AFFIDAVIT OF DESISTANCE

I, Silvestra Bautista Petallana , of legal age, married, Filipino, with

residence and postal address at 689 D Jakosalem Street, Day-As Cebu City,
Philippines, after having been sworn to, in accordance with law, do hereby
depose and state, that:

1. I am the legal wife of Cesar Petallana;

2. After serious and thorough deliberation of pursuing a case against my

husband for concubinage, I found out that the incident was just a result of my
emotional outburst following the loss of money and the misinterpretation of the
facts against my husband and Sandra Guan; and hence I finally decided to
desist from further prosecuting the case for adultery and/or concubinage
against them;

3. That I desist from appearing and is no longer interested to testify in

court, file a case against my husband Cesar Petallana and Sandra Guan;

4. As a consequence of my desistance from prosecuting the above-

entitled case; I also hereby waive all my rights as the private complainant and
other civil liabilities relative to and arising out of this case of Adultery or
Concubinage;

5. I execute this Affidavit of my own free and voluntary will without any
threat against my person nor any monetary reward or promise of any financial
consideration for the execution of this Affidavit of Desistance;

6. With this Affidavit of Desistance, I humbly pray that the Honorable Court
or Honorable Office of the Public Prosecutor shall dismiss or drop the case from its
roll;

7. Moreover, I further desist from filing any case against my husband and
Sandra Guan for the same cause of action. We have already settled our
differences and I hereby condone and further grant my CONSENT to Cesar
Petallana and Sandra Guan;
