DWIGHT ANTHONY YU, CHRISTIAN DALE QUIDILLA, AND VJISYL GUADALQUIVER,

PETITIONERS
VS.
COURT OF APPEALS, EDLIN LAMBO, AMIRA SOLAIMAN, AND EDERIC APAO,
RESPONDENTS
GR NO. 712017 JULY 1, 2017

Facts:

Petitioners Dwight Anthony Yu, Christian Dale Quidilla, and Vjisyl Guadalquiver, are

the President, Human Resource Manager, and Secretary respectively of XYZ Company. They

employed private respondents Edlin Lambo, Amira Solaiman, and Ederic Apao, as factory

workers on May 25, 2017.

In their contract, it was stipulated that private respondents would be paid according

to the minimum wage in their region, which is Region IX.

Petitioners made respondents sign a voucher wherein it stipulates that the latter’s

daily wage will only be P200 pesos. Private respondents allegedly received merely such

amount as evidenced by the voucher, contrary (to law).

[Petitioners contend that there was merely a clerical error in the printing of the

vouchers as it is supposed to reflect the minimum wage, and that respondents indeed were

paid the minimum wages.]

The Labor Arbiter Kim Khaled Aguisanda found petitioners guilty of violating the

(law) and were ordered to pay the correct wages to respondents. The National Labor

Relations Commission reversed the Labor Arbiter’s decision. The Court of Appeals affirmed

the ruling of Labor Arbiter, setting aside the decision of the NLRC, with additional interest

rate of 1% per month beginning from May 25, 2017 up to the present, and attorney’s fees

worth 5000php to petitioners.
