Some families
win under new
health care
provisions

CHICAGO — The
nation’s new health care law
adds consumer protections
that kick in today, forcing
insurers to meet new require-
ments. Coverage for children
is guaranteed. Lifetime dol-
insurers can no longer cancel
policies retroactively for friv-
olous reasons when people
get very sick.
The provisions will help
the Cunninghams in Texas
and the Morefields in central
Chicago suburbs. The three
families shared their stories
with The Associated Press.

Dallas family is now covered
through COBRA insurance
from his previous employer,
but that coverage will expire.
Cunningham now does
contract work and would like
to start his own business. But
to do that would mean buy-
ing insurance on the indi-
vidual market, rather than
getting coverage through an
employer. Insurance brokers
have told the Cunninghams
they won’t write a policy that
covers Ryan.
“They could cover the rest
of us, but they couldn’t give
it to us for Ryan,” Michelle
Cunningham said. “We’re
willing to pay a fair premium,
but they weren’t willing to
sell it to us at any price.”
Under the new health care
law, the family will be able
to buy insurance covering
their son. That means Bob
Cunningham can pursue his
small business dream, instead
of plugging away at a discour-
aging search for employment
that provides health benefits.
“If the subject of health
care reform comes up, I try to
tell people about our situation
every time I get a chance,”
said Michelle Cunningham.
“I want them to know that
sick children really were
being denied access to insur-
ance.”

Tanner, Taylor and Tucker
all use wheelchairs. Of the
three, Tucker has the most
fragile health. He maxed out
the $1 million lifetime limit
in his family’s policy three
years ago when he went into
respiratory failure and was
hospitalized for 12 weeks.
That meant the insurance
company would no longer
pay Tucker’s medical bills.
Illinois has picked up the
slack through a program for
children with special health
care needs. But the strapped
program puts strict limits
on certain medical supplies
Tucker uses, causing the fam-
ily to wash and reuse equip-
ment meant for single use.

VAN WERT COUNTY COURT NEWS
The following individuals
appeared Wednesday before
Judge Charles Steele in Van
Wert County Common Pleas
Court:
Gary E. Coats, 28,
Coldwater and formerly of
Ohio City, was sentenced to
a nine-year prison sentence on
three counts of unlawful sexual
conduct with a minor, all three
counts were felonies of the
third degree.
Coats was indicted after
a joint investigation by the
Van Wert County Sheriff’s
Department and Children
Service revealed that on three
separate occasions starting in
December 2009 and ending in
June 2010, Coats was involved
in sexual conduct with a
female under the age of 13, all
incidents took place in Ohio
City. Judge Steele ordered that
he serve three years in prison
on each count and that each
count run consecutive to one
another for a total of nine years
in prison. He was given credit
for 108 days he has served
incarcerated in the Van Wert
County Jail awaiting the final
disposition of this case.
Coats was originally indict-
ed with three additional counts
of sexual battery but these
counts were dropped in a plea
negotiation.
Judge Steele found that
Coats was a Tier 2 sex offender
and ordered that he must report
his place of residence every
180 days for the next 25 years
upon his release from prison.
David R. Strayer, 34,
Delphos, was placed on three
years of community control
and made to spend up 90 days
in the Van Wert County Jail
and then given another 30 day
jail sentence to be served at
the direction of his supervision
officer.
Strayer was charged with
assault, a felony of the fourth
degree, after he assaulted
Officer Tyler Paugh of the
Delphos Police Department

“I feel wonderful,” she
said. “It will be nice to

Nearly 60 percent of
employers offer insurance
plans with a lifetime limit,
according to the Kaiser
Family Foundation. The new
provision applies to both indi-
vidual and group plans.

