LEASE AGREEMENT

This Lease Agreement is made on this ….th day of September 2016 at Gurgaon
between Mr.__________________________ _S/o Mr. _______________

“LESSOR”) which expression shall include his successors, legal representatives and
assignees of the ONE PART.

hereinafter Called the “LESSEE”). it is repugnant to the context or meaning here of


include his successors and assigns of the OTHER PART.
That the Lessor is the absolute owner and in physical possession of Flat No.-103,
First Floor, Shakti Sky Lark Apartment CGHS,Plot No.-14, Sector-52 ,Gurgaon
(HR) (hereinafter called the said premises) along with all fittings and fixtures.

And whereas the Lessee had approached the Lessor for grant of lease in respect of
the said premises and whereas the Lessor has agreed to Lease out the same to the
Lessee on the following terms and conditions:

NOW THIS DEED WITNESSETH AND IT IS HEREBY AGREED BY AND


BETWEEN THE PARTIES HERETO AS FOLLOWS:-

1. That the Lessee shall use the aforesaid premises only for residential
purposes. The premises shall be exclusively used by the Lessee for his own
residence.

2. That the premises having 3BHK and Two Covered Car Parking.

3. The Lessee agrees to hold the said premises for a maximum period of
Eleven (11) months commencing from 01/09/2016 to 31/07/2017. The
Lessee agrees to vacate the premises after the expiry of said period of eleven
(11) months from the date of commencement of this agreement. However,
this agreement can be renewed after expiry of the period of 11 (eleven)
months with mutual consent of both the parties with increase of rent
@10%Or as on consent of both parties of both parties and fresh lease
agreement will be executed by the both parties.

4. That the period and terms of the lease granted by the Lessor to the Lessee
for the demised premises has been agreed to be for a fixed period of eleven
months commencing on 01/09/2016 and valid till 31/07/2017.

5. That the Lessee has agreed to pay the rent of Rs. 28000/- (Rupees Twenty
Eight Thousandonly) per month including maintenance in advance on or
before 7th day of each English Calendar month Lessor either in cash or
account payee cheque or Transfers in Account.

6. In the event of non-payment of rental for any duration exceeding two


months, irrespective of whether, demanded or not, the lease shall stand
terminated without regard to the period elapsed or prior notice, since
commencement of the Agreement with costs and consequences to the
Lessee.

7. That the Lessee shall pay for the Electric (Power & Light) charges as per
meter reading on the bills. However all Municipal/HUDA taxes including
House/Property Tax for the said premises shall be payable by the Lessor.

8. That the Lessee shall not sublet, assign or part with the possession of the
premises without the consent in writing of the Lessor.
9. That the Lessee shall comply with all the rules and regulation of the local
authorities whatsoever with relation to the said premises.

10. That the Lessor shall pay all the taxes of any kind whatsoever, including
House/Property Tax and Ground-Rent as and when may hereinafter be
assessed on the said premises by the Municipal Corporation or any other
concerned authority or authorities.

11. That the demised premises will be used only as residence of the Lessee Mr.
_____________________, Mr. _________________,and
Mr___________________________That the Lessee will not carry out any
structural addition or alteration to any of the house without written consent
of the Lessor.

12. That the major repairs (including any caused by nature) shall be carried out
by the Lessor at his own cost and day-to-day minor repairs shall be carried
out by the Lessee at his own cost with the consent of the Lessor.

13. That the Lessor or his/her/their authorized person can inspect the premises at
any reasonable time as and when necessary with prior notice.

14. That there is a lock in period of Six (06) months for the Lessee from the date
of commencement of this Lease. It means if the Lessee vacates the said
premises before Six (06) months his one month security deposit will be
forfeited by the Lessor. However, after Six (06) months both the parties shall
be entitled to terminate the agreement at any time during the tenure of the
lease upon serving one month’s prior notice in writing either side.

15. That in case the lessee vacates the flat with one month’s notice on or after
six months from the date of commencement of rent agreement (i.e
28/02/2016); his two months security shall be refunded within 10 days after
the lessee vacates the flat.

16. That at the expiry of rent period, the lessee shall handover the physical
possession of the said property to the lessor with all the fittings and fixtures
in working order except natural wear and tear and damages by act of nature.

17. That the Lessee shall pay to the Lessor a security amount of Rs.56,000/-
(Rupees Fifty Six Thousand Only) by cash/cheque No…………….,
dated……………….., drawn on ………………………on
dated……………,, ( which shall be refunded free of interest by the Lesser to
the Lessee after the clearing of all the outstanding dues/damages, if any, like
electricity, on the date of the expiry of this Lease Agreement, or on
termination of this Lease Agreement after six (06) months as per point 14
above.

18. That on the termination of the Lease, the Lessee shall hand over the vacant
and peaceful possession of the said premises of the premises to the Lessor
with the fittings and fixtures intact and in working condition.

19. That if any dispute arises out of this Lease Agreement which cannot be
resolved by mutual negotiations, shall be subject to the Jurisdiction of
Gurgaon/Haryana Courts only.

20. IN WITNESS WHEREOF THE LESSOR AND LESSEE HAVE


EXECUTED THIS LEASE DEED AT THE PLACE, DATE MONTH AND
YEAR AS FIRST ABOVE WRITTEN IN THE PRESENCE OF THE
FOLLOWING WITNESSES.
