At approximately 9am I took my Black Ford Taurus to Metro Express
Car Wash. I had sold the car and the new owner was arriving from
Wisconsin at 5:30 that day to pick the car up and drive home.
I entered the car wash and was about ½ way through when I felt my
right front wheel run over something. There was soap all over the
windows so I couldn’t see outside the car.
The car wash stopped and a woman appeared at my window and said
I had gone out of the track. She asked me to put it in gear and drive
forward.
She then told me everything was OK and to put the car back in neutral
and role the window up.
The car wash started back up and when it reached the middle of the
dryer blowers, the car wash stopped again.
This time, a gentleman came to the passenger window [Defendant
Tyler Woosley] and said that the rear bumper had fallen off. He
grabbed the rear bumper and walked outside the car with it still
partially attached until we were clear of the tunnel.
At that point he said he was going to go get a screwdriver to remove
the remaining screws. He also indicated that Defendant Fery
was not there to inspect the damage.
10:00am
I pulled around the back side of the building and Defendant
has me fill out a small report and Id.
Then Defendant Woosley walked around the front of the car and
realized the front bumper had also been torn off the car. He went to
find it and indicated an employee had found it laying in the wash
tunnel.
He then indicated that it would take he and Defendant
two hours to review the tapes, take pictures and further examine the
bumpers.
I took the two hours to get an estimate to repair the damage. The
total was $2,600 for parts and labor.
Defendant Woosley called me around noon and indicated that there
was pre…………………….. damage and they were not going to cover it.
He indicated that he had a video that showed conclusively that there
was damage when it went through the car wash on 5/22/18.
I told him I would be over with a pickup truck to get the two damaged
bumpers and review the alleged video.
Defendant Woosley never mentioned they had insurance and he
indicated he and Defendant Frey would make the final determination
whether to cover the damage or not.
Defendant Woosley signed a statement that they were not going to
cover the damage