and apologized along with per-
sonally meeting with Officer
Paugh and apologizing for his
actions.
Judge Steele also gave
Strayer an 18-month prison
term but deferred the imposi-
tion of the prison term pending
the successful completion of
the community control pro-
gram.
Heidi Sill, 21, Van Wert,
was placed on three years
of community control to run
concurrently with her present
sentence on three counts of
forgery, all felonies of the third
degree.
Sill allegedly forged the
name of a former boyfriend to
checks that came in the mail to
her former boyfriend while he
was in prison. She was ordered
to make restitution for approxi-
mately $112 for the checks.
Sill is presently incarcerated
at the WORTH Center on other
charges, the present sentence
will run concurrently with the
sentence for the forgery.
Gerald A. Kohorst, 18,
Delphos, was placed on three
years of community control on
charges of breaking and enter-
ing and possession of stolen
property, both felonies of the
fifth degree.
Kohorst was ordered to
spend 60 days on electronic
monitored house arrest and
another 30 days in jail at a
time to be determined by his
supervision officer.
Judge Steele ordered
Kohorst to make restitution of
$827 to one victim and $38.10
to the other victim. Kohorst
must also pay all costs associ-
ated with his case.
A six-month basic prison
term on each count is to run
concurrent to one another but
the imposition of the prison
sentence was deferred pending
the successful completion of the

tosterone, when he applied
for coverage on the individ-
ual market.
“He did fail to put down
he had been seeing this urol-
ogist,” said Scott’s mother,
Connie Janis. “Sometimes
you can’t remember every-
body you’ve seen. It was
inadvertent.”
The new law prohibits the
practice of insurers search-
ing for small misstatements
and using them as an excuse
to cancel individual policies
for people with high medi-
cal bills. Most states, includ-
ing Illinois, now allow these
types of cancellations, called
rescissions, for reasons other
than fraud.

lence, a felony of the fourth

Sargent avoided a two-day
trial which was to start next
Monday by entering the plea.

Brittney R. Cousino, 22,
entered a guilty plea to theft,
a felony of the fifth degree.
Sentencing date will be set for
a later time.
Cousino had been charged
with the theft of railroad mate-
rial that had a value in excess
of $500.
Amanda Colins, 27, Van
Wert, entered a plea of guilty
to a charge of theft, a misde-
meanor of the first degree, and
was immediately sentenced to
one year of community control
and ordered to pay court costs.
Colins will be on one year of
unsupervised community con-
trol with the Van Wert County
Adult Probation Department.
Faith Sevitz, 30, Delphos,
entered a guilty plea to traf-
ficking in drugs, a felony of the
fourth degree.
Sevitz had been arrested
as the result of an undercov-
er investigation by the West
Central Crime Task Force.
Sevitz allegedly sold cocaine
to an undercover agent on Sept.
9, 2009, in the close vicinity of
a child in Delphos.
Judge Steele ordered a pre-
sentence investigation and
scheduled sentencing for 9
a.m. Oct. 13.
Moses D. Wilder, 27, Van
Wert, entered a guilty plea to
domestic violence, a misde-
meanor of the first degree.
Wilder allegedly caused or
attempted to cause physical
harm to a family or household
member on June 27.
Judge Steele ordered a pre-
sentence investigation and
scheduled sentencing for 9
a.m. Oct. 13.
Psychiatric problems were
the No. 1 reason for rescis-
sions in a study by the National
Association of Insurance
Commissioners, which also
found Illinois has one of the
highest rates of rescission in
the nation. Nationally, there
were about 4 such cancella-
tions per 1,000 policies writ-
ten on the individual market,
NAIC found.
The new federal law
comes too late for Scott and
his parents, who are in their
60s. They’ve been fighting
the insurance company as
they struggle to take care of
their son and find coverage
for him.
Even though the new law
hasn’t directly helped them,
the Janises think it offers
important protections for con-
sumers. And they’ve applied
for coverage of their son for
people with pre-existing con-
ditions, a new program fund-
ed by the federal law.
Blue Cross and Blue Shield
of Illinois issued a statement
saying the company can’t
comment on Scott Janis’ case
because of privacy laws.
“We recognize that rescis-
sions are difficult for every-
one involved,” the statement
said. “We have a long-stand-
ing policy not to rescind cov-
erage for members unless we
learn that they intentionally
omitted material information
or provided false information
at the time of their member-
ship application.”
Illinois Department of
Insurance Director Michael
McRaith said the new protec-
tion in the national law is “a
big step forward,” but the
state Legislature also needs
to strengthen the Illinois law.
McRaith would like to require
insurers to get approval from
the state insurance depart-
ment before they rescind
policies.

