Compliance requirement communication

Dear valued Supplier,

With the focus on Transportation Compliance Lubrizol has noticed an increase of non-compliant
situations where drivers presented themselves to Lubrizol’s facilities not being compliant with the
requirements put in place for the physical transportation of products.
As you are one of Lubrizol’s selected carriers, we feel it our obligation to again re-emphasize following
agreement that has been set between both our companies.
Lubrizol will continue applying following strict rules in order to enforce a correct handling, loading &
shipment related to the physical movement of Lubrizol’s products:

A. General Requirements :

1. Your charter must comply with legal requirements related to vehicles, loadings and drivers.
2. Prior to entering Lubrizol’s premises, all drivers must register at the designated office/area.
3. Loading can only be effected if the drivers present themselves with the proper reference(s) for
loading (DN = Delivery Number)
4. Some of our products are classified hazardous according to current regulations. All trucks loading
these goods have to comply with legal norms for transportation of chemical products according
to ADR / IMDG /RID / IATA regulations.
5. For hazardous products shipped in Bulk by road, the free space should not be less than 20% or
not more than 80% of the tank or compartment. For maritime and air transport this rule applies
to all products.
6. The driver will be required to present a cleanliness certificate certified by APLICA (Association
Professionnelle des Laveurs Intérieurs de Citernes Agrées, agreement dated 22/03/1993) or
EFTCO (Agreement dated 24/06/1999 completed with the European Cleaning Document created
in 2004) dated of maximum 5 working days for tank trucks and of one month for containers. If
this time limit is exceeded, you will need to provide us with a non –loading certificate. A visual
control will be done to check that the tank is clean, dry and odor free. Otherwise the truck will be
refused and will be sent to the nearest certified cleaning station. Penalties for late collection
might apply in this case see Paragraph G.
7. For Bulk quantities under 10 MT, special equipment will be required in order to comply with
applicable regulations (baffle tanks / multi pot tanks).

8. In order to be granted access to our loading sites, drivers must have the following IPE (Individual
Protective Equipment):
- Safety helmet
- Safety glasses
- Safety shoes
- Covering clothes
- Gloves
- Hearing Protection
- Harness for bulk loadings

site before 2 pm due to customs documentation procedures.
**Rouen package: For air and sea shipments out of our Rouen facility, you must contact our Plant
Logistics Department latest 48 hours prior to the confirmed collection date either by email :
pickupatrouen@lubrizol.com or phone: + 33 2 35 58 14 56 or +33 2 35 58 13 73. Our colleagues will
confirm the expected loading slot time (morning or afternoon). Without information from your side,
the shipment will not be prepared. As a consequence, the truck shall be loaded after the scheduled
ones and Lubrizol will not accept any costs resulting of the waiting time.

Hambourg :
(1) For bulk orders, weighing operations must be performed at the following address before

*LBC Sogestrol:
- In case of shipments outside of the European Union, all vehicles must be on site before 2 pm due
to customs documentation procedures.
- The day prior to loading, your haulier has to contact one of the two numbers mentioned above to
arrange an appointment.
- After loading, the haulier has to drive back to Le Havre plant to obtain his papers and the IMDG
placarding.
No extra costs for waiting will be accepted in case of arrival outside the opening hours.

C. Documents to be provided

Please ensure that the drivers have the following documents when loading at one of our plants:

 Safety procedures: drivers must either have safety procedures signed between Lubrizol and the
haulier or the streamlined version which will be handed over to them upon arrival. In case your
driver does not comply with these rules, he/she will be evicted and denied future access to our
site.
 Identification (ID): drivers should be able to provide their ID or passport in order to be identified
 Truck driving licence
 Driver’s training certificate for the transport of dangerous goods.
 Instructions in writing ADR 5.4.3.
 Valid certificates of approval for the vehicles
 Cleanliness certificate (see General Requirements Paragraph 6.).

If applicable, it is the driver’s responsibility to indicate to our staff the customs office where the export
documents will be cleared.

D. Types and Equipments Characteristics

- Bulk loading :

Tank container :
 From 20.000 L to 37.500 L
 IMO certified (International Maritime Organisation)
 Steam heating coil system
 Electrical heating (when applicable)
 Security Handrail for shipments in our Hamburg plant or in VLS, Belgium
 2 wheel-chocks (to be put in place by the driver)

Tank-truck :
 20.000 L to 37.500 L
 ADR agreement, when applicable
 Security handrail
 Insulated tank
 Tank, lines and valves in stainless steel
 Heating coils

Flexitank :
 Our additives’ viscosity does not allow loading in flexitank.

For quality and safety reasons, we cannot accept to load the below transport equipments :
 Jumbos
 Tank-truck with a capacity greater than 37.500 Liters
 Swan neck trailer
 40 feet trailer
 Multi-tank with common collector system
 Tank trucks dedicated to food (see regulation dated 20/12/2009)
 Tank trucks dedicated to the transport of dangerous goods specialized in the transport of
alcoholic drinks (UN 3065).

- Loading of packed goods :

As shipper, we are responsible for the loading, stowing and securing of packaged cargo as per the
driver’s loading plan.
In order to comply with security rules, we reserve the right to load our drums on pallets. Ex Rouen plant,
pallets with less than 4 drums will be systematically strapped.
For H&S reasons, we do not accept to load our packed goods in any vehicle containing foodstuffs.
Trailers must be fitted with the following equipments :
 Anti-slip material (pad or roll)
 Lashing straps complying with EN 12195-2 norm, with a tensing effect higher than 350 daN
 Edge protectors
 Cross beams / lashing beams
 Lashing points complying with the EN 12640 norm
 2 wheel-chocks (to be put in place by the driver)

Should one of the above described equipments be missing, the loading could be refused.
For safety reasons, we cannot accept to load the below transport equipments :
 Refrigerated trailer
 Low bed trailer
 Jumbo or swan neck trailer
 Trailers with width lower than 2.40 meters
 Trailer with a metallic floor or equipped with rolling conveyor system
 Flatbed truck

E. Vehicle Requirements :

1. The vehicle is fit for purpose, well maintained with seatbelts.


2. The number of passengers not exceeds spec for the vehicle.
3. Loads are secure Journey Requirements.
4. In high risk countries journey management plans in place.

F. Driver Requirements :

1. They are licensed, trained and medically fit.


2. They are rested and alert.
3. They do not use a mobile phone while operating the vehicle.
4. Not under the influence of alcohol or drugs.
5. Seatbelts worn by all occupants.
6. Safety helmets worn by rider and passengers.
7. Be able to express themselves in the local language OR English.
8. Drivers must attend loadings as they are performed under their responsibility.

Failure to comply with the above can result in non-loading or refusal to enter Lubrizol’s premises. Should
such events occur repetitively, additional actions and measures can be taken potentially leading to the
cease of our collaboration.

We trust that you will pass this information on within your organization and remain convinced that you,
as Lubrizol’s selected supplier will do all to follow these Requirements.
