AFFIDAVIT OF ADVERSE CLAIM

I, JUNAFEL C. BESA , of legal age, Filipino citizen, married to


ROSEFIN B. BESA, residing at 5 Piko Street, Carreon Subdivision,
Novaliches, Quezon City, after having been sworn in accordance
with law, do hereby state that:

1. On July 19, 2006, I entered into a Deed of Absolute Sale


with Spouses Delfin U. Centeno and Chona B. Centeno, both
Filipinos and residents of 32-B Simoun Street, Sta. Mesa Heights,
Quezon City over a parcel of land located at Del Nacia Ville,
Talipapa, Novaliches, Quezon City, covered by TCT No. RT-80957
(284949) and more particularly described as follows:

“A parcel of land (Lot 4, Block 7 of the


consolidation subdivision plan (LRC) Pcs-10797,
being a portion of the consolidation of Lot 3,
(LRC) Pcs-9723, Lots 106-B-1-A, Lot 106-B-10-
B, Lot 106-B-10-C, all of (LRC) Pcd-43777, Lots
106-B-11, (LRC) Psd-12554 & Lot 105-A-2-B-2-E-
1, (LRC) Psd 114921, LRC Rec. No. 5975),
situated in the Dist. Of Balintawak, Quezon City,
Island of Luzon xxx xxx xxx; containing an area
of TWO HUNDRED TEN (210) SQUARE
METERS, more or less”

A duplicate original copy of said Deed of Absolute Sale in the


amount of P845,000.00, notarized before Notary Public Aurora V.
Flor (Doc. No. 314; Page No. 63; Book No. IV; Series of 2006) is
attached as Annex A and made an integral part hereof.

2. In the process of transferring the ownership of the


above-described property, my wife undertook the payment of the
necessary internal revenue taxes in the amount of P70,875.00 with
the Bureau of Internal Revenue and as a result thereof, was issued
the corresponding BIR Form 1954, or the Certificate Authorizing
Registration CAR 00002530 dated July 20, 2006, by Florante C. de
Castro, Revenue District Officer

A duplicate original of said Certificate is attached as Annex B


and made an integral part hereof.
3. Since we will need the Owner ’s Duplicate of said TCT
No. RT-80957 (284949) to surrender the same to the appropriate
government agency and complete the process of transfer of
ownership, we sought the same from the seller, the spouses
Centeno, who then handed to us said Owner ’s Duplicate certificate
of title. We then proceeded to the Quezon City Register of Deeds on
November 24, 2006 to submit all our supporting papers, including
the Deed of Sale, CAR and the said Owner ’s Duplicate title.

4. To our complete surprise, we were informed that the


document we had in our custody, said Owner ’s Duplicate of TCT No.
RT-80957 (284949) “is a false and unlawful reproduction of Owner ’s
Duplicate Certificate of title issued by the Registry of Deeds of
Quezon City xxx xxx After a thorough and careful examination of the
said title, the same appears to be spurious.”

A Memorandum attesting to the foregoing was annotated on


said certificate, a photo-copy of which is attached as Annex C and
made an integral part hereof.

5. Among the bases for this declaration coming from the


Register of Deeds was the fact that the Original Copy of TCT No.
RT-80957 (284949), which is necessarily a mirror version of the
Owner ’s Duplicate certificate does not resemble the certificate of
title provided us by the sellers, Spouses Centeno.

A certified true copy of TCT No. RT-80957 (284949) is


attached as Annex D and made an integral part hereof.

6. Moreover, the spurious Owner ’s Duplicate title was


officially confiscated by the Office of the Register of Deeds, in order
that the same may be referred to the Land Registration Authority for
verification and further appropriate action.

A copy of an Acknowledgment Receipt dated November 24,


2006, signed by Atty. Elbert T. Quilala is attached as Annex E and
made an integral part hereof.

7. On account of the foregoing circumstances, we are


extremely apprehensive and fearful that our hard-earned money,

used as payment for the property covered by TCT No. RT-80957
(284949) may be lost. I am constrained to resort, declare and
protect our rights to the property covered by said certificate of title,
which rights emanate from our purchase of said property, as adverse
to that of the present registered owner, Spouses Delfin U. Centeno
and Chona B. Centeno.

8. I am executing this Affidavit for purposes of attesting to


the truth thereof and to seek annotation of said Affidavit as an
Adverse Claim upon TCT No. RT-80957 (284949).
