LICENSES FOR STRATING A RESTAURANT

1. Food License for Starting a Restaurant It is one of the primary requirements to obtain a license under
FSS (Licensing & Registration of Food Businesses) Regulations 2011.

 Every restaurant owner has to first register their business with FSSAI.

 No person shall commence or carry on any food business- except under a license with an
exception of a tiny food business operator, but they shall register themselves with food
authority.

 Carrying business without a license will be treated as a legal offense thus, making the restaurant
liable to pay penalties.

FSSAI license is basically a 14- Digit registration number which is printed on food packages. Based on
Annual Turnover, a Food Business Operator (FBO) has to either apply for simple registration in FORM A
with FSSAI or apply for a License given by FSSAI in FORM B.

Below 12 Lakhs Registration FORM A

12 – 20 Lakhs State License FORM B

Above 20 Lakhs Central License FORM B

The Documents Required For FORM A Are :

 Passport size photograph of Food Business operator.

 Document for Identity Proof like- Passport, Aadhar Card ,Senior Citizen Card Ration Card, Voter
ID Card, PAN Card, Driving License, Department Issued ID.

 Supporting Documents (if any):- NOC by Municipality/Panchayat, Health NOC.

Documents Required For FORM B Are :

 Form B must be appropriately completed and signed- (in duplicate)- by the proprietor or partner
of the authorized signatory. It is mandatory for all.

 It is mandatory for manufacturing and processing units to provide a blueprint plan of the
processing units which shows the dimensions in meters or squares and operation wise area
allocation- along with name list of the Equipments and Machinery with their number, installed
capacity and horse power used.
 It is mandatory for companies to furnish the list of Partners/Proprietor/Executive Members of
Society with complete address and contact details.

 Address proof and Photo ID issued by Government authority.

 Analysis report (Chemical & Bacteriological) of water to be used as ingredient in food from a
recognized/ public health laboratory to confirm the potability- (mandatory only for
manufacturing and processing units).

 Proof of possession of premises- (Sale deed/ Rent agreement/ Electricity bill, etc.) (optional).

 Partnership Deed/Affidavit of Proprietorship/Memorandum & Articles of Association towards


the constitution of the firm. (optional) – For MoA – Three pages need to be uploaded (First page
– Certification of incorporation, Second page – Authorization of food business activity and Third
page – list of directors with addresses).

 Copy of certificate obtained under Co-Op Act – 1861/Multi State Co-Op Act – 2002, in case of
Co-operatives- (wherever applicable).

 NOC & Copy of License from manufacturer- (mandatory for re-labels and re-packers only).

 Food Safety Management System plan or certificate (if any).

 Source of milk or procurement plan for milk- including location of milk collection centre’s etc. in
case of Milk and Milk Products processing units(wherever applicable).

 Source of raw material for meat and meat processing plants. (wherever applicable)

 Pesticide residues report of water in case of units manufacturing packaged drinking water,
packaged Mineral water and/or carbonated water from a recognized/ public health laboratory.

 Recall plan wherever applicable- with details on whom the product is distributed. (optional)

 NOCs from Municipality or local body (optional).

 Form IX: Nomination of Persons by a Company along with the Board Resolution.

 For Transporters-Supporting documentary proof for Turnover or self declaration of number of


vehicles.

 Upload Production unit photograph and

 Declaration form.

Documents For FORM C Are:

 List of Directors with full address and contact details (mandatory for companies only).
 Photo ID and address proof issued by Government authority of
Proprietor/Partner/Director(s)/Authorized Signatory. (optional)

 Authority letter with name and address of responsible person nominated by the manufacturer
along with alternative responsible person indicating the powers vested with them viz assisting
the officers in inspections, collection of samples, packing & dispatch.

 Proof of possession of premises. (Sale deed/ Rent agreement/ Electricity bill, etc.) (optional).

 Partnership Deed/Affidavit/Memorandum & Articles of Association towards the constitution of


the firm. (Optional).

 Copy of certificate obtained under Co-Op Act – 1861/Multi State Co-Op Act – 2002 in case of Co-
Operatives. (Wherever applicable).

2. Health Trade License For Restaurant

The restaurant owner has to obtain a health/trade license which is issued by the municipal corporation
or the health department of the concerned state.

3.License For Eating House

The restaurant owner has to apply for the Eating House License under the city/state police headquarters
and the police commissioner – Licensing- that’s is authorized to grant this license.
In most of the cities the applicant can apply online for grant of the registration certificate.
REGISTRATION FEES:- The registration fee payable for every new certificate of registration shall be
Rs.300/-(Three Hundred Rupees) (Subject to revision).• For renewal, it is Rs. 100/- (One Hundred
Rupeesper year (Subject to revision) .

