I. Mr.

Peter Banag’s Side

Banag presented Puzon, one of his neighbors, to testify to the incident
that involved her daughter, Mary. Puzon narrated that he saw Mary was
attacked by Sison’s dog while knocking at the latter’s gate to buy ice candies.
He suddenly ran towards her to defend her from further attacks by the dog.
Sison immediately came out of his house to check what was going on. He
then discovered that his dog bit Mary’s arms and leg which prompted him to
accompany the victim to a nearby clinic for a proper medical attention.

II. Mr. Arthur Sison’s Side

Sison claimed that he was not at fault regarding the incident since he
reiterated that there is a written warning sign about the presence of his dog.
He alleges that his gate sports an automatic closer feature in order for his dog
not to come out. He also claimed that it was the first incident that his dog bit
someone. Sison furthered that it was the responsibility of Banag to watchout
of his 6 year-old-daughter to prevent her from walking alone. As soon as he
discovered the incident he rushed outside to send his dog in and accompany
the victim to a nearby clinic for proper treatment of her wounds and for an
injection that were all shouldered by Sison.
