Probable Cause Statement ON 3/22/18 THE 14 YEAR OLD VICTIM DISCLOSED TO A SCHOOL COUNSELOR THAT HER 10 YEAR OLD BROTHER WAS HIT WITH A BELT AND HAD MARKS IN HIS BACK. THE 10 YEAR OLD VICTIM WAS THEN OBSERVED WITH RED MARKS ON HIS BACK AND BURN MARKS ON HIS FOOT. DCS INTERVIEWED THE 14, 10 AND 12 YEAR OLD VICTIMS THEN REMOVED THEM FROM THE HOME. THE TWO 16 YEAR OLD VICTIMS AND ANOTHER 14 YEAR OLD VICTIM WERE NOT RE- MOVED AT THIS TIME.DURING A FORENSIC INTERVIEW ON 5/10/18 THEY DISCLOSED THE FOLLOWING14 YEAR OLD FEMALE VICTIM DISCLOSED THAT THE WEEK BEFORE THEY WERE RE- MOVED FROM THE HOME, HER ALONG WITH HER 10 AND 12 YEAR OLD BROTHERS WERE HIT WITH A BELT ON THE PALMS OF THEIR HANDS. DURING THIS INCIDENT THE 10 YEAR OLD WAS HIT ON THE BACK WITH THE BELT BECAUSE HE MOVED HIS HANDS AWAY. SHE ALSO DE- SCRIBED THE FOLLOWING INCIDENTS WHICH OCCURRED BETWEEN 5TH GRADE AND NOW. SHE SAID RAFAEL HIT HER WITH A RED PAN IN THE HEAD. SHE DESCRIBED THAT SHE COULD NOT BREATH. SHE SAID THEY ARE FORCED TO STAND IN LINE AND RAFAEL HITS THEM WITH A. BELT.RAFAEL HIT HER HARD IN THE FACE AND DESCRIBED HER JAW HURTING.SHE DISCLOED THAT HER AND HER SIBLINGS WOULD HAVE TO WALK IN A CIRCLE AND HE WOULD HIT THEM WITH THE WIRE WHEN THEY WOULD STOP.RAFAEL BURNED HER ALONG WITH ALL THE SIBLINGS WITH A LIGHTER ON THEIR HANDS IF THEY WANTED A MUFFIN. SHE DESCRIBED THAT THEY ALL HAD BLISTERS ON THEIR HANDS.SHE SAID RAFAEL BURNED HER 10 YEAR OLD BROTHERS FOOT WITH A LIGHTER. SAID IT LOOKED NASTY AND DESCRIBED IT AS BEING GREEN.DISCLOSED THAT RAFAEL USED TWEEZERS ON HER 10 AND 12 YEAR OLD BROTHERS MME AND TWISTED THEM. RAFAEL WOULD USE HIS HANDS TO TWIST HER SWUM FOR PUN- ISHMENT.DISCLOSED A TIME THAT RAFAEL HELD HER 10 YEAR OLD BROTHERS HEAD UNDER. COLD WATER IN SHOWER AND HE COULD NOT BREATH.DISCLOSED THAT RAFAEL HELD A BAG OVER HER 10 YEAR OLD BROTHERS HEAD UNTIL HE PASSED OUT.THE 10 YEAR OLD MALE VIC- TIM DISCLOSED THE FOLLOWING.SAID RAFAEL HIT HIM ON THE BACK WITH THE BELT THEN KICKED HIM IN HIS BACK AND STOMACH. DISCLOSED THAT HE HAD BRUISES ON HIS BACK.DISCLOSED THAT DURING THIS SAME INCIDENT HIS 14 YEAR OLD SISTER GOT HIT ON HER HANDS AND WRISTS.DISCLOSED THAT HIS 12 YEAR OLD BROTHER, 16 YEAR OLD SISTER AND 16 YEAR OLD BROTHER ALSO GOT HIT WITH THE BELTSAID