Afghan fighting force

WASHINGTON — The
CIA has trained and bank-
rolled a well-paid force of
elite Afghan paramilitaries
for nearly eight years to hunt
al-Qaida and the Taliban for
the CIA, according to current
and former U.S. officials.
Modeled after U.S. special
forces, the Counterterrorist
Pursuit Team was set up in
the months following the U.S.
invasion of Afghanistan in
2002 to penetrate territory
controlled by the Taliban and
al-Qaida and target militants
for interrogations by CIA
officials.
The 3,000-strong Afghan
teams are used for surveil-
lance and long-range recon-
naissance missions and some
have trained at CIA facilities
in the United States. The force
has operated in Kabul and
some of Afghanistan’s most
violence-wracked provinces
including Kandahar, Khost,
Paktia and Paktika, accord-
ing to a security professional
familiar with the program.
The security official and
former intelligence officials
spoke about the Afghan force
on the condition of anonymity
because they were not autho-
rized to discuss the sensitive
information.

war yielded a strategy that
pleased almost no one and
hasn’t turned the tide of a con-
flict near its 10th year.
Just how contentious that
plan has been, inside the
Obama White House as well
as outside, is captured in Bob
Woodward’s new book. The
account exposes the roots
of an Afghanistan exit plan
driven more by politics than
national security and shows
the president worried about
losing the support of the pub-
lic and his party.
“I have two years with
the public on this,” Obama is
quoted as saying at one point,
referring to what the adminis-
tration still considers a finite
well of public patience.
Such private fears have
been aired publicly. Defense
Secretary Robert Gates has
said the United States and its
NATO partners must show
clear progress by the end of
this year or risk a collapse of
public support.

be made public for three days
before a vote.

the Taliban in Afghanistan
and against al-Qaida and allies
over the mountainous border
in Pakistan. The U.S. mili-
tary, including special opera-

with the CIA in an intensified
crackdown against militants
on both sides of the border.
Drone strikes run by the
CIA are at their highest level
yet against Afghan Taliban,
Haqqani and al-Qaida lead-
ers in Pakistan, while U.S.
special operations forces have
been staging combined raids
with Afghan army special
forces against the midlevel
leadership that operates on the
Afghan side.
The Afghan pursuit teams
were described in detail in
Bob Woodward’s new book,
“Obama’s Wars,” due out
Monday.
Woodward reported that
the units conducted covert
operations inside neighbor-
ing Pakistan’s lawless border
areas as part of a campaign
against al-Qaida and Taliban
havens.
Pakistan allows U.S. spe-
cial operations forces to enter
the border region only for
limited training missions. The
use of Afghan paramilitaries
to carry out spying activities
will likely inflame already
frayed political relations
between Afghanistan and
Pakistan.

first reported by The New
York Times, which obtained
a copy before its release

Post also reported extensively
on the book by its longtime
reporter and editor. It shot to
No. 2 on the Amazon best-
seller list Wednesday.

occasionally combine forces
for an operation. Despite
operating independently, the
units coordinate their opera-
tions with NATO, the security
professional said.
The Afghan force became
the focus of a debate last year
between CIA and military
officials over who would con-
trol its operations. The CIA
remained the lead agency, the
former official said.
The paramilitaries earn
generous salaries compared
to Afghans employed by the
army or police.
The CIA-run Afghan para-
military in Kandahar were
compensated on an elite pay
scale, according to human
rights investigators. The aver-
age paramilitary in the force
could earn $340 a month
while a regiment head could
take home as much as $1,000.
In Uruzgan, the U.S. pays
members $300 to $320 per
month.

making a political argument,”
Gibbs said. “The president
was making an argument in
our national interest.”

agenda was drafted to answer
the public’s skepticism about
government and give them a
“deliverable.”
“A number of people are

their magic number for clinching

to four. It was the Phillies’ first
home sweep over the Braves
since 2001.
Oswalt allowed the hit — a
clean double by Martin Prado in
the fourth — and walked one in
seven innings.
Atlanta began the day with a
one-game lead over San Diego in
the wild-card race.
Ryan Madson (6-2) pitched a
perfect eighth for the win. Brad
Lidge finished for his 26th save.

