JUDICIAL AFFIDAVIT

I, ULDARICA DINGLASA, Filipino, of legal age, a

businesswoman and a resident of Brgy. Sangcol, Dipolog City,
Zamboanga del Norte, after having been sworn to in
accordance with the law, do hereby depose and say that:

1. Atty. Jan Hendrik I. Vallecer, of IBP Zamboanga del Norte

Chapter, conducted and supervised the taking of this
judicial affidavit at his office located at No. 627, Gonzales
St., Dipolog City

2. I fully understand or am conscious of all my answers to

the questions of the above-named lawyer and
understands that I may face criminal liability of perjury
in case my statements may be proven to be false
testimonies;

3. The following were the questions asked by the above-

named lawyer and my answers:

a. Q: Why are you here at my office?

A: To answer all the allegations in the case filed
against me, my husband and son by Engr. Jose
Saguin, . in Municipal Trial Court in Cities Branch 1
docketed as Crim. Case No. 27920 for Estafa.

a. Q. Nganu nia man ka dinhi sa opisina?

A. Aron pagtubag sa mga allegasyon sa kaso nga
gipasaka batok kanako, sa akong bana ug anak ni
Eng. Jose Saguin, dinhi sa ka hukmanan.
b. Q: What is your highest educational attainment?
A: Only Grade 5, sir.

b. Q: Unsa imo nahuman?

A:Grade 5 ra Sir.

c. Q: Do you understand English?

A: Only few words, sir, but it shall be okay to have this
affidavit in English if you would explain everything to
me.

c .Q: Makasabot ka ug Ingles?

A: Gamay ra Sir, pero pwede ra Ingles kung ipasabot
sa binisaya ang ako nasabtan.

d. Q: How did you allegedly commit the crime?

A: Sometime on August 26, 1996, there were 19 sacks
of coprax loaded to passenger-type vehicle together
with 3 sacks of coprax. The 19 sacks of coprax were
delivered and sold to KGR Commercial, while the three
(3) sacks of coprax were sold to “Akao Lim” station and
had not been reported to Engr. Jose Saguin.

d. Q: Naunsa man nga gipasakaan ka ug kaso?

d A:Niadtong August 26, 1996, dunay 19 ka sako nga
coprax nga gisakay sa passenger type nga sakyanan
uban sa tulo ka sako nga coprax. Ag 19 ka sako gihatod
ug gibaligya sa KGR commercial, samtang ang 3 ka
sako,gibaligya ka “Akao Lim” ug wala na report ngadto
kang Engr. Saguin

e. Q: What can you say about the allegations?

A: The allegations are all false, fabricated and a brazen
lie. The truth of the matter is that we are the tenants
of an agricultural land located in Sangkol, Dipolog
City, having been instituted therein in 1961 by the
father of Engr. Jose Saguin, the previous owner.

e. Q: Unsa man imo ikasulti sa maong allegasyon?

e. A: Usa kana ka bakak, hinimo himo ug dili tinuod .Ang
tinuod kami nga mga saop (tenants) sa usa ka agricultural
land nga naa sa Sangkol , Ciudad sa Dipolog sukad pa sa
tuig 1961 nga gipasulod sa unang tag iya nga amahan ni
Engr. Jose Saguin.
f. Q: Was there any landowner-tenant arrangement
between you and the father Engr. Jose Saguin?
A: Yes, during the time of his father, it was our
agreement that we may harvest coprax every three (3)
months. However, when Engr. Jose Saguin took over,
he demanded that we should harvest coprax every two
(2) months.

f. Q. Duna ba mo tenancy contract tali sa amahan ni

Engr. Jose Saguin sa maong yuta?
A: Aduna sa panahon sa unang tag iya, among
gikauyunan nga mo harvest mi kada 3 ka bulan. Pag
abot sa anak nga si Engr. Saguin siya momando nga
mo harvest mi kada duha (2) ka bulan.

g. Q: Were you able to heed his demand?

