FACTS:

Due to the various crimes committed by the New People’s Army, the Government
thru the National and Capital Region District Command conducted a security
operations or checkpoint, not only to suppress the said incident, but also to to
maintain peace and order.

ISSUE/S:

Whether or not the government violates the right of its citizen against
unreasonable search and seizures?

HELD:

The Supreme Court held that Military and Police Checkpoints do not violate the
right of the people against unreasonable search and seazures.

It is the Inherent right of the State to protect its existence and also the citizens
right against a warrantless search, however, as the dissenting opinion of Justice
Cruz stated that the protection of the security of the State is a convenient pretext
of the police state to suppress individual rights.