WHEN HE WAS IN 3RD GRADE, RAFAEL PUT A BAG OVER HIS HEAD AND HE FAINTED. WHEN HE WOKE UP HE SAW RAFAEL PUTTING TOOTHPICKS UNDER HIS 12 YEAR OLD BROTHERS NAILS.RAFAEL PUT STAPPLE IN HIS HAND FOR FALLING ASLEEP .DISCLOSED THAT WHEN HE WAS IN 2ND GRADE RAFAEL PUT A LIGHTER ON HIS FOOT AND IT LEFT A MARK. DISCLOSED THAT RAFAEL PUT HIM UNDER COLD WATER IN THE SHOWER FOR PEEING HIS PANTS. RAFAEL USED TWEEZERS TO TWIST HIS MBBMBBEDESCRIBED A TIME THAT HIS HEAD WAS PUSHED INTO THE BED SO HE COULD NOT BREATH AND HE WAS HIT WITH THE BACK SCRATCHER.THE 12 YEAR OLD VICTIM DISCLOSED THE FOLLOWING.DISCLOSED BEING HIT WITH THE BELTDISCLOSED BEING HIT WITH A HANGERSAID RAFAEL PUT TOOTHPICKS UNDER THIS NAILS AS A FORM OF PUNISH- MENT.DISCLOSED HOLDING A BASKETBALL UP AND WHEN HE DROPS IT HE IS HIT WITH AN OBJECT.IN 4TH GRADE HE WAS HIT WITH A HEATED UP SPACHULA.DISCLOSED THAT HIM AND HIS 10 YEAR OLD BROTHER WERE BOTH BURNED ON THEIR FEET AND HANDS. DESCRIBED HAV- ING BUBBLES ON HIS FOOT.IN 6TH GRADE RAFAEL USED TWEEZERS ON HIS SiN AND TWIST. DISCLOSED THAT RAFAEL PUT A PLASTIC BAG OVER HIS 10 YEAR OLD BROTHERS HEAD AND HE FAINTED.CHRONIC ABUSE THAT HAS BEEN OCCURRING FOR THE PAST 4 YEARS. ALL THREE VICTIMS DESCRIBED BEING HIT BY THE BELT, A BACK SCRATCHER, A HANGER AND A WIRE ON SEVERAL OCCASIONS. THEY DISCLOSED THAT RAFAEL BURT THEM ON THEIR FEET AND ON THEIR HANDS WITH A LIGHTER, STUCK TOOTHPICKS UNDER THEIR FINGER- NAILS, AND TWISTING THEIR MMMM WITH TWEEZERS. THE 10 YEAR OLD VICTIM DISCLOSED THAT RAFAEL PUT A PLASTIC BAG OVER HIS HEAD AND HE PASSED OUT. THE 12 AND 14 YEAR OLD VICTIM ALSO DISCLOSED BEING A WITNESS TO THIS INCIDENT. THE 10 YEAR OLD DISCLOSED BEING PUT UNDER WATER IN THE SHOWER FOR PEEING HIS PANTS. THE 14 YEAR OLD DISCLOSED THAT SHE WAS ALSO A WITNESS TO THIS EVENT. ALL THREE VICTIMS SAID THEY WERE TOLD NOT TO TELL AND WERE SCARED. THERE ARE PHOTOGRAPHS OF A SCAR ON THE 10 YEAR OLDS RIGHT FOOT WHICH WAS FROM THE BURN. THERE ARE ALSO PHOTOGRAPHS OF THE RED MARKS ON HIS BACK WHICH WERE SAID TO BE FROM THE BELT. THE TWO 16 YEAR OLDS AND THE 14 YEAR OLD ARE STILL IN THE HOME AND WERE NOT ABLE TO BE CON- TACTED TO BE INTERVIEWED AT THIS TIME. ON 5/31/18 AT 1109 HOURS, RAFAEL WAS AR~ RESTED AND TRANSPORTED TO 620 W WASHINGTON ST.
