[5] The VENDOR promise and confirm that he have not entered
into any other sale Agreement with any Third Party with respect of
the Schedule Property herein and the said Property is free from
any encumbrance, mortgage, charge, lien, gift, settlement,
bequeathal, Court Attachment, pending litigation, proceedings
etc., other than the facts mentioned in the Sale Agreement.
[6] The VENDOR agree and undertakes that he will extend their
full support and co-ordination in completing the various
requirements stated in the sale agreement and inter related
procedures and further agrees and undertakes to sign, execute any
deeds or documents which enables to PURCHASER to complete
the sale transaction.
[8] The VENDOR likewise clarify that they have not in any way
encumbered the Schedule mentioned property or contracted to sell
the same either in whole or in parts to any of their nominee/s and
in the event of any such claims surfacing the VENDOR shall in
their individual capacity cause to make good the same, without the
involvement of the PURCHASER herein.
[9] This Agreement shall be in full force until all the transactions
contemplated herein are fully and effectively completed.
[11] Both Parties herein agree that if either party fails to fulfill any
of their obligations under this Agreement for sale, the Party not at
fault shall have the right to sue the other party for specific
performance of this Agreement for Sale with or without damages
as per the Clauses of the Transfer of Property Act.
SCHEDULE
All the piece and parcel of Vacant land, bearing plot No.XII,
measuring 1800 sq.ft. in K.G.T.Nagar, sanctioned and approved
by CMDA, vide PPD/Layout No.94/2005, letter No.
L1/2578/2005, dated 19.10.2005, Comprised in Survey No.
64/1A,( As per patta No. 1407 S.No. 64/48) in Goparasanallur
Village, Poonamallee Taluk, Thiruvallur District, being,
