Greetings!
As per Routing Slip dated 25 July 2018 and in compliance with CHIEF TSD’s directive
in connection thereto, which was received by the undersigned on 30 July 2018, the latter
made a courtesy and working visit to CENRO-Panabo on 1 August 2018 to offer assistance
and evaluate the propriety of filing criminal charges in connection with the above-cited
subject.
CENRO-Panabo, according to For. Carena P. Gudes who is one of the members who
conducted the ground inspection and verification, shall schedule another administrative
hearing to adjudicate the subject controversy, probably on the second week of August, after
the required notices shall have been duly served upon the parties concerned; in view thereof,
the undersigned was invited to attend the said hearing as an observer and/or resource
person.
The records of the administrative case show that, among the three respondents –
namely GLEN ESCANDOR, NESTOR MA and JAIME LAO – who allegedly made unwarranted
excavation/construction/dredging activities in the coastal areas, only JAIME LAO, assisted by
counsel, appeared in the previous administrative hearing; corollary, notices of the subsequent
administrative hearing shall be re-served upon the respondents, and their failure to appear
thereat despite due notice may be deemed a waiver of their right to be heard.
The subject controversy is still the subject of an on-going administrative hearing for the
determination of the pertinent facts and resolution of the issues at hand; and such
determination and resolution is within the primary jurisdiction of the CENRO-Panabo Hearing
Committee for being the administrative tribunal that has the experience, expertise,
specialized training and knowledge on the controversy.
In view of the above and pursuant to the Doctrine of Primary Jurisdiction, any resort to
the judicial courts, including the filing of criminal case, should be held in abeyance until such
time that the administrative adjudication on the subject controversy shall have been duly
completed; this holds true even if the said controversy may well be within the proper
jurisdiction of the courts.

Prosecutors Office for violation of sec. 77 of PD 705 as amended.
It appears that three (3) cases has been filed as of April, 2018. The same is subject for
determination of probable cause at the Prosecutors level.

As it appears that the case was dismissed for lack of probable cause, no further action was
taken by the OIC CENR Officer to represent the interest of the state.

It could be noted from the matrix that there were no new production or purchased by
the lumber dealers for the period, instead disposed lumbers were old stocks which were
purchased from the previous months of operation.