A: No. It was impossible for us to heed his demand.

g. Q: Nakatuman mo sa iya nga mando?

A: Wala kay imposible nga amo mahimo.

h. Q: How did he respond to your failure to heed is

demand?
A: He resorted to acts of harassment against us. He
fabricated lies and stories against us and demanded
that we should seek for another landlord. Hence,
sometime on August 26, 1996, he allegedly learned
from a certain Carlita Patangan that we sold three
sacks of coprax to Akao Lim without his knowledge.

h. Q: Unsa man ang gihimo ni Engr. Saguin nga wala man

mo katuman ?
A: Duna daun siya gihimo pag pang “harass” kanamo,
naghimo himo ug istorya pagdaot namu ug miingon nga
maayo mangita kami ug lain nga landlord. Dayon,
niadtong Agusto 26 1996, nakadungog ko no siya ug
istorya gikan kang Carlita Patangan nga nagbaligya mi
ug tulo (3) ka sako nga coprax ni Acao Lim nga wala
siya kabalo.

i. Q: Is that true?
A: No. The truth of the matter is that sometime on
August 26, 1996, we scheduled to deliver 19 sacks of
coprax to KGR Commercial to sell our coprax. We
boarded on Kriskath-I, a passenger vehicle, together
with my husband, Isaac Dinglasa, and son, Desiderio
 Dinglasa. Carlita Patangan also boarded the vehicle
with her “tuba”, and few others. Kriskath I was also
loaded with comprax owned by other persons.

i. Q: Tinood ba na?
A: Dili na tinood. Niadtong Agusto 26, 1996 nag
schedule mi deliver ug (19) ka sako nga copra to KGR
commercial nga pagbaligya ug copra. Misakay mi sa
Kriskath-1, passenger vehicle, uban sa akong bana ug
anak. Si Carlita Patangan misakay pod sa mao nga
sakyanan nagdala ug tuba ug uban pa. Kriskath I
nagkarga pod ug copra nga gipanag iyahan ug lain nga
tawo.

j. Q: How many passenger vehicles that travels from

Sangkol to Dipolog City?
A: Only two, sir. One is Kriskath I. The vehicle we
used on August 26, 1996.

j. Q: Pila ka sakyanan nga gipasayro nga mulabay sa

Sangkol paingon sa Dipolog?
A: Duha (2) ra Sir. Ang Kriskath I, mao ang sakyanan
nga amo nasakyan adto Agusto 26, 1996.

k. Q: After you boarded on Kriskath I, you immediately

proceeded to Dipolog City to sell your comprax?
A: Yes, sir. We sold the 19 sacks of comprax to our
“suki” at KGR Commercial.

k. Q: Pagsakay nimo sa Kriskath -1 ni dertso daun mo sa

Dipolog pagbaligya sa copra?
A: Mao Sir, amo gibaligya ang (19) ka sako nga copra
sa among suki sa KGR Commercial.

l. Q: Can you still remember the route of Kriskath I

during that day?
A: Yes, sir. Carlita Patangan disembarked first with
her “tuba”, and we followed. I do not know sir where
was the next stop because when we disembarked,
there were still other sacks of comprax left in the
vehicle. There were also other passengers on board.

l. Q:Nakahinumdum pa ka asa ang ruta agianan sa

Kriskath-1 anang adlawa?
A:Oo Sir. Kini si Carlita Patangan mikawas sa
sakyanan dayon mikawas pod mi.Wala na daun mi
 kabalo diin paingon ang sakyanan.Kay sa pagkawas
namu sa sakynanan naa pay nahabilin nga sako nga
copra sa sakyanan. Naa pa pod nahabilin nga
pasahero sa sakyanan.

m. Q: So, when did you learn about the theft incident?

