Bhg. Dato’fTuan/Puan sedia maklum peruntukan syarat- syarat kontrak memperuntukkan keperluan kontraktor mendepositkan Jaminan Reka Bentuk kepada Kerajaan bagi menjamin reka bentuk serta mutu kerja yang dilaksanakan kontraktor apabila terkeluamya Perakuan Siap Kerja. Keperluan Jaminan Reka Bentuk sebagaimana yang diperuntukkan dalam syarat-syarat, kontrak bukan sahaja menjamin cadangan reka bentuk kontraktor tetapi juga menjamin mutu kerja dan bahan-bahan binaan, perkakasan, peralatan dan kelengkapan yang telah disiapkan oleh kontraktor. 3. Bagi tujuan menyeragamkan penggunaan borang Bon Jaminan Reka Bentuk ini, rujukan telah dibuat kepada Pejabat Penasihat Undang-Undang Kementerian Kerja Raya di mana satu borang piawai PWD DGB 1/2011 telah disediakan dan diluluskan sepertimana di Lampiran A yang dikembarkan4 Penggunaan borang Bon Jaminan Reka Bentuk ini hendaklah dipakai bagi jenis-jenis kontrak berikut: + Bagi kontrak reka dan bina. * Bagi kontrak konvensional di mana kontraktor dikehendakki mengemukakan cadangan reka bentuk bagi bahagian kerja yang telah dikenal pasti dalam kontrak. 5, Sehubungan itu, pihak Y. Bhg. Dato’/Tuan/Puan hendaklah memastikan kontraktor mendepositkan Bon Jaminan Reka Bentuk ini bagi semua projek-projek yang telah disiapkan dan yang berkaitan menurut borang piawai PWD DGB 1/2011 di Lampiran A sepertimana yang dikembarkan. Now the Guarantor hereby agrees with the Government as follows: The Guarantor shall within fourteen (14) Business Days after receiving notice of demand pay to Government the sum so demanded not withstanding any contestation or protest by the Contractor or any other third party and without proof or conditions Provided that the total of all demands so made shall not exceed the sum of Ringgit (RM ) (hereinafter referred as “the said sum’) and the total amount recoverable against guarantor under this guarantee shall not exceed the said sum. ‘Business Days’ means the days which commercial banks are open for business in Malaysia and other than Saturday or Sunday.(2) The Government reserves the right to make any partial demands if it shall so desire and the total of such partial demands so made shall not exceed the sum as stated in paragraph (1) above and as the liability of the Guarantor to the Government shall correspondingly be reduced proportionate to any payment of partial demands having been made. (3) The Design Guarantee Bond given by the Guarantor is a continuing Design Guarantee Bond and the Guarantor shall not be discharged or released from this Design Guarantee Bond by any arrangement between the Contractor and the Government. (4) The Guarantee given by the Guarantor is irrevocable and shall remain in force until that is for a period of five (5) years six (6) months after the completion of the works.
