QUESTION 1 [15 MARKS]


Amendments to the Registration of Engineers Act 1967(REA) have recently been passed
by the Parliament, and were subsequently gazetted on 28th February 2015. The
amendments with the title "Registration of Engineers (Amendment) Act 2015, were
enforced by the Minister of Public Works, Malaysia on 31 July 2015.

(a) Discuss and explain briefly the main reason for the latest amendments to the
Registration of Engineers Act 1967(REA) with the title "Registration of Engineers
(Amendment) Act 2015”. (Please refer statement above) [5 marks]

In the latest amendments to the REA, new sections were included to provide for the
registration of new categories of Registered Persons under the "Registration of Engineers
(Amendment) Act 2015, as shown in Figure 1 below.

(b) Examine and discuss Figure 1 and statement above in detail the registration of two
(2) of the new categories of Registered Persons under the REA (Amendment) Act
2015. [5 marks]

The latest amendments under the REA (Amendment) Act 2015 have resulted in a two-tier
(2) registration of Professional Engineers; namely a Professional Engineer with
Practising Certificate, and a Professional Engineer (without practising certificate).

(c) Discuss and explain briefly (please refer statement above) the differences between
the entitlements of a Professional Engineer and a Professional Engineer with a
Practising Certificate. [5 marks]

QUESTION 2 [15 MARKS]


(a) Discuss and explain the term ”Integrity” from the perspective of engineer
responsible for monitoring a project for his/her employer being a leading
multinational company. [5 marks]

(b) Justify five (5) example on how engineering schools and professional bodies such
IEM/BEM, the government and companies could play a more effective role in
achieving a high standard of integrity among the engineers in Malaysia in making
choices to uphold oneself to consistent moral and ethical standards. [10 marks]

QUESTION 3 [30 MARKS]


(a) Ir Ahmad is a technical manager of an engineering design and consulting firm.
Under his supervision are a group of senior and junior engineers, and technicians.
Discuss any two (2) ways, what Ir Ahmad could do to improve productivity and
technical competency of his team. [6 marks]

(b) Effective communication is very important in the workplace. Hence


communicating clearly, both verbally and in writing is essential in particular for
people in leadership position. Discuss some simple ways to strengthen
interactions/communication within an organization. [9 marks]

(c) As a young engineer in a multinational company, you should have a very good soft
skills among your team members. Discuss five (5) example of soft skills that can
be approached to develop career success and at the same time will give a benefit to
your company growth. [15 marks]

QUESTION 4 [20 MARKS]


The world is becoming a place in which the human population, which now numbers more
than 7 billion, is becoming more crowded, more consuming, more polluting, more
connected, and in many ways less diverse than at any time in history. There is a growing
recognition that humans are altering the Earth’s natural systems at all scales, from local
to global, at an unprecedented rate. As predicted in the study made by some scientists from
MIT in the book Limits of Growth and depicted in the graph below (figure 2), the way
forward is to embark on “sustainable development”.

(a) Based on the background descriptions above discuss on the three spheres of
sustainability relating to a sustainability model and deliberate on one example that
relates to how the model can be unbalanced in the engineering practice.

(b) How sustainability can be challenged and addressed in transport systems? Give five
(5) challenges and ways to address them. [10 marks]

QUESTION 5 [10 MARKS]


Two construction companies were convicted by the Malaysian court on the construction
mishaps that happened on the 2nd Penang Bridge in late December 2014. Both companies
were found guilty for causing fatality and injuries to the public as well to their employees.
Based on the OSHA 1994, deliberate on at least five (5) provisions that was probably not
adhered to by the companies in the 2nd Penang bridge case and which if adhered to may
have avoided the casualities. [10 marks]

QUESTION 6 [10 MARKS]


(a) AAA Corporation is a registered proprietor of the trade mark “SEIZAKEN”
pursuant to Trade mark Registration No. 91/01413 in respect of batteries in Class
9 under the Trade Marks Act 1976. Therefore, AAA Corporation is the sole and
exclusive company in Malaysia entitled to sell and distribute batteries under the
trade mark “SEIZAKEN”. AAA Corporation also never gives permission or license
to any party to sell such product. One day, AAA Corporation noticed that Beenion
Inc. is selling watch batteries in Singapore under the mark “SEIZAKEN”. Does the
trade mark registration gives protection abroad? If Beenion Inc. is selling the watch
batteries in Malaysia but the registration of the trade mark “SEIZAKEN” already
lapsed ten years and AAA Corporation is yet to renew the registration, do you think
AAA Corporation is still the sole and exclusive company to sell and distribute
batteries under the said trade mark? Justify all answers. [7 marks]

(b) A patent is an exclusive right granted for an invention which is a product or a


process that provides a new way of doing something or offers a new technical
solution to a problem. State Three (3) ‘conditions’ for an invention to be
patentable. [3 marks]