INDIANAPOLIS — Several health insurers
say they will stop selling new child-only indi-
vidual insurance policies as they face a health
care reform provision that will prevent them
from excluding children with potentially costly
pre-existing conditions.
An insurance industry representative said
the decision affects a relatively small popula-
tion and is being made to keep costs down for
all policyholders. But a Georgetown University
researcher said some middle-class children
could be left vulnerable by the ensuing lack of
coverage options.
Several provisions of the health care over-
haul went into effect today, six months after it
was signed into law.
One of those could help parents who have
struggled to find coverage for children with
expensive medical conditions. Under the pro-
vision, insurers will not be able to exclude
children from coverage because of a pre-
existing health condition. This means they will
no longer be able to deny coverage or agree to
cover the child except for services related to
certain conditions.
However WellPoint Inc., UnitedHealth
Group Inc., Aetna Inc., Cigna Corp. and
Humana Inc. — the five largest publicly traded
health insurers based on enrollment — all have
said recently they will stop selling child-only
individual policies, although those children can
still get coverage through a family plan in the
individual market.
Individual insurance is coverage that is not
offered through an employer and includes both
single and family coverage.
Parents who buy single plans for their chil-
dren under age 18 paid an average of $1,350
in annual premiums last year, according to a
survey by the industry trade group America’s
Health Insurance Plans. But that cost can vary
depending on where the children live and how
healthy they are.
Aetna said in a statement it made the deci-
sion to stop selling to new members “to protect
our current members from significant price
increases,” but it will continue to administer the
policies it already has.
Cost is a big concern, according to Robert
Zirkelbach, a spokesman for the industry trade
group America’s Health Insurance Plans.
The provision in the new law tries to allay
that by allowing insurers to sign up children
only during a fixed annual enrollment period.
That is designed to discourage parents from
waiting until their child gets sick before they
buy coverage.
But Zirkelbach noted there’s no set time of
the year for all insurers to hold open enroll-
ment like there is for Medicare Advantage
plans. That means parents can still wait until
their child becomes ill and then shop around
for an insurer that happens to be holding open
enrollment. Those customers then will generate
more in medical claims than they contribute in
premiums, and that could ultimate raise the cost
of insurance for everyone else.
“The goal here is to make coverage as afford-
able as possible for all policyholders,” he said.
Zirkelbach called the child-only portion of
individual insurance business a niche market.
AHIP estimates that child-only single coverage
makes up about 6 percent of all policies in the
individual insurance market. Estimates for how
many children currently have this coverage
vary.
About 16.7 million people have individual
insurance coverage in the United States, accord-
ing to the Employee Benefit Research Institute.
The decision by insurers to stop selling new
child-only policies could hurt children from
middle-class families that don’t have employer-
based coverage but have incomes too high to
qualify for public assistance like Medicaid, said
Jocelyn Guyer, a senior researcher with the
Georgetown University Center for Children and
Families.
“I think the number of children affected is
very small, but the issue is some of them are
particularly vulnerable,” she said.
By 2014, insurers will be required to
cover everyone, under the new law, and most
Americans will have to buy insurance.

Evangelical bishop accused of Prosecutors say city corruption ran deep

coercing three men into sex

ATLANTA — Bishop Eddie Long built one of the nation’s
best-known black megachurches by being an outspoken reli-
gious leader who campaigned against same-sex marriage. Now
he’s preparing to break the silence about accusations that he
used jewelry, cars and cash to lure three young men into sexual
relationships.
Long, a married father of four, has planned a news confer-
ence to speak about the lawsuits filed this week by the three
New Birth Missionary Baptist Church members who say that
they were coerced into sexual liaisons by the prominent evan-
gelical pastor.
The lawsuits say the young men were 17 or 18 years old at
the time, enrolled in New Birth’s ministry for teen boys.
A lawyer for Long, who writes books on heterosexual rela-
tionships and has strong ties to the Rev. Martin Luther King
Jr.’s family, adamantly denied the allegations.
B.J. Bernstein, an attorney representing the plaintiffs, said
she opened her investigation after getting a call from one
of the men. The Associated Press normally does not name
people who claim they are victims of sexual impropriety, but
Bernstein said all three — Maurice Robinson, 20, and Anthony
Flagg, 21, and Jamal Parris, 23 — have consented to making
their identities public.
Bernstein said she didn’t trust local authorities to investi-
gate the claims.
“This is a really large church that’s incredibly politically
powerful,” Bernstein said. “There are pictures of this guy with
every politician around. With something this important, how
can I trust that word didn’t get back to the bishop?”
President George W. Bush and three former presidents
visited the sprawling New Birth Missionary Baptist Church in
the Atlanta suburb of Lithonia for the 2006 funeral of Coretta
Scott King, the widow of the Rev. Martin Luther King Jr.
Long introduced the speakers and the Rev. Bernice King, the
Kings’ younger daughter, delivered the eulogy. She is also a
pastor there.
DeKalb County Sheriff Thomas Brown has been a member
of New Birth for more than 15 years and sits on the advisory
board for Long’s Longfellows Youth Academy. He said he
would stand by the bishop and bristled at the suggestion that
local authorities couldn’t be trusted.
Today, New Birth sits on 250 acres and has more than
25,000 members, a $50 million, 10,000-seat cathedral and
more than 40 ministries.
Not all of his attention, though, has been positive. The
church was among those named in 2007 in a Senate commit-
tee’s investigation into a half-dozen Christian ministries over
their financing.
Friend: Bomb suspect wants fame

