In case of my failure to pay when due and payable any sum which I am obligated to pay under this
Note or under any obligation which I may now or in the future owe to said __________________________________
or in the event of bankruptcy, insolvency, receivership, levy on execution, garnishment or attachment or
in case of conviction of a criminal offense by final judgment carrying with it the penalty of civil
interdiction affecting us, or in any cases covered by Article 1198 of the Civil Code of the Philippines, then
the entire sum outstanding under this Note, including any accrued interests and charges, shall
immediately become due and payable without the necessity of notice or demand which I hereby waive. In
addition, I hereby promise to pay the penalty and collection charges at the rate of three percent (3%) per
month on the total amount due until finally paid as liquidated damages. _________________________________
shall likewise have the right to proceed against the security/ies and/or collateral/s, if there be any, to
satisfy the total amount due. Should the amount of the security/ies and/or collateral/s be insufficient to
answer for the total amount due, ________________________________ shall have the right to collect the balance of
the total amount due and/or proceed against any of my personal and/or real properties until the total
amount due be fully satisfied.

Any renewals, either in whole or in part, extensions or acceptance by _______________________________

any payment or any part thereof made by us after due date shall not be considered as extending the time
of payment of our obligation or result in the novation or modification of the conditions of this Note. The
failure of _______________________________, to exercise any of its rights under this Note shall not in anyway
constitute or be deemed to be a waiver of such right.

Should ______________________________________ resort to the Courts of Justice for the enforcement or

protection of its rights or redress of its grievances under this Note, I hereby agree and affirm to pay
_______________________________________, all costs and expenses of litigation plus Attorney’s Fees equivalent to
25% of the total amount due, but in no case shall be less than P5,000.00. I further affirm and agree that
any and all actions arising from or in connection with this Note shall only be instituted in the proper
courts of Quezon City to the exclusion of all other courts.

I hereby waive our application of payment under Article 1252 of the Civil Code of the Philippines
especially in the case where we have more than one (1) obligation in favor of _______________________________,

herein and in such other related documents, such as, but not limited to, the name of the parties, the
