RESEARCH METHODOLOGY

1.1 Research Aim and Research Objective

This research work is done on the topic of “The Object of Transfer of Property Act 1882”.
The aim of doing this project is to know about the Transfer of Property Act in India, and the
basic object behind doing this research work is to understand and get the knowledge about
the enactment of Transfer of Property Act and the major object of this Act.

1.2 Statement of Problem

Transfer of Property Act was enacted in order to regulate the transmission of property
between living persons into harmony. Although the Act covers a large area of the law of
immovable property, it does not profess to be a complete Code. The transfer to property act
was enacted to avoid conflicting and confusing views of various jurist when the transfer of
property in India was governed by the principles of justice, equity and good conscience, but
whenever the provisions of the Act are not applicable to a case, the courts are entitled to
apply the rules of English law, based on justice, equity and good conscience.

1.3 Research Question


 What are objects behind the enactment of Transfer of Property Act?
 What is the applicability in extend of the Act? Is this Act applicable to all the
states of India?
 Was the Transfer of Property Act successful in regulating the transmission of
property between two living persons?

1.4 Hypothesis
The Transfer of Property Act seeks to complete the law of Contract which means that
Transfer of Property between two living persons is being made after fulfilling all the
essentials of a valid contract.
1.5 Nature of Research Methodology
Methodology implies simply the methods used by the researchers to collect data. Here the
study of the topic “The object of Transfer of Property Act” is based on Analytical or
Doctrinal Research Methodology. Doctrinal research indicates arranging, analysis and
collection of data with reference to books, articles and journals. As it is a theory based topic
the above method was considered appropriate rather than the empirical method of research.

This research work is done on the topic of “All that is relevant may not be admissible but
all that is admissible has to be relevant” The aim of doing this project is to know about the
relevancy and admissibility of evidence, and the basic object behind doing this research work
is to understand and get the knowledge about the relevancy and admissibility and the major
object of this Act.

1.2 Statement of Problem

The main problem regarding this topic is that there might be certain facts that maybe relevant
to the facts in issue but that fact may not be admissible.

1.3 Research Question


 What do you mean by relevant facts?
 What is admisibility?
 What is the difference between admissibility and relevancy?

1.4 Hypothesis
Relevancy is the genus of whish admissibility is a species. Thus, oral statements which are
hearsay may be relevant but not being direct evidence are not admissibilile.

1.5 Nature of Research Methodology


Methodology implies simply the methods used by the researchers to collect data. Here the
study of the topic “all that is admissible may not be relevant but all that is relevant has to be

This research work is done on the topic of “Genesis of precautionary principle and
polluter pays principle ” The aim of doing this project is to know about polluter pays
principle and precautionary principle, and the basic object behind doing this research work is
to understand and get the knowledge about the pollution and the major object of this topic.

1.2 Statement of Problem

The main problem regarding this topic is that polluter pays principle talks about paying fine if
pollution is caused but still pollution exists and it hasn’t stopped yet.

1.3 Research Question


 What do you mean by precautionary principle?
 What is polluter pays principle?
 What are the remedies to stop pollution?

1.4 Hypothesis
Pollution can take the form of chemical substance of energy heat or light, pollutants
substance maybe either foreign substance or naturally occurring contaminants.

study of the topic “polluter pays principle and precautionary principle” is based on Analytical
or Doctrinal Research Methodology. Doctrinal research indicates arranging, analysis and

The aim of doing this project is to know about colourable legislation, and the basic object
behind doing this research work is to understand and get the knowledge about the constitution
and the major object of this topic.

1.2 Statement of Problem

The main problem regarding this topic is that this is also known as doctrine of fraud on the
constitution.

1.3 Research Question


 What do you mean colourable legislation?
 What is the doctrine of colourable legislation?
 Analysis of colourable legislation?

1.4 Hypothesis
It is any other like constitutional law doctrine is a tool devised and applied by the supreme
court of India interpret various constitutional principles.

study of the topic “colourable legislation” is based on Analytical or Doctrinal Research
Methodology. Doctrinal research indicates arranging, analysis and collection of data with

The main problem of this topic is the procedure of investigation that cannot be completed
within 24 hours.

 What do you mean by section 167?
 What is the description of this section 167?

1.4 Hypothesis
Whenever any person is arrested or detained in custody and it appears that the investigation
cannot be completed within 24 hours there are grounds for believing that the accusationor
information is well founded.

study of the topic “section 167” is based on Analytical or Doctrinal Research Methodology.
Doctrinal research indicates arranging, analysis and collection of data with reference to
