SECTION b - PREAMBLES
Generally
A The Lump Sum amount entered by the Contractor in these Bills of Quantities shall constitute the entire
claim for compensation for the work under this Contract in accordance with the Conditions of Contract.
It is to be noted that the Contractor's design costs shall be priced separately and included in Part d/1
General Items of the Bills of Quantities.
The works shall not be remeasured and will be subject to adjustment only as a result of changes in
the scope of work approved by the Employer.
B The Bills of Quantities have been provided as a format/schedule for pricing by the Contractor and in
order that the bids received can be analysed/compared on a like for like basis.
The Contractor is totally and without exception responsible for the measurement of the quantities and
work items required for the completion of the Design and Build Works.
The Bills of Quantities shall be used as a pricing document and the Contractor shall identify any
additional items of work to those stated in the Bill of Quantities, and include in the designated place
at the end of each Bill Section.
C Each unit cost for any single item must be firm and will not be adjusted during the contract.
D The Contractor must include his quantities against the items provided in the Bills of Quantities and his
unit prices to give the total Tender sum.
E If the Contractor determines that there are items on the drawings or in the Specification or required
by his design which are not included in the Bills of Quantities, he should reflect such variances or
omissions in this pricing document.
F Upon award of Contract, the Bills of Quantities shall be used solely for evaluating progress and as a
schedule of rates for any approved changes.
G The Bills of Quantities herein, including all notes and instructions, form an integral part of the Contract
Documents. However, the descriptions contained in the Bills of Quantities for each item are not
necessarily complete. The Contractor is referred to the Conditions of Contract and other Documents,
Specifications and Drawings as well as relevant Standards and Codes of Practice for further information
as no claim or variation will be considered on account of the Contractor's failure to do so.
H The Contractor is cautioned to familiarise himself with the full content of other Contract Documents
including the Instructions to Tenderers, Tender Form, General Conditions, Particular Conditions, Design
Criteria, Tender Drawings and Specifications or any other information that can be reasonably inferred
from any of them and all obligations contained in the documents shall be included in the item rates and
sums.
I The Contractor should note that Ministry of Public Works reserves the right to require the Contractor to
adjust any unfair distribution of moneys within the General Items.
J Drawings, Specifications and Bills of Quantities and all other Contract documents are complementary
and if any item is included in any of them, it shall be deemed included in all.

A The Contractor's tender for the entire work shall provide for supervision of any or all trades that is not
intended to be performed with his own forces. No extra compensation for services as a General
Contractor will be paid.
B The Contractor is required to provide with his tender one original and two copies of the Bills of
Quantities fully priced out in waterproof ink with summation sheets properly checked and extended
to include any items which are added by the Tenderer.
C Amendment shall not be made to these Bills of Quantities without the authority, in writing, of the
Employer. The Tenderer is allowed to insert items for Method - Related charges in accordance with
Civil Engineering Standard Method of Measurement (Third Edition) CESMM3. CESMM3, Section 7:
paragraphs 7.6, 7.7 and 7.8 are not applicable.
D The Contractor shall not use these Bills of Quantities as the basis for a construction programme or for
the purposes of ordering materials or arranging sub-contracts. The references for these activities shall
be the drawings, specification and instructions issued by the Engineer.
E The Contractor is to ensure that identical items occurring in separate bills are not priced at different
rates unless this is the Contractors deliberate intention.
F The prices and rates entered by the Contractor against items in the Bills of Quantities shall apply
throughout the duration of the Contract to the execution of these items in any location and, except
where otherwise provided for, to any additional work ordered by the Engineer.
G A price or rate is to be entered against each item in the Bills of Quantities and any item left unpriced
will be deemed to be included for elsewhere in the Bills of Quantities and hence the rate for that item
will be taken as NIL.
H Quantities and Rates inserted by the Tenderer must be limited to a maximum of THREE DECIMAL PLACES.

Method of Measurement
B This form of Bill of Quantities have been prepared generally in accordance with the Rules of the Civil
Engineering Method of Measurement Third Edition (CESMM3) approved and sponsored by the
Institution of Civil Engineers 1 - 7, Great George Street, London SW1P 3AA, England and published
by Thomas Telford Services Ltd. 1 Heron Quay London E14 4JD. In any particular case, in the
Bills of Quantities where the method of measurement for certain items is modified it is stated in these
Preambles. The modified method of measurement expressed for these items must be accepted
and measured in accordance therewith.
C Items in the Preambles Section of these Bills of Quantities are deemed to qualify and to form part of
every description of the work to which they refer including composite descriptions.
D Item reference numbers shown in column 3 for the class of works according to CESMM3 generally
follow the convention used by CESMM3. Any deviation in the convention used shall not be the basis
for a claim.
E Reference to British Standards in CESSM3 are applicable only if not stated unless otherwise in the
Contract Specifications in which case the specified reference standard shall apply.
F CESMM3, Section 1: paragraph 1.2 is deleted. The Conditions of Contract applicable to this Contract
are the General Conditions of Contract for Plant and Design-Build Projects prepared by the
International Federation of Consulting Engineers (FIDIC) First Edition 1999. Reference to Clause
numbers in CESMM3 are applicable to the corresponding Clause numbers which may be
different to the Conditions of Contract applicable to this project.

