FOREWARD

Abbottabad Township Scheme (ATS) was launched in Abbottabad covering a gross

area of 190 of land to develop residential plots of various sizes. Sites have also been reserved

in the Township for utility buildings i.e. School, Mosque, Health Centre, Parks, Post Office,

Fire Brigade, Open Spaces, Graveyard, Bank, Police Station and other recreational activities.

This Booklet contains the terms and conditions along with application form for

allotment of residential plots in ATS, Abbottabad. The form maybe detached and submitted

along with 1/4th price of the plot as advanced money into designated branch of National

Bank of Pakistan. The applicants outside Abbottabad may submit their application along with

Bank Draft in favour of Project Director, Abbottabad Development Authority Abbottabad.

PLOT ALLOTMENT REGULATIONS, 2018


CHAPTER # 01 PRELIMINARY

1. DEFINITIONS:
In these Regulations unless there is anything repugnant in the subject or context:-

i. Allotment means allotment of a plot to an individual or party by an


allotment order prescribed under these regulations.
ii. Application means the application form prescribed under these regulations
for seeking allotment of a plot
iii. Authority means Abbottabad Development Authority, Abbottabad
iv. Ballot Draw means assignment of plot by lots to be conducted in public or
by computer as laid down in these regulations for allotment of residential
plots.
v. Head of Authority means The Director Abbottabad Development
Authority
vi. Delivery of Possession means handing over the physical possession of a
plot with or without the title of ownership
vii. Eligible means qualified or entitled to the allotment of the plot.
viii. Family means and includes applicant's wife/wives or husband as the case
may be and their children below the age of 18 years.
ix. Installment means part payment of the dues as prescribed under the mode
of payment of these regulations.
x. Notified Date means the date notified by the Authority indicating that the
essential services have been provided and that plots area ready for delivery
of possession.
xi. Payment means partial or full discharge of all liabilities or dues by the
allottees including advance payment and installments.
xii. Plot means a piece of land with specific dimensions or area earmarked for
the following purposes:-
a. For Residential Buildings exclusively
b. For Commercial Buildings exclusively
c. For Industrial Buildings exclusively
d. For Public Utility Buildings exclusively
xiii. Corner Plot means a plot located at the end of a block and bounded with
connected roads at least on two sides.
xiv. Quota means a specific ratio or number of plots allocated to a particular
group of persons for the purpose of allotment.
xv. Regulations means the Plot Allotment Regulations, 2018 and Building
Regulations 1985 with all their appendices and annexure and any
instructions issued or which may be issued by the Authority from time to
time.
xvi. Government means Government of Khyber Pakhtunkhwa.
xvii. Public Utility Plots means piece of land allotted for construction of
schools, colleges, hospitals, dispensaries, parks, mosque, post office,
police station and Library.
xviii. Commercial Plots means plots allotted for the construction of commercial
buildings, shops, plazas, banks and any other business/trade purpose.

xix. Residential Plots means plots allotted for construction of houses or living
units.

2. RESIDENTIAL PLOTS:
The Residential Plots consist of 3, 5, 7, 10, 14 Marlas and 1-kanal. The detail of
standard sizes of plots is as under:-

3. ELIGIBILITY:
i. A person or a family (as defined in Chapter-1 Definitions) being citizen of
Islamic Republic of Pakistan bearing National Identity Card and
nationality of Pakistan will be eligible for allotment of plots.

ii. Minor Below the age of 18 years shall not be eligible to apply for
allotment of plot.

4. SUBMISSION OF APPLICATIONS:
i. The Authority with the approval of Government reserves the right to
arrange collection of applications for allotment of plots in the ATS through
any schedule Bank/Banks or any other institution so authorized for public
convenience.

ii. All applications received will be subject to scrutiny either before or after
the draw for allotment in order to determine the eligibility of otherwise of
the applicants. The Authority reserves the right of rejecting any application
before conduction of draw/auction or cancellation of allotment afterwards
owing to ineligibility of applicant.

5. MODE OF ALLOTMENT OF RESIDENTIAL PLOTS:


i. The entitlement of allotment shall be determined by an auction or open
draw/ballot amongst the applicants.

ii. The auction or draw shall be conducted publicly by the Authority.

iii. Allotment of plots to the successful bidder/applicant in the auction/draw:

a. The successful bidders/applicants having succeeded in the


auction/draw shall be allotted plots with their exact location i.e.
Plot Number, Sector Name, Plot Area and Plot Dimensions.

iv. Auction Committee will be as notified by Secretary Local Government,


Elections and Rural Development Department, Government of Khyber
Pakhtunkhwa vide letter no. SO (LAAs)/LG/1-4/15/Swabi Vol-V/427
dated: 22-03-2018. The Auction Committee members will be as under:

a. Director, Abbottabad Development Authority, (Chairman)


b. Representative of Deputy Commissioner, Abbottabad, (Member)
c. Representative of LGE&RDD, (Member)
d. Housing Officer ADA, (Member)
e. Representative of Anticorruption, (Observer)
f. Media Person (Observer)

v. The Plot allotted shall be subject to the Plot Allotment Regulations 2018
and Building Regulations 1985 and other instructions issued and those
which may be issued by the Authority from time to time and shall not be
sold or transferred by the allotee except as otherwise provided for in the
said regulations.

vi. In case an allotment of residential plot is obtained in contravention of these


regulations, the allotment shall stand cancelled. In such a case the amount
deposited in full or part thereof shall stand forfeited or as maybe decided
by the head of the Authority.