A: We were shocked that on the next day, we were
summoned to the barangay captain, but we did not
know the purpose of such summons.

m. Q: Kanus-a man mo nakabalo nga adunay nahitabong

pagpangawat?
A: Nakuratan, kay pagka sunod adlaw gipatawag mi
sa Barangay Kapitan pero wa mi kabalo unsa
hinungdan sa pagapatawag.

n. Q: Did you respond to the summons? What happened

next?
A: Yes, sir. The barangay captain informed us the
Engr. Jose Saguin, Jr. accused us that we stole his (3)
sacks of coprax. The barangay captain also wanted us
to admit the accusations. But, we vehemently denied.
We do not know any about the incident.

n. Q:Niadto ba mo kadtong gipatawag mo?Unsay

nahitabo sunod?
A:Oo Sir.Giingnan mi sa Barangay Kapitan nga
giaakusahan mi ni Engr.Jose Saguin nga amo gikawat
ang iya tulo (3) ka sako nga copra. Gusto sa barangay
kapitan nga amo angkunon ang maong sala.Pero wala
namu giangkon ang sala.Kay wala man mi kabalo
anang insedenteha.

o. Q: Who is Rosalio “Ebon” Mandas?

A: He is our neighbor, sir, from Brgy. Cogon, Dipolog
City.

o. Q. Kinsa man ni si Rosalio “Ebon “ Mandas?

A: Among silingan Sir.Gikan sa Brgy. Cogon, Dipolog
City.

p. Q: Is it true that you approached Rosalio Mandas and

beg that he will claim the three (3) sacks of coprax sold
on August 26, 1996?
A: No, we never approached or beg for him to be our
witness, but I confronted him that he also had a
coprax at that time on board of Kriskath I. Why can’t
 he tell them the truth? He was already in the house of
the barangay captain when we arrived.

p. Q:Tinoud ba nga inyo gihangyo ug nagpakaliuoy mo ni

Rosalio Mandas nga iya angkunon ang tulo (3) ka sako
nga gibaligya atong Agusto 26, 1996?
A:Wala Sir. Wala gyud mi nihangyo ug nagpakiluoy
niya nga amo siya himuon nga testigo, pero amo siya gi
konpronta nga naa siya copra nga gipasakay pod sa
Kriskath atong tungora. Nganu dili man siya
makaistorya ug tinuod?Naana siya daan sa balay sa
barangay captain sa wala pa mi naabot.

Q: What happened next?

A: I was so shocked that he already executed an
affidavit against us.

q. Q: Unsay sunod nga nahitabo?

A: Nakuratan na kaayo ko kay nagpahimo naman siya
affidavit batok sa amoa.

r. Q: On August 26, 1996, have you seen Engr. Jose

Saguin?
A: No, sir. As it was our practice that when we sell our
coprax at our “suki”, I can claim only my share. Engr.
Saguin’s share is left with KGR.

q. Q: Kaniadtong Agusto 26, 1996 nakit an pa ba nimo si

Engr. Saguin?
A: Wala Sir, sa among pagbaligya usob sa copra sa
among suki ang ako makuha kay ang ako ra gyud nga
bahin. Ang bahin ni Engr. Saguin kay gibilin ra didto sa
KGR.

r. Q: During the time of the father of Engr. Jose Saguin,

had you ever been involved in any agrarian or criminal
or civil case?
A: From 1961 until the death of the father of Engr.
Jose Saguin, none.

s. Q: Atong panahon sa amahan ni Engr. Saguin naa ba

kay mga kaso?
A:Gikan sa 1961 taman sa pagkamatay sa amahan ni
Engr. Jose Saguin, WALA.

t. Q: Had Engr. Jose Saguin ever demanded that you

vacate the said property?
 A: Yes. Engr. Jose Saguin demanded that we should
vacate the property because he is now the owner of the
entire property. He further added that, “I do not like
you anymore, you better leave”.

s. Q: Giingnan ba mo ni Engr. Jose Saguin nga

mupahawa mo sa yuta nga inyo gipuy-an?
A: Oo. Niingon si Engr. Jose Saguin nga kami
mupahawa sa yuta nga amo gipuy an kay siya naman
ang tag iya. Iya pa gyud giingon nga wala naku ganahi
ninyo, pamahawa namu.
