JOINT AFFIDAVIT OF APPREHESION

WE, __________________________, member of the Philippine National Police,

presently assigned with the Provincial Highway Patrol Team- _________ with address at
Brgy. +++++++++++++++++++, do hereby depose and state:

1. That, we are a bonafide member of the RHPU Provincial Highway Patrol Team-
wherein on at about 06300H to 0900H , 20th of June 2018, Mobile ___ of PHPT conducted
TDC and Oplan Disiplinadong Driver, Colorum operation along National Highway , Brgy.
San Vicente , San Pedro City in line with the pronouncement of Pres. Rodrigo Duterte to
apprehend violators specially Colorum Operations .

2. That while patrolling along National Highway , Brgy. San Vicente , San Pedro
City our Team spotted one ( 1 ) Mitsubishi Adventure Wagon with Plate # UYD 688 UV
Express with Franchise Route to Sucat via Lawton obstructing the rightside of the road
towards San Pedro with 2 passengers on board which prompt us to flagged down the MV for
verification.

2. That we approached the said MV and requested the driver to roll down the
window and asked of his Driver’s License and OR/CR of the MV which later identified as
one (1) Mr. Renato R Lopez of Brgy Tunasan, Muntinlupa City as showed his driver’s
license to SPO4 ____________ . However, when he was asked for the CPC and Franchise
of the MV the driver/possessor showed a Franchise Decision with route Sucat – Lawton via
SM Mall of Asia in violation of the granted Decision to Operate on Paragraph 2 (Terminal
to Terminal Clause) this prompt the team to accost the driver for Out of Route /Colorum
Operations.

3. Consequently, that while we are traversing the national highway towards

Pavilion , Binan City, a Hyundai H100 with CS# MR6567 was obstructing the middle of the
road towards Mamplasan Road with more or less (18) Passenger on board with
Unauthorized/illegal attachment of Blinker( PD 96) which prompt the Team to approached
the said MV and requested the driver to roll down the window and asked of his Driver’s
License and OR/CR of the MV which later identified as one (1) Mr. Rafael A Mendoza of
Technopark , Loma, Binan , Laguna as showed his driver’s license to SPO4 ______.
However, when he was asked for the CPC and Franchise of the MV the driver/possessor
failed to show any documents this prompt the team to accost the driver for Colorum
Operations as the driver requested to disembark his passenger at Fujitsu, Laguna
Technopark , Binan City an brought the apprehended MVs for further investigation and
proper disposition

4. Upon arrival at the said Office, the team turned over the said MVs, documents,
Driver’s licenses to SPO2 __________________l , Investigation PNCO of our Unit as he
processed and prepared the necessary report and documentation for proper disposition of
the MVs and confiscation of Blinkers.

5. That we are executing this Affidavit to attest the truthfulness of the foregoing facts
and to support the apprehension of the above said MVs in violation of PD 96 and
Violations in connection with Franchise of JAO 2014-01, Title 4, Table 1 Para B and C.

1. informed that at about 06300H to 0900H this 20th of June 2018, Mobile 411 of
PHPT Laguna led by SPO4 Custodio, SPO4 Olaes, SPO2 Blaza ,PO3 Ferrer under the
direct supervision of PCI JOSE MARIA C FRANCA, conducted TDC and Oplan
Disiplinadong Driver, Colorum operation along National Highway , Brgy. San Vicente , San
Pedro City in line with the pronouncement of Pres. Rodrigo Duterte that resulted in the
apprehension/impounding of (2) passenger van for Colorum Operations and confiscation of
two (2) blinkers in violation of PD 96 (Unauthorized Attachment of Blinker) enumerated as
follows with corresponding violations, to wit:

a. Mitsubishi Wagon ( For Hire ) with Plate # UYB 688 for Out of Route ( Sucat-
Lawton Franchise ) driven by Mr. Renato R Lopez of Brgy Tunasan, Muntinlupa City
 b . Hyundai H100 ( Private ) with CS # MR 6567 for Colorum Opns / Shuttle
Service flagged down for PD 96 (Unauthorized attachment of Blinker) driven by Mr.
Rafael A Mendoza Technopark , Loma, Binan , Laguna.

2. Subject MVs , Driver’s License were turned - over to Land Transportation

Office Calamba District Office received by Asst. Chief, LTO Calamba District Office
pursuant to Section 4 Para 7 of RA 4136 and the confiscated Blinker shall be turned over to
RHPU4A for proper disposition.