4.Fire Security Certificate

The restaurant premises should have proper fire security arrangements. One has to acquire NOC from
the fire department for this. Once you apply, the inspection would be carried out and the decision will
be taken by the officials of the Fire Department for the grant of the NOC.

5.Liquor/Bar License

The Liquor license L-4 (L-17 as per new excise rule) is required if Liquor is served in the restaurant. The
Liquor license can be obtained from the Excise Commissioner of the city/region of the state.

6. Approval/Re-Approval Of A Restaurant

If restaurants are looking to acquire L-4 license then they have to take prior approval from the
department of Tourism of the Govt. of India in the concerned state.

7. Lift Clearance

The restaurants with multi story building premises shall have to get clearance from the electrical
inspector of the office of the labor commissioner- to ensure that the lift operations comply with the
safety norms.

8. License For Playing Music/Video


If recorded music or video is to be played in the premises then one has to obtain a license in compliance
to the Copyright Act of 1957 and the license can be obtained from Phonographic Performance Limited or
Indian performing Right Society.

10.Environmental Clearance
A NOC from the pollution board of the city/state is required by the restaurants for ensuring that their
activities are not violating pollution norms.

11.Restaurant Insurance Required


The restaurants have to take insurance for public liability, Product liability, fire policy & for building &
Asset. Insurance policies can be obtained from any insurance company providing such insurances.

12. Signage License


Restaurants can obtain this license from the local civic bodies like Municipal Committee or City
Corporation.

13.Shop & Establishment Act

Restaurants have to obtain license under the prescribed Act as applicable to the concerned state.

14.Approval From The Weights & Measures Department

As per the Legal Metrology Act, 2009, you have to go for the Approval of models of weighing &
measuring instruments from the Weights & Measures Department.

It is the duty of the owner of the restaurant to ensure that all the requisites like obtaining licenses and
their timely renewal.
PERFORMANCE LICENSE

DOES YOUR EVENT NEED A PERFORMANCE LICENSE?


If your event is of the nature of a musical, dancing, dramatic, mimetic, theatrical or other
performance for public amusement or any public exhibition or diversion or game or any assembly
for Public Amusement you need to obtain a Performance License.
SINGLE WINDOW FACILITY:
The licensing branch with the intention to facilitate the organisers has now introduced single
window facility exclusively for all Licensed Premises Click to Download. This facility allows the
organisers to obtain Performance License from this office as a one stop solution. Thus where the
organisers had to obtain clearance for each event from five different agencies viz local police,
traffic, fire, electricity & entertainment tax office, now they have only to approach the Licensing
Unit.
RATIONALE:
The licensed Premises are those venues that have obtained License from this office after thorough
scrutiny of all relevant safety parameters. Moreover, their license is renewed every year hence it
was unduly harsh on the organiser to insist on obtaining clearance for each event from different
agencies viz local police, traffic, fire, electricity and entertainment tax office. This system, however,
rests on a clear cut delineation of responsibilities -
Responsibility of the Management of the Premise where Single Window Facility is provided:
The responsibility of furnishing NOC of Fire Department as well as the Electrical Department to this
office in time is solely with the Management of the Premises which is offering their premises to the
organizer for the performance. The management of the premises has to ensure that the organizer is
briefed about the procedure and the requisite Application Form and the Affidavit are made
available to the organizer well before confirming the booking of the venue, against proper receipt.
Responsibility of the Organizer:-
The organizer of performance is only responsible for the content of the programme, its ticketing
and the electrical equipments and other props etc that will be used by them for the show. He shall
take all modern and approved precautions for the prevention of any accident and shall abstain from
any act which may tend to cause fire or explosion.
PROCEDURE:
1 DOCUMENTS TO BE SUBMITTED FOR PERFORMANCES BEING HELD AT LICENSED PREMISES :

