ORDER

1. Shri Ashish, the appellant, sought the documents vide which the Haryana Government

was not bound by the NCTE minimum education qualification eligibility criteria for

recruitment of teachers in senior secondary education and also to increase minimum

percentage of 50% to 55% as minimum educational qualification for teac her’s recruitment

etc.

2. Not having received any reply from the CPIO, the appellant approached the FAA. The

FAA directed the CPIO to provide the information. Later the CPIO provided the copy of

NCTE notification dated 12.11.2014 to the appellant. Not satisfied with the reply, the

appellant came in appeal before the Commission stating that required information had not

been provided.

3. The matter was heard by the Commission. The appellant stated that unsatisfactory and

incomplete information had been provided to him.

4. The respondent was not present in spite of the notice of hearing having been sent to

them.
5. The Commission observes that the CPIO had provided a copy of NCTE notification

dated 12.11.2014 to the appellant, however, it was not clear whether there was any

rule/document under which the Haryana Government has the power to change the eligibility

criteria as claimed by the appellant. The Commission therefore directs the CPIO to revisit the

RTI application dated 13.02.2016 and provide an appropriate reply to the appellant within 15

days from the date of receipt of this order. The Commission further issues a show cause

notice to the CPIO with a direction to submit his written explanation for not being present for

the hearing within two weeks from the receipt of this order. The appeal is disposed of.