CHAPTER # 02 MODE OF ALLOTMENT

6. RESIDENTIAL PLOTS:

i. All residential plots in ATS will be disposed of by auction/draw/ballot as


notified. The base price/reserve price of plots will be fixed by Auction
Committee as notified by under Section 5 (iv) of these regulations.

ii. Payment schedule will be as per advertisement for auction which will be
widely published in local and national newspapers as per government
policy.

iii. In case of re-auction of cancelled residential plots, Sui Gas charges if


unpaid will have to be submitted by the successful bidder along with sale
price.

7. COMMERCIAL PLOTS:

i. All commercial plots in ATS will be disposed of by auction/draw/ballot as


notified. The base price/reserve price of plots will be fixed by Auction
Committee as notified by under Section 5 (iv) of these regulations.

ii. The sites for Banks shall be treated as commercial plots and disposed of by
an open auction or directly allotted on rates approved by Auction
Committee.

iii. Payment schedule will be as per advertisement for auction which will be
widely published in local and national newspapers as per government
policy.

iv. In case of re-auction of cancelled commercial plots, Sui Gas charges if


unpaid will have to be submitted by the successful bidder along with sale
price.

v. Utility plots as defined in section 1 (xvii) of these regulations except plots


allotted to mosques, will be charged non-user charges, plan approval fee,
sui gas charges, water charges, transfer fee and all other fee/charges on
basis of commercial rates.

vi. The Head of the Authority has the discretion that Government Utility
Buildings maybe charged non-user charges, plan approval fee, sui gas
charges, water charges, transfer fee and all other fee/charges on
concessional rates i.e. on residential basis for specific period or
permanently.

8. PUBLIC UTILITY PLOTS:


i. Public Utility Plots will be disposed of by auction or outright sale with
price/cost payable by allotee department/body wherever applicable.

ii. Plots earmarked for mosques will be placed at the disposal of Auqaf
Department for construction of mosques only. The designs for the
mosques, to be prepared by Auqaf Department will be approved by the
Head of the Authority.

CHAPTER # 03 GENERAL CONDITIONS

9. TRANSFER OF ALLOTMENT:
i. The Allotment of a plot is non-transferable except as provided in Rule 12
below or to any one of the legal heirs of a deceased allottee provided that
the other legal heirs, if any, surrender their rights in the plot in favour of
the former legal heir.

ii. The Allottee shall not transfer or sell or sub divide or part with the
possession or mortgage the plot or any part thereof, except a mortgage
with the specific purpose of obtaining loan from any bank or any other
institution for the purpose of construction, without prior approval of the
Head of the Authority.

iii. Provided further that with the approval of the Authority, the allotee may
transfer built or unbuilt plot to some other person subject to payment of
transfer fee at the following rates:-

 No fee shall be payable by a legal heir of a deceased allottee.


 All the taxes, fee, charges rates mentioned above are revisable. The Head of the
Authority through Finance Review Committee (FRC) has the discretion to revise rates
annually.

10. CONSTRCUTION PERIOD:

i. The allottee shall, within a period of three years from notified


date/issuance of possession certificate erect/complete upon it at his own
cost a building in conformity with the Building Regulations or any other
instructions issued by the Authority from time to time. The allottee shall
obtain a completion certificate in accordance with the provision of
Building Regulations which shall be taken to be the date on which this
requirement is fulfilled.

ii. If the allottee fails to complete the construction of the house/building


within stipulated period as mentioned above in clause 10 (i), he shall be

liable to pay a charge to be called Non-User Charge to the Authority at


the following rates, which shall start accruing from the date on which the
specified period expired, and shall continue till such time the construction
is completed by the allottee:-

11. COMPLIANCE WITH REGULATIONS AND INSTRUCTIONS:


The allottee shall observe these regulations and Building Regulations 1985 and
the instruction that maybe issued from time to time by the Authority with respect to
the land comprising the plot, sanitary conditions, maintenance of buildings and
recovery of dues and local taxes etc.

12. TRANSFER ON COMPLETION:

i. After the building has been completed and completion certificate obtained
in accordance with these regulations from the officer so authorized, the
allottee may transfer proprietary rights in the property built if so desired.