CHICAGO — A 22-year-old Lebanese immigrant accused of
placing a backpack he thought contained a bomb near Chicago’s
Wrigley Field is no terrorist, just someone seeking quick fortune and
fame in America, his attorney and a friend said Wednesday.
But a federal judge denied bail for Sami Samir Hassoun, deter-
mining he is dangerous and a flight risk.
“It’s hard to imagine a more serious crime ... Although it was
thwarted, it had the potential to kill many people,” U.S. District
Judge Susan Cox said Wednesday afternoon at Hassoun’s detention
hearing.
Prosecutors allege Hassoun took a fake bomb given to him by
undercover FBI agents and dropped it Sunday in a trash bin near the
historic home of the Chicago Cubs baseball team. While harmless,
the device appeared ominous — a paint can fitted with blasting caps
and a timer.
Earlier Wednesday, restaurant owner Joseph Abraham told The
Associated Press that Hassoun is well educated but also prone to big
boasts, lies and bluffs. Those may have led his friend of more than a
year to plant the bogus bomb, Abraham said.
“Half of the stuff he told you you couldn’t believe — lies to show
people he was a big shot,” said Abraham, 49. “I think what got him
into trouble was he was bluffing, and he got caught in a bluff.”
Outside the courtroom, attorney Myron Auerbach also described
his client as prone to embellish. He said Hassoun had difficulty back-
ing away from dangerous situations but insisted, “My client is not a
terrorist.”
Auerbach said Hassoun was born in Beirut but spent much of his
childhood in the west African nation of Ivory Coast, where his father
had a business. The family was forced to flee for their lives as fighting
broke out among various factions, he said.
“He saw death, mayhem and destruction as a small child,” said
Auerbach, who contends the trauma may have affected Hassoun’s
development.
The judge set Hassoun’s next court date for Sept. 30. Auerbach is
seeking a psychological evaluation for Hassoun, although he told the
judge he believes his client is competent to stand trial.
Hassoun wore an orange jumpsuit over his slight frame at
Wednesday’s hearing, hunching his shoulders as he stood next to his
attorney.
When a marshal removed his handcuffs, Hassoun nodded at rela-
tives seated in the courtroom. One responded by appearing to blow a
kiss at the defendant.
Hassoun was charged Monday with attempted use of a weapon of
mass destruction and of an explosive device. If convicted of the first
charge, he could face life in prison.
An informant tipped off authorities about Hassoun and befriended
him for more than a year. At least two FBI undercover agents then
got in touch, posing as co-plotters.
The complaint also says Hassoun waffled about his plans and
motivations, talking about profiting monetarily. He also discussed
wanting to spark revolution in Chicago, and he spoke of poisoning
Lake Michigan or assassinating Mayor Richard M. Daley.
Prosecutors told the judge Wednesday that Hassoun was deadly
serious about the plot.
LOS ANGELES (AP) — Eight current and former offi-
cials of the city of Bell appeared in shackles before judges
Wednesday in a corruption case prosecutors said was so
ingrained in the blue-collar suburb that almost anyone who
could have blown the whistle was benefiting from it.
Former city manager Robert Rizzo was accused of being at
the center of the scandal that went unchecked for years while
he allegedly lent city money to himself, his assistant, city
council members, members of the police force and an array
of city workers that included a recreation attendant who bor-
rowed $1,500.
Rizzo also was singled out in a state controller’s audit
that said city officials mismanaged more than $50 million in
bond money, levied illegal taxes and paid exorbitant salaries
to leaders.
Rizzo was being paid nearly $800,000 a year when he
resigned earlier this year and had total control of city funds,
the audit stated.
The findings were “shocking and detail actions that are
reprehensible beyond words,” said Bell interim city manager
Pedro Carrillo, who requested the state audit in July.
He called the audit an invaluable tool to correct the prob-
lems and to establish reforms to prevent more abuse in the city
where one in six residents live in poverty.
All eight defendants made their first court appearances
on Wednesday but gained little in their appeals to have high
bail amounts slashed. Rizzo’s bail was reduced to $2 million,
down from the $3.2 million prosecutors had requested, but far
more than the $100,000 his attorney had sought.
Unusual worry: Inflation too low? Lake swallows land and buildings

