MEMBERSHIP AGREEMENT, TERMS, AND NOTICES

Renewal Terms: All Standard 12 Month Agreements will renew automatically at the
end of the agreement on a monthly basis with the same terms and conditions as this
agreement. All cancellation terms will apply.
Notice: The New You Fitness, LLC (hereafter referred to as “TNU Fitness”, “the gym”,
or “the facility” urges all members to obtain a physical examination from a medical
professional prior to the use of any equipment or attendance in any exercise class. If
the member has a history of heart disease, he or she should consult a medical
professional before joining the gym. In recognition of the possible dangers
associated with physical activity, the above stated hereby knowingly and voluntarily
waives all liability from TNU Fitness and its affiliates. TNU Fitness holds the right to
require and verify reasonable evidence of any injury or disability that is claimed to
have occurred at the facility or at a sponsored event.
Notice: Any holder of this consumer credit contract is subjected to all claims and
defenses which the debtor could assert against the seller of goods or services
obtained pursuant hereto or with the proceeds hereof. Recovery hereunder by the
debtor shall not exceed amounts paid by the debtor hereunder. Do not sign this
contract if there are any blank spaces. In the event optional services are offered, be
sure that you have not or have selected these options.
Legal Notice: State law requires that we inform you that should you the buyer
choose to pay for any part of this agreement in advance, be aware that you are
paying for future services and may be risking loss of your money if TNU Fitness
ceases to conduct business. Gyms do not post a band and there may be no other
protections provided to you should you choose to pay in advance.
Key-Fobs: Each member will be required to have their own key-fob and key-tag.
Each member is given a key-fob and key-tag at their registration (fee is added
into the enrollment fee). If a member request additional they may purchase a
new set for $12. All key-fobs and key-tags are non-refundable and cannot be
shared. ______
Club Enhancement Fee: The purpose of the annual club enhancement fee is to
maintain, add, or repair (if needed) any equipment, services, and facilities. The
fee will be collected on February 1st of each year, and then will renew annually
from that date. The fee can be paid in cash before the due date or it will
automatically be drafted from your bank account. This fee is $25.00 per person.

Termination Policy: If a member is terminated from TNU Fitness they will be
required to pay a $75.00 termination fee, which will be drafted from their card,
and no refunds on membership dues or fees will be issued. ______
Cancellation Policy: You the buyer of this contract have three (3) business days
to cancel this contract without penalties. To cancel hand deliver your request to
TNU Fitness at 986 North Wall Street, Calhoun, GA, 30701 by 12pm on the third
business day after enrollment. Any cancellations after the third business day will
result in penalties/fines (refer to cancellations/note). ______
Non-Member Notice: If you are caught letting non-members into the facility it will
result in a $50 fine charged to the members card on file and will have their
membership terminated immediately. ______

Cancellations: Any member wishing to cancel their membership with TNU Fitness
must provide a written notice at least thirty (30) days before the date requesting to
have their membership cancelled. Cancellations via phone or email will not be
accepted or processed. It is recommended that you come into the office during
normal office hours with your written notice or send your notice by registered or
certified mail, return receipt requested. If you hand deliver your cancellation notice,
be sure to get a signed statement from a TNU Fitness staff member acknowledging
your cancellation. For your cancellation to be effective and processed your notice
should include your full legal name, your date of birth, any membership forms given
to you, your key-fob and key-tag. For any and all cancellations to be processed
(regardless of reason) the member shall render payment of $75.00. Once the
$75.00 cancellation fee is received and processed, all remaining payments on the
contract will be deleted and your cancellation request will be finalized.
I authorize The New You Fitness, LLC (TNU Fitness) to draft my account when
necessary for membership dues, account balances, collection fees, cancellation or
termination fees, and purchases starting on the enrollment date.
I herby state and agree that I have read, been told, and understand all parts of
this agreement, its terms, its notices, and rules and regulations. I also agree that
I am being provided with TNU Fitness member rules, regulations, and
expectation, and I am required to follow them at all times.
Membership Type Total Amount for Membership

Notice: No refunds are issued on memberships paid in full. Memberships are not Number of Payments Due Payment Amount
transferrable. Under this contract, no further payments shall be due to anyone
including the purchaser of any note associated with or contained in this contract, in
the event that TNU Fitness at which the contract is entered into ceases to operate.

Note: I understand that I have signed a contract/note which may be purchased by a Membership Start Date Membership Expiration Date
financial institution. My failure to regularly attend and utilize the facility does NOT
relieve me of my obligations, regardless of the circumstances, to pay the installment
note in full. I understand that, except herein provided, my membership is absolutely
non-cancellable and non-refundable. Should I default on my payment obligations, I First Auto-Draft Payment Discounts/Additions
understand that my account may be turned over to a collection agency or legal
action may be taken against me. If either of these are required, I will be required to
pay 75% of any collection or court fees, plus the remainder of my contract balance. I
promise that if I default on my installment payments, I or someone on my behalf will
pay the remained of my contract balance out to TNU Fitness via cash or credit card. Enrollment Fee Key Fee Total Due Today
All payments are due on the first (1st) of each month and will automatically be
drafted from my bank account at midnight until my contract balance is paid in full.

Acknowledgment: You the buyer of this agreement agree that you have read and
received a complete copy of this contract with disclosures made in compliance with
federal and state laws and a copy of the facilities rules, regulations, and

TNU Fitness holds the right to terminate any
contract/membership at any time without
refund or question.
Anybody caught letting non-members into the
gym without prior expressed permission from
the owners will have their
contract/membership terminated and will be
charged a $50.00 non-member fee and a
$75.00 termination fee.
All belongings should be kept in lockers on in
the members vehicle. TNU is not responsible
for lost, stolen, or damaged property.
RULES, REGULATIONS, AND EXPECATIONS
Appropriate athletic clothing and shoes must be
worn at all times while in the gym. No street
clothes, pants, any clothing item with zippers
or buttons, boots, flipflops, sandals, or any
open toed shoe.
Keep your hands and feet away from all
moving parts and weight stacks.
Be courteous and do not sit on the equipment
to talk or play on your phone. Please keep your
feet and shoes off benches and padded areas.
If you are listening to music use headphones.
Children under the age of sixteen (16) are not
allowed to be in the gym unless they are in the
daycare. Once the daycare closes, no children
are allowed in the gym, no exceptions.
Rack your own weights when you are finished
with them. This includes dumbbells, plates,
bars, and accessories.
Each and every member is required to scan
in/check in at the front desk each and every
time they enter they building. Members should
always have their key-fob and key-tag with
them.