13. BREACH OF REGULATIONS OR NON PAYMENT OF DUES:

i. The Allotment shall be liable to cancellation in case the allottee commits


breach of :-

a. Regulations (Plot Allotment Regulations, 2018 and Building


Regulations 1985), or

b. Instructions issued, or those that may be issued from time to time, or

c. If it is subsequently discovered that allotment of the plot had been


obtained by the allottee by giving false information in his application
for allotment, or

d. Through fraud or mis-representation of facts (or that plot has been


allotted in violation of allotment regulations)

e. Non-payment of non-user charges, sui gas charges, water charges or


any other charges due on the allottee within period as specified by the
Authority

ii. In case of breach of regulations clause 13 i (a), (b), (c), (d) and (e), the
Authority shall have the right to cancel allotment or plots and the
Authority acting through the Housing Officer shall have the right to forfeit
the whole or any part of the payments so made by the allottee and to
resume the plot with full title together with the building if any, thereon,
without paying any compensation whatsoever and without prejudice to the
rights of the Authority to enforce any legal liability arising out of the
default in the nature of a fine or penalty recoverable from the defaulting
allottee.

iii. If at any time the right to cancel the allotment accrues to the Authority in
pursuance of above clause 13 (i) (a), (b), (c), (d) and (e)and 13 (ii), it shall
be lawful for the Authority to cancel the allotment in exercise of that right
or accept in lieu thereof by way of compromise in the form of money as
restoration fee/fine from the allottee.

14. SURRENDER OF PLOTS:

In case the allottee surrenders the plot after having taken the possession thereof,
an amount equal to 20% of the price shall stand forfeited to the Authority.
However, no surcharge shall be recovered in case an allottee surrenders his plot
before taking over possession of plot.

15. FACILITIES TO BE PROVIDED:

The Authority shall not be bound to provide more facilities than the approved
essential services.

16. PROPRIETARY RIGHTS:


The proprietary rights in the land comprising the plot shall be transferred to the
allotees only after he has paid full price of the plot and has completed the building
in accordance with Building Regulations.

17. ERRORS IN ALLOTMENT ORDER:


Any bonafide error in the identity or description of land comprising the plot will
neither by itself annul the allotment order nor any compensation shall be claimed
in respect of such an error.

18. TRANSFER COST AND EXPENSES:


The cost and expenses of stamp duty, registration of sale deed and any other
government taxes etc. for the transfer of proprietary rights shall be paid by the
allottee.

19. LAND REVENUE AND OTHER CHARGES:


All arrears of land revenue or any other charges imposed under any law for the
time being in force in respect of the land comprising the plot shall be payable by
the allottee.

20. AUTHORITY'S RIGHT TO REVISE:

The Authority reserves the right to revise the cost-price, size of plot, location no.
and sector and orientation and that allotees shall have no right of objection.

21. JOINT APPLICATION:


A plot shall be allotted/transferred in the name of a single person. Joint application
for one plot will not be entertained.

22. INTEREST OF DEPOSITS WITH THE AUTHORITY:


No interest whatsoever will be paid in respect of deposits by the
applicants/allotees with Abbottabad Development Authority lying for any period
for the purchase of plot.

23. VARIATION OF SIZE IN PLOTS:


Based on the rates fixed by the Authority, the actual cost of plot payable by the
allottee will be determined on actual demarcation and measurement of the plot to
be carried out in the presence of the allottee or his authorized representative at the
time of handing/taking over the possession of plot.

24. PASSING OF SERVICE LINES ETC. ACROSS PLOTS:


The plot owner shall have to allow at appropriate places across his plots as
decided by the Authority, the passing of Authority's or allottee's neighbour service
line viz drain, sewer, water supply etc. if the site conditions so warrant. No
compensation whatsoever shall be paid to the plot owner in respect of area in his
plot occupied by any service line or any structure connected with the
development/construction of the ATS.

25. ACCESS TO PLOTS FROM AUTHORITY'S ROAD:


The plot owner shall construct, at his own cost, the approach along with a culvert
to his plot from the Authority's roads in accordance with the site conditions
subject to the approval of the Authority.

26. LEVELLING OF PLOTS:


The plots would be handed over to the allotees as per existing site conditions and
the allottee at his own expenses shall level the plot or otherwise to make it fit for
erection/completion of building etc.

27. APPEAL:

i. Any person feeling aggrieved by an order or decision of the Authority,


may within one month of such order or decision prefer an appeal to
Secretary Local Government, Elections and Rural Development
Department Khyber Pakhtunkhwa in which case the procedural order no.
1/1983 dated 3rd October, 1983 shall be followed or as may be decided by
the Secretary LGE&RDD Khyber Pakhtunkhwa.

ii. The Secretary Local Government, Elections and Rural Development


Department Khyber Pakhtunkhwa shall not confirm, modify, alter or set
aside any order or decision appealed against, except after giving the
affected person an opportunity of being heard.

iii. Decision of the Secretary Local Government, Elections and Rural


Development Department Khyber Pakhtunkhwa on an appeal shall be
final.
