CITY ORDINANCE NO. 2016-002


AN ORDINANCE AMENDING SECTION 6, SECTION 7 AND
SECTION 8 OF CITY ORDINANCE NO. 2013-032, “AN
ORDINANCE ESTABLISHING CABADBARAN CITY POUND AND
FOR OTHER PURPOSES THEREOF”

WHEREAS, for the purpose of improving the City Pound Operation,


prioritizing human welfare but still considering the welfare of the animals, the
Sangguniang Panlungsod of Cabadbaran City hereby enact this amendment.

BE IT ORDAINED, by the 3rd Sangguniang Panlungsod, in its 120th


Regular Session assembled, t h a t:

SECTION 1. Section 6 of City Ordinance No. 2013-032 which reads:

Section 6. REDEMPTION

1. At any time before the sale of any impounded animal, the


owner thereof may redeem the same by paying to the City
Treasurer’s Office the authorized fees for impounding as
follows:

Shall be amended as:

1. At any time before the release/adoption of impounded dogs and


cats, the owner/or adopter thereof may redeem the same by
paying to the City Treasurer’s Office the authorized fees for
impounding as follows:

SECTION 2. Section 7 of City Ordinance No. 2013-032 which reads:

Section 7. DISPOSAL OF IMPOUNDED ANIMALS

1. Impounded animals shall be disposed after seven (7) days of


their capture, confiscation or impoundment. Food animals
(cattle, carabao, horse, etc) shall be sold at public auction
after seventh day of their confiscation.
2. If there are no buyers in an auction, the animals may be
humanely killed and disposed off according to sanitation
procedures.
3. The City Veterinarian shall condemn diseased animal after
proper examination.
4. Healthy dogs and cats, which have been duly vaccinated
with anti-rabies vaccines, shall be sold at legitimate pet
stores/pet lovers.

Shall be amended as:

Section 7. RELEASE OF IMPOUNDED ANIMALS

1. Impounded animals shall be released to the owner within three


(3) days of their confiscation or impoundment except for the
domestic animals for meat (cow, carabao, pig, sheep, goat and
poultry), working animals (cow, carabao) and sports animal
(horse) which shall be released only when redeemed by the
owner right upon payment of the necessary fees and incidental
charges.

2. Laboratory/experimental animals (rabbit, guinea pig, hamster,


white mice) and wildlife animals shall be released in accordance
with the Animal Welfare Act (RA 8485).

3. All impounded animals are subject to clinical judgment of a


licensed veterinarian. The City Veterinarian shall condemn
diseased animal after proper examination.

4. Unclaimed apparently healthy dogs and cats can be disposed


through adoption to qualified persons or pet lovers securing first
Barangay Clearance and duly filled-up adoption papers/ pet
adoption contract available in the City Pound Office. The dog
shall be vaccinated first and observed for 14 days before
adoption. All forms of aesthetic surgery are prohibited by the
City Veterinarians.

SECTION 3. Section 8 of City Ordinance No. 2013-032 which reads:

Section 8. PURCHASE OF IMPOUNDED ANIMALS BY


EMPLOYEE IS PROHIBITED

No officer or other person in-charge of the City Pound or


employed in or about the care of, or sale of animals impounded
therein, shall purchase or be directly or indirectly involved
in the purchase of animal taken up, impounded or sold
under the provisions of this Ordinance.

Shall be amended as:

Section 8. ADOPTION OF IMPOUNDED DOGS AND CATS


BY EMPLOYEE IS ALLOWED

Any officer or other employees in-charge of the City Pound can


adopt dogs and/or cats. Provided that these officers or
employees shall be as the last priority, following the same
procedures, guidelines and requirements provided under this
Ordinance.

SECTION 4. SEPARABILITY CLAUSE - Provisions of City Ordinance


No. 2013-032 not affected by the amendments herein shall remain in full force and
effect.

SECTION 5. EFFECTIVITY - This Ordinance shall take effect upon


approval.