3. Affidavit to be submitted by applicant on a non-judicial stamp paper worth Rs.10/- duly attested
by a Notary Public and Notary stamp of Rs 5/- Click to Download
4. No Objection Certificate from Entertainment Tax department (In case the event is ticketed)
1. PROCESSING OF DOCUMENTS:
These documents are to be submitted by organizer/applicant at least one week before the event.
Once the thorough scrutiny of forms is done the applicant is granted Performance License. Apart
from this if the event involves ticketed Performance a License to sell tickets is also issued. This is
granted at the Public Dealing Counter Lounge II between 9.30 - 12.30 on any working day (Monday -
Friday).
SPECIAL PROCEDURE:
In case of Premises with multiple auditoriums (eg Siri Fort) special procedure is followed. The
following aspects need special attention
1 The expected number of spectators/audience shall be specifically mentioned by the applicant in
the application form.
2 The number of spectators/audience shall not be allowed to increase the maximum sitting
arrangement in the auditorium and an undertaking to this effect is to be taken from the organizer.
3 The performance license may be not be granted for two performances for the same day if there is
clash of timings in order to ensure that traffic congestion does not take place.
4 In case there is an application for the grant of permission to an event that has successive shows, it
shall be ensured that sufficient gap (minimum one hour) is maintained between the shows.
5 The management of the auditorium shall issue a conditional booking slip to the organizers that
would be contingent upon the organizer approaching the licensing unit within ten days, failing
which it shall be presumed that the booking stands cancelled.
6 In order to avoid traffic congestion it shall be ensured that fixed number of traffic labels (as per
samples provided by the organizer) duly numbered and stamped by the auditorium management
are issued in order to restrict the free circulation of passes.
PROCEDURE FOR OTHER VENUES:
In case of events at all other venues/non-licensed premises which includes - Open Grounds , Road
Shows , Exhibition grounds , School Auditoria etc. the applicant has to submit following documents
at least 30 days in advance along with following documents

4. No Objection Certificate from Entertainment Tax department (In case the event is ticketed)
After receipt of these documents in Letter soliciting No Objection Certificates/Comments from Local
& Traffic Police, Delhi Fire Service, Electrical Department and also Auto Engineer of MCD (In case
Jhulas/Joy rides are to be installed) is issued on same day by Performance License Section. Copy of
this is also given to the organizer/applicant for liaisoning with these departments.
Things to be kept in mind
1. Delhi Fire Service, Electrical department and Auto Engineer issues No objection Certificates only
after inspecting the site (Inspection is done after organizers have erected stage/ shamiana/ pandal/
tents/ kiosks/ stalls/ joy rides/ jhulas/ electrical fittings etc. for the event)
2. The applicant must submit following documents to Fire Department prior to inspection.
(a) Lay-Out plan of the programme having sufficient Nos. of exit points.
(b) Lab test certificate of fire retardant fabric if erecting Pandal/Shamiana/Tent.
3. Inspection fee has to be deposited to Electrical Department for inspection of site/premises.
Once all the N.O.C‘s are obtained then the final Performance License is granted by this office after
thorough scrutiny of papers.

SPECIAL PROCEDURE:
The procedure as outlined above differs in certain respects in the case of the following.
1 Melas having Jhullas /Ramlilas- In case of Melas the procedure has been streamlined in
consonance with ground reality with the objective of reducing the last minute
uncertainty/harassment that the organizers of the Melas have to go through. Now the Applicant
has to apply to the Licensing Unit much in advance along.
with the following documents-

1.3 copy of the agreement between the main management and the organizer of the Mela.
1.4 Copy of the N.O.C. granted by the land owning agency.
1.5 Detailed site plan of the area showing the exit, entry, parking space etc
Once these documents are received report is called form the Local Police and form Traffic Police. On
the basis of the report so received a Conditional Performance License is granted to the Applicant.
This Performance License is simultaneously endorsed to the Chief Fire Officer, Electrical Inspector,
Executive Engineer (Auto) and the Entertainment Tax Officer for necessary action and
initmation. This Performance License is conditional and is contigent upon the organizer/applicant
abiding by all the conditions as well as submitting the Electrical safety Click to Download and Fire
Safety Certificates Click to Download and the Clearance from the Mechanical Inspector (Auto) one
week prior to the date of the Mela.
2 CIRCUSES:
In Case of Circuses apart from the N.O.C's from the local police, traffic, fire, electricity department
and entertainment tax officer, the organizer is required to submit a detailed specification of the
construction of any tent or building proposed to be utilized in accordance with the Regulation-97 &
98 of Chapter-VII.
3 ROAD SHOWS :
3.1 Application form with full particullars.
3.2 Booking letter/slip of the premises or the N.O.C of the Land Owing Agency.
3.3 A detailed specification of the construction of any tent or building proposed to be utilized in
accordance with the Regulation - 97 & 98 of chapter-VII. If so then NOC from the fire department is
necessary.