WASHINGTON — It might seem like prices are rising wher-
ever you look, from medical care to college tuition. Yet to the
Federal Reserve, they might not be going up fast enough.
The Fed says a little more inflation might be just the thing to
start a chain reaction that would ultimately create jobs — and
avoid a spiral of falling prices that could damage the economy.
In a statement Tuesday, the Fed avoided directly mentioning
the dreaded word “deflation.” But it signaled its concern that
today’s very low inflation might lead to actual price drops.
The Fed, meeting for the last time before the midterm elec-
tions, said its measures show inflation is “somewhat below” desir-
able levels for the economy. That may sound strange, because
inflation is often made out to be an economic evil.
And it can be, when it gets out of control. But its opposite can
be even worse.
Once deflation takes hold, it can wreck an economy. Workers
suffer pay cuts. Corporate profits shrivel. Stock values fall.
People, businesses and the government find it costlier to pare debt.
Foreclosures and bankruptcies rise.
And people spend less, convinced that prices will fall even fur-
ther if they just wait. That trend has already emerged in the hous-
ing market. Many would-be buyers are standing on the sidelines,
waiting for home prices to fall further.
Spending by shoppers accounts for about 70 percent of eco-
nomic activity in the United States. A further drop in their spend-
ing could potentially throw the economy back into recession.
It’s true that the costs of items like health care, education and
transportation have surged. But the Fed studies a wide range of
prices across the economy. Overall consumer prices — excluding
food and energy prices, which are volatile — inched up just 0.9
percent for the 12 months that ended in August. That matched a
44-year low, according to the government.
And it’s well below the Fed’s comfort zone for inflation, which
ranges between 1.5 percent and 2 percent over a year. The Fed
would like to see inflation at least that high because it would show
the economy is making a solid recovery. It would mean shoppers
are confident enough to spend and businesses confident enough in
customer demand to raise prices. Confident employers are more
likely to create jobs.
Blockbuster files for bankruptcy
NEW YORK (AP) — Troubled video-rental chain
Blockbuster Inc. filed for Chapter 11 bankruptcy protection,
and said it plans to keep stores and kiosks open as it reorga-
nizes.
The move, long expected and pre-arranged with bondhold-
ers, effectively ends an era that Blockbuster dominated — of
Americans visiting video-store chains for the latest movie-
rental releases. Increasingly, Americans are watching movies
via video subscription services like Netflix Inc., video on
demand and vending machine services such as Redbox.
In a submission to the U.S. Bankruptcy Court in the Southern
District of New York today, the company said it reached an
agreement with bondholders on a recapitalization plan.
Blockbuster plans to reduce debt from nearly $1 billion to
about $100 million or less by swapping debt for equity in a
reorganized Blockbuster with bondholders that hold about 80.1
percent of the company’s senior notes.
It has received commitments for $125 million in “debtor-
in-possession” financing from senior noteholders to repay cus-
tomers, suppliers and employees during the reorganization.
“After a careful and thorough analysis, we determined that
the process announced today provides the optimal path for
recapitalizing our balance sheet and positioning Blockbuster
for the future as we continue to transform our business model
to meet the evolving preferences of our customers,” said CEO
Jim Keyes.
Blockbuster, founded in 1985 by a Dallas software entre-
preneur, was once a home entertainment powerhouse. It helped
popularize videotape recorders and took off in 1987 after Waste
Management Inc. founder Wayne Huizenga took control and
began aggressively expanding and buying up competitors.
But Blockbuster has been losing money and market share
for years. As Netflix and other services gained popularity,
Blockbuster tried to keep up. It ended late fees and started
online and kiosk services of its own. But it was unable to keep
its debt in check.
Deputy District Attorney Jennifer Lentz Snyder, who
argued for keeping the bail amounts high, said all eight offi-
cials face lengthy prison terms if convicted of all charges.
Rizzo faces the longest sentence, 58 years, and former assis-
tant city manager Angela Spaccia the shortest, 10 years.
The loans and other allegations came to light after the Los
Angeles Times revealed in July that Rizzo and other city offi-
cials were making huge salaries. The resulting scandal trig-
gered nationwide outrage, turning the suburb of 40,000 people
into a poster child for government abuse.
Also charged in the corruption probe were Mayor Oscar
Hernandez; Vice Mayor Teresa Jacobo; council members
George Mirabal and Luis Artiga and former council members
Victor Bello and George Cole.
All eight, wearing jail jumpsuits and shackled at the waist,
appeared before Superior Court Judge Hilleri G. Merritt,
who continued their arraignments until Oct. 21 at the request
of their attorneys. The group appeared somber except for
Spaccia, who occasionally smiled as she looked out at a
packed courtroom where her adult son was sitting.
Artiga, Jacobo and Cole were given permission to post bail
immediately after prosecutors agreed with defense attorneys
that the assets they planned to use had not been looted from
the city.
All three were released from jail Wednesday night after
posting bond that ranged from $120,000 to $260,000.
Four others then went to Pastor’s courtroom to argue for
reduced bail. The judge reduced the amounts slightly for three
of them. Mirabal did not challenge his bail amount.

