farmer intentionally does not accept the system after installation and successful trial
run, DHMIU will have overriding power to release payment to MIS supplier on the basis of
inspection report.

9.1 MIS supplier shall undertake repair or replace any components/instruments of the system within
guarantee period, if they are found to have manufacturing defects or workmanship defects.
9.2 The authorized representatives of MIS supplier shall carry out the repairs or the replacement of
instrument/component within 7 working days of the receipt of the complaints in writing from the
farmer or through DHMIU.
9.3 Farmer will pay cost of fittings/ spares and consumables which are not under guarantee period and
as the maintenance job is over, against the bill of fittings / spares.
10.1 MIS suppliers will hand over after trial run of the MI System, a complete and updated “As Made
Design Map‟‟ to the farmer. The map should include a clear presentation of the head control unit,
water carrier and distribution system including pipelines, location of valves, air release valves,
junctions and other components etc.
10.2 Along with this, irrigation schedule, fertigation schedule, copy of techno economic report of all
crops for which design is made and literature explaining maintenance schedule will be given by
MIS supplier to the farmer.
11.1 The farm productivity does not depend on the use of micro irrigation system alone. It is also
impacted by other factors such as planting materials, application of inputs in terms of quantity and
schedule, incidence of diseases, the soil quality and weather conditions etc. Hence the scope of
responsibility of MIS supplier is limited to the MI system supplied, technical guidance and
interaction with the farmer about the system and its maintenance.
11.2 MIS supplier is not responsible for any consequential damages / liabilities arising out of power
fluctuation pump / water source failure; mishandling, vandalism or any other factors beyond the
control of MIS supplier.
11.3 Farmer should safeguard, operate and maintain the micro irrigation system by maintaining desired
pressure and the farmer should maintain discharge and timely and regular upkeep and chemical
treatment of the system. Farmer should clean filter elements, bulk washing media filters, flushing of
laterals and sub mains etc. at his own cost as per the guidelines provided by MIS supplier and
operate the system regularly to maintain optimum soil moisture level throughout the crop life cycle.
11.4 Farmer should strictly follow the guidelines for system operation & maintenance given by the MIS
supplier for successful performance of the system.
11.5 Farmer should not lodge any false complaint / claim or to create any unpleasant situation and try to
settle differences and disputes if any amicably and as far as possible at local level through
concerned DHMIU and / or In charge/MIS supplier.

11.6 If at any time during the continuance of this contract, the performance in whole or in part by either
party of any obligation under this contract shall be prevented or delayed by reason of any war,
hostility, act of the public enemy, civil commotion, sabotage, fires, floods, explosion, epidemics,
quarantine restriction, strikes, lock-outs or acts of God (herein referred to as event), then provided
written notice of the happening of any such event is given by either party to the other within 60
days from the date of occurrence thereof, neither party shall by reason of such event be entitled to
terminate this contract nor shall either party have any claim for damages against the other in respect
of such non-performance or delay in performance, and deliveries / services under this contract shall
be resumed as soon as practicable after such event has come to end or ceased to exist and the
decision of DHMIU as to whether the deliveries have been submitted or not shall be final and
conclusive.
11.7 Dispute among the DHMIU, farmer and MIS supplier shall be settled through arbitrator appointed
with the consent of parties.
11.8 Director General Horticulture, Haryana will be appellant authority in case the dispute is not settled
through arbitrator.
11.9 Any suit or proceedings to enforce the rights of either party under this Agreement shall be
instituted and tried only in the court of concerned district and by no other Courts, and parties hereto
expressly agree to submit to the exclusive jurisdiction of Courts in concerned district.
11.10 The contents of this Agreement have been explained fully to the Farmer and the farmer has signed
this Agreement after fully understanding the contents of this Agreement.

a) Scheme: The proposal shall be covered under Centrally Sponsored Scheme 2401-
Crop-Husbandry-119-Horticulture and Vegetable crops (SB No. 63) Centrally
Sponsored Scheme for (Sharing Basis 50:50) for horticulture crops insurance in
Haryana for the year 2014-15. An outlay of Rs. 50.00 lacs has been kept as State
share under the scheme.
b) Coverage of Crops: All the major fruits and vegetables shall be covered in all the
districts of the State.
c) Coverage of Farmers: All the farmers including small & marginal, women,
scheduled caste, share croppers and tenant farmers would be covered under the
scheme. The scheme would be voluntary for the non loanee farmers and mandatory
for loanee farmers.
Following are the weather perils, which are deemed to cause “Adverse
Weather Incidence”, leading to crop losses, would be covered under the Scheme:
year 2014-15 is as under. The area proposed is tentative which may increase or
decrease depending upon the crops covered under the districts.
f) Risk Period (Insurance period): Risk period would be from “Sowing Period” to
“Maturity” of the crop. Risk period, depending on the duration of the crop and the
weather parameters chosen, could vary with individual crop and Reference Unit Area,
and would be notified by the SLCCCI before the commencement of risk period.
g) Sum insured/limit of coverage: The sum insured will be extended to the cost of
cultivation of the insured crops. The rate of premium fixed for each insured crop is
reflected in Table – 1 under item which includes service tax for annual
commercial/horticulture crops actuarial rates of premium will be applicable @12%
on sum insured.
h) Premium payable: Out of total premium of the insured crop, 50% will be paid by
the farmer and balance is payable by the State and Govt. of India in the ratio 50:50
basis.
