AFFIDAVIT

I, Isabel Singh, Filipino citizen, of legal age, married to Noel Buenaventura, and a

resident of Makati after having been duly sworn in accordance with law, hereby depose

and say:

1. That on, July 12, 1992, Noel Buenaventura, filed for a petition for nullity

of marriage on the ground of psychological incapacity.

2. That on, July 31, 1995, the Regional Trial Court promulgated a Decision

which states that:

(a) Ordering the liquidation of the assets of the conjugal partnership

property [,] by ceding, giving and paying to her fifty percent of the net

amount of P3,675,335.79 or P1,837,667.89 together with 12% interest per

annum from the date of this decision and one-half (1/2) of his outstanding

shares of stock with Manila Memorial Park and Provident Group

Companies;

(b) Ordering him to give regular support in favor og his son Javy Singh

Buenaventura in the amount of P15,000 monthly amount.

(c) Awarding the care and custody of the minor Javy Singh Buenaventura

to his mother, the herein defendant.

3. On, September 2, 1996, the Court of Appeals issued a resolution

increasing the support to P20,000 a month upon the respondents motion for

increasing the support.

 4. On October 8, 1996, the Court of Appeals promulgated a decision

dismissing petitioner’s appeal for lack of merit and affirming the decision

of the Regional Trial Court.

5. On November 13, 1996, the Court of Appeals denied petitioner’s motion

for reconsideration.

6. On July 9, 1997, Noel Buenaventura’s Petition for Review on Certiorari

and the Petition for certiorari were consolidated by the Supreme Court. The

Supreme Court promulgated a decision that MODIFIED the ruling of the

Court of Appeals, which states that:

(a) In that the award of moral and exemplary damages, attorney’s fees,

expenses of litigation and costs are deleted.

(b) Ordering respondent one-half of the retirement benefits of petitioner

from Far East Bank and Trust Co. and one-half of petitioner’s share of stock

in Manila Memorial Park and in the Provident Group of Companies but in

the basis of the liquidation, partition and distribution of the co-ownership

and not of the regime of conjugal partnership of gains.
