Amend the current language as follows:


Except as othenrise expressly provided, this Agreement shall be binding in all
respects upon the parties hereto effective upon ratification by both parties for the
period of August 1, 2018 through May 3l 2021, on ail buildiirg and heavy
,
construction work in the Metropolitan Area of Detroit, which is understooð to mean the
f_ollowing seven (7) counties of the state of Michigan: Lenawee, Macomb, Monroe,
Oakland, St. Clair, Washtenaw and Wayne; and thereafter, tlris Agreement shali
continue from year to year unless requesl is made by either party to change and/or
terminate the Agreement in accordance with the Renewat or Chànge Section of the
Agreement.

2. SECTION 2- EMPLOYMENT

Paragraph (b):

Add the title *Utility Operator"


(b) The Employer agrees that in the employment of workers to perform the various
classifications of labor required in the work under this Agreement, which workers are
hereinafter also referred to as Engineers, Operating Engineers, Operalors, Firemen,
Oilers, Utillty Operators, Apprentices or Employees, he will not discriminate against
applicants because of membership or non-membership in the Union. The Employer
agrees that, as a condition of employment, he will require each worker to become and
remain a member of the Union for the term of his employment after the seventh (7th)
calendar day of his employment by any Employer who is a party to this Agreement, or
the effective date of this Agreement, whichever is later. The seven (7) day period
following which a worker agrees to join the Union shall be computed from the second
day such worker enters the employment of any Employer who is a party to this
Agreement. lt is agreed that "membership in good standing" shall mean only the
payment of those periodic dues and fees germane to collective bargaining contract
administration and grievance adjustment.

For purposes of this Tabte Settlement, the partìes understand and
agree that the amount allocated to this new Fund will come from the
total Wage/Fringe package agreed upon by the parties.

t ln lieu of the existing Fringe Benefîts Package, the job


classifications listed in these 2 groups will receive the foltowing
adjusted Frínge Benefits Package; provided that, the operating
Engineers Local 324 Pensìon Fund lrusfees, based upon the
recommendatíon of the Trust Fund Professionals, do not contest the
Ímplementation of thÍs new Fringe Benefit Package:

ln the event the operating Engineers Local 324 Pension Fund


Trustees reject the adjusted Fringe Benefits Package for the z
groups indlcated above with the "t" by no later than August 31,
2018, then the newly added classificatíons Ín both groups witl not be
added to the parties' Collective Bargaining Agreement.