DEVILS LAKE, N.D. — It’s been called a slow-growing
monster: a huge lake that has steadily expanded over the last 20
years, swallowing up thousands of acres, hundreds of buildings
and at least two towns in its rising waters.
Devils Lake keeps getting larger because it has no natural
river or stream to carry away excess rain and snowmelt. Now
it has climbed within 6 feet of overflowing, raising fears that
some downstream communities could be washed away if the
water level isn’t reduced.
And those worries are compounded by another problem:
Scientists believe the pattern of heavy rain and snow that filled
the basin is likely to continue for at least another decade.
“It’s a slow-moving torture,” said 72-year-old Joe Belford,
a lifelong resident of Devils Lake and a county commissioner
who spends most of his time seeking a way to control the
flooding and money to pay for it.
No other place in America has faced such a dilemma. The
nation’s only other significant “closed-basin” lake is the Great
Salt Lake, which was in danger of flooding housing develop-
ments in the mid-1980s. But shortly after the state spent $70
million on huge pumps, a dry spell began. Those pumps now
stand idle.
Since the water began rising in the early 1990s, more than
400 homes around the lake have been relocated or destroyed.
The lake, about 160 miles northwest of Fargo, is the largest
freshwater body in North Dakota, with an estimated shoreline
of at least 1,000 miles. It’s up to 75 feet deep and has attracted
tourists from across the nation with excellent fishing and other
recreational activities.
But local people and politicians are fretting that the lake is a
catastrophic flood waiting to be released in their direction.
In the tiny town of Minnewaukan, the lake was once 8 miles
away. Today it is lapping at the community from three sides,
and residents are begging for help.
On Monday, the lake stood at just over 1,451 feet above
sea level. If it climbs above 1,458 feet, its water will spill into
the Sheyenne River, which flows through southeastern North
Dakota before it joins the north-flowing Red River and heads
into Canada.
Among the threatened communities along the Sheyenne is
Valley City, west of Fargo. The mayor there said a spillover
could raise the river more than 5 feet above a record 2009
flood, which forced most of the town’s 6,300 residents to
evacuate. That might flood up to half the city.
Devils Lake has nearly quadrupled in size since the early
1990s, flooding nearly 150,000 acres of land, inundating a
million trees and destroying hundreds of homes and farm
buildings. Many of those who lost property to the water
were eventually bought out by the state or federal govern-
ments. The buyouts included the two tiny towns of Penn
and Churchs Ferry, although some people remain in both
communities.
