Do Filipinos Need a Divorce Law

Atienza: Children will suffer

: Marriage is inviolable, you cannot touch it, you cannot change it

Beth Angsioco: Annulment & Legal Separation isn’t enough

(She also quoted that “I’m not losing hope just because of the president’s statement on
divorce: He has reversed a lot of his statements”)

Points:

1. Legal Separation does not dissolve the marriage banns : it is not just the case of
getting married immediately after a separation but a case of breaking the
power a man has over a woman due to cases of abuse
2. The problem of annulment is different from divorce because it declares one’s
marriage void from the beginning like it never happened therefore the grounds
should have existed before or during the wedding ceremony- which then result
to a lenghty time and procedure due to need of services of psychologists and
psychiatrist.
3. What is happening now even valid marriages are told that “that marriage” is not
valid from the very start which goes off as hypocrisy.

Karen Davilla: Annulment is hypocritical for an example of a husband having a child


from the first marriage and that the marriage is null and void.

Beth Angsioco: If annulment is allowed in some situations why not allow divorce as it
was proposed in the house bill 1799

Divorce law may be beneficial to couples’ children (2016)

: Divorce law will hugely help especially women who are in abusive relationships

Divorce affects the children BUT parents should be responsible enough of what
situation the family is in. There are longitudenal researches about how good is it for
children to have their parents be separated than having the children continuously
witness what happened in the family.
The spouses are already protected and covered by the law, the Family Code.

Is the divorce bill allowed in the constitution?

Rep. Colmenares: Divorce existed in spanish time: CIVIL CODE OF SPAIN WHICH ALLOWS
DIVORCE the catholic church just did not allow it.

:American period: there is a divorce law Divorce act of 1917

1935- Divorce is there and there are a lot of cases of it in the supreme court

1970 not done due to civil code

Divorce cannot prohibit the law that Marriage is inviolable because the COMISSION
according to Rep. Neri Colminares (2011) recognizes marriages that are irreconcilable

If there is abuse, infidelity, or serious cases the constitution cannot legislate the
marriage, the love, the respect but let the law give Divorce if needed.

Liza Maza: In our society today we cannot tell that marriage is truly inviolable because
there is already Legal Separation, there is Annulment which then paves way to the
allowance of the separation of spouses.

: There is also Article 26 which tells that if you are married to a foreigner and your
spouses wanted to divorce and is granted one in America, that means you can legaly
marry too. Which is recognized by the law. Now for those who are telling that Divorce
prohibits the constitution, this is the answer that it does not say anything about it
violating the constitution.

Colmenares: If Divorce is unconstitutional so legal separation is also unconstitutional?


For example that a husband is legally separated to a wife and they already live far from
each other, is that what real marriage is? The marriage there is just in name but in reality
that is NOT THE MARRIAGE THAT THE STATE WISHE TO PROTECT. THAT IS NOT THE
MARRIAGE THAT THE CHURCH WISHES TO DEFEND.

Ilagan: Divorce is not for everybody, not for spouses who are happy, not for spouses
who are finding solutions to fix their differences but it is for spouses who are long
separated, and are irreconcilable, and if there is abuse.

:There is a process and all means will be exhausted to fix and the fact that in the
proposed Divorce Bill, it will NOT BE GIVEN EASILY especially to irrational reasons.