Pricing
A The pricing of the Bills of Quantities shall be executed in such a way to enable reproduction by
photocopying to be carried out if required. CESMM3, Section 6, Paragraph 6.1 is deleted and
replaced with "Rates and Prices shall be inserted in the rate column of the Bill of Quantities in
Kuwaiti Dinar and fils".
B The prices shall be comprehensive and must include for complying in all respects with the Instructions
to Tenderers, Conditions of Contract, Specifications Design and Drawings and for all matters and things
necessary for the proper construction, completion, and maintenance of the whole of the Works. No
claims for additional payment will be allowed for any error or misunderstanding by the Contractor of the
work involved.
C The rates and sums inserted in the Bill of Quantities are deemed to include for the following:-
2. Materials, goods and all costs in connection therewith (e.g. carriage freightage, all duties, delivery,
unloading, storing, returning packings, handling, hoisting or lowering, replacing work, goods or
materials damaged, broken, lost or stolen until the issue of a Certificate of Completion).
4. Plant.
6. Land required for tips and stockpiles including all costs for obtaining any necessary licences and
approvals.
7. Allowance for phasing requirements of works, effect on programming of the works of all traffic
diversions and construction activity associated with diversion or installation of services.
8. For taking measures for the support and full protection of pipes, cables and other apparatus required
during the progress of the Works as required by Service Authorities or the Engineer.
9. Dewatering as required.
10. For working alongside and liaising with other Contractors working on the same site.
D Lump sums shall not be inserted where unit rates are applicable.
E Where the word "allow" is used, the cost of the item shall be the responsibility of the Contractor.

A The amounts set against any items of overhead shall include for all costs in connection with letters of
credit bank charges, interest charges and insurance after the materials come under the control of the
Contractor.
B The tenderer shall submit the analysis of "Tender Sum" with a full and detailed rate breakdown of all
the BOQ items, together with the tender submission. The breakdown is to show the actual calculations
of the General Items, Labour, Plant and Materials costs for the Works, the build-up of measured rates
with on-costs and overheads and any other allowances used to arrive at the Tender Price. In addition
the tenderer/contractor will be required to provide the Engineer within 7 days with a full and detailed
breakdown/any other information if requested.
C Where fix only items are specified, the rate shall be deemed to include for taking delivery, storing and
installation of goods or materials in the works where appropriate.
Weather Conditions
D The prices and rates shall include for all restrictions on working due to inclement weather or weather
related conditions.
Variations
E The rates inserted in the Bill of Quantities with the application of the adjustment item will be used to
value any variations to the Works, whether omissions or additions. The Contractor shall not be
entitled to payment for profit and overheads on the value of Work omitted.
F CESMM3, Section 5:pursuant to paragraph 5.20 no body of water is identified separately. The Tenderers attention is
particularly drawn to the de facto situation whereby the whole of the Works are affected by Tidal Water.
Adjustment Item
H CESMM3, Section 6: paragraphs 6.3, 6.4 and 6.5 are not applicable.

General Items
Contractual Requirements
A (i) Items for insurance classed as contractual requirements shall be deemed to include only provision
of insurance in accordance with Contract Conditions Clause 18 Insurance.
B The Contractor is to allow in his rates for the production of all shop drawings, working drawings,
operations and maintenance instructions called for in the Specifications.
(i) The surveyed location of all existing services, including gas/oil/other pipelines.
Ground Investigation
C CESMM3 Class B: Ground Investigation is deleted and replaced with the one Item of Ground Investigation as detailed in
the Bill of Quantities. This item is to be priced to include all Ground Investigation works
D Items for ground investigation shall be deemed to include preparation and submission of records and results.
E The items for trial trenches and pits will be executed in accordance with the Engineer's instructions.
F CESMM3, Section C: Geotechnical and Other Specialist Processes is deleted and replaced with the one Item of
Geotechnical and Other Specialist Processes as detailed in the Bill of Quantities.
This Item is to be priced to include all Geotechnical and Other Specialist Processes.
G CESMM3 Class D: Demolition and Site Clearance is deleted and replaced with the one Item of Demolition and
Site Clearance as detailed in the Bill of Quantities. This Item is to be priced to include all Demolition and
Site Clearance works.
H Items for demolition and site clearance shall also include disposal of the materials arising
except as otherwise directed.
I The price for general clearance of trees, bushes, other vegetation and debris shall include carting to tip. The limits
of general clearance work will be as instructed by the Engineer.

Earthworks
Excavation/Filling
A The quantities of earthworks shall be computed net using dimensions from the Drawings with no
allowance for bulking, shrinkage, waste or working space.
B The rate for imported fill material shall include borrow pit excavation on land,
hauling/pumping, placement and compaction in specified layers.
C No separate pay item is included for the preparation of the existing sea bed in respect of fill areas, all
preparation works such as removal of silt, mud, debris and any other works as required by the
Specifications are to be included for in the pay items for fill.
D The Contractor is required to quantify and price his Tender Design using, and where necessary, extending the form of BoQ
provided with the Tender Documents which has been produced on the basis of the Employer's Concept Design and Drawings.
In Section (e) of this document, a Grand Summary is provided for the above item and the Contractor
is to price/complete the form and carry to the Form of Tender.